Pastor Kevin wilson, Gilroy Bible church gave the Invocation. The city Clerk noted that the Agenda had been posted on May 12, 1994 at 8:50 a.m. Present: councilmembers: K. A. Mike Gilroy, paul v. Kloecker, charles S. Morales, Connie Rogers, suellen C. Rowlison, Pete valdez, Jr. and Donald F. Gage; 7:00 p.m. The Mayor introduced New Employee: Kurt Ashley, Police officer. The Mayor presented the Employee Award for the Month of April 1994 to Jim McCann, Public Information Technician. The Mayor stated that it was the time and place scheduled for a Public Hearing to consider a Tentative Map request of Kaufman & Broad to subdivide a portion of two parcels into four- teen single family residential lots on approximately three acres, located west of Santa Teresa Boulevard, north of Longmeadow and Blacksmith Drives; TM 93-06. The Staff Report was noted and further explained by Planning Director Dorn. The Mayor asked if there was anyone in the audience wishing to speak for or against the proposal. There was no comment from anyone in the audience. The Mayor closed the Public Hearing. Motion was made by councilman Kloecker seconded by councilman Gilroy and carried that the Negative Declaration be approved as completed in compliance with CEQA, as reflectin9 the independent judgement of the city and adopting the Mitigation Monitoring Program. Z 93-10 650 ~J The Mayor stated that it was the time and place scheduled for a Public Hearing to consider a rezoning request from Al (Agriculture) and R3 (Medium Density Residential) District to Rl- PUD (single Family Residential-planned unit Development) District on 39.23 acres, and to R3-PUD (Medium Density Residential-planned unit Development) District on 13.42 acres on approximately 52.75 acres, on property located on the west side of Thomas Road, north of santa Teresa Boulevard, Thomas Road properties, Ltd. and the Glenn Lorna Group, applicants, z 93-02. The staff Report was noted and further explained by planning Director Dorn. The Mayor asked if there was anyone in the audience wishing to speak for or against the proposed rezoning. Arnold Brunetti, representing the owners, addressed the council noting his presence to answer any questions. Motion was made by councilman Kloecker seconded by councilman Gilroy and carried that the Negative Declaration be approved as completed in compliance with CEQA and reflecting the independent judgement of the city and adopting the Mitigation Monitoring Program. The Mayor stated that it was the time and place scheduled to consider a Tentative Map to subdivide 10.19 acres from 43 single Family Residential Lots, including 1 existing single Family Dwelling, on property located on the west side of Thomas Road, north of Santa Teresa Boulevard, Thomas Road properties, Ltd. and Glen Lorna Group, Applicants, TM 93-03. The staff Report was noted and further explained by planning Director Dorn. The Mayor asked if there was anyone in the audience wishing to speak for or against the proposal. The Mayor stated that it was the time and place scheduled for a Public Hearing to consider a rezoning request to amend the city of Gilroy's zoning Map from Rl (single Family Residential) to RI-PUD (single Family Residential-planned unit Development) on approximately 13 acres, on property located on the west side of santa Teresa Boulevard, north of Mantelli Drive, willard Homes, applicant, Z 93-10. The staff Report was noted and further explained by Planning Director Dorn. The Mayor asked if there was anyone in the audience wishing to speak for or against the proposal. The Mayor stated that it was the time and place scheduled to consider a Tentative Map request to subdivide thirteen acres into sixty single Family Residential Lots, on property located on the west side of Santa Teresa Boulevard, north of Mantelli Drive, Willard Homes, applicant, TM 94-01. The staff Report was noted and further explained by Planning Director Dorn. The Mayor asked if there was anyone in the audience wishing to speak for or against the proposal. Motion was made by councilman Kloecker seconded by councilman Gilroy and carried that staff be directed to prepare a Resolution approving TM 94-01. Motion was made by Councilman Kloecker seconded by council- woman Rogers and carried that the Public Hearing to consider a General plan Text Amendment to update the Housing Element of the city of Gilroy's General plan be continued to June 20, 1994. (Planning commission continued their hearing to June 2, 1994.) The Mayor recommended that Patricia Golden be appointed to fill the unexpired term (1-1-98) on the Parks & Recreation commission. Motion was made by councilman Kloecker seconded by council- man Valdez and carried that Patricia Golden be appointed to fill the unexpired term on the Parks & Recreation commission (1-1-98). The Mayor announced his proposed recommendation on the appointment to the Library & culture commission vacancy to be Leah Halper who has declined the appointment and requested councilmembers notify the city Clerk of their second choice for appointment at the next regular council Meeting. councilwoman Rowlison noted that another opening on the Library & culture commission is anticipated due to the recent resignation of one of the commissioners. The Mayor noted that Council would request new applications for said vacancy. Discussion was had regarding potential new commissions that may be formed, i.e. Film commission and possible charter amendments pertaining to Commissions. Discussion was had regarding a proposed ordinance amending Chapter 25B of the Gilroy city code relating to the Transporta- tion Demand Management Program further explained by councilman Kloecker. Motion was made by councilman Kloecker seconded by councilman Valdez and unanimously carried that the proposed ordinance be read by title only and waived further reading of the ordinance. The Clerk read the title of the ordinance. Motion was made by councilman Kloecker seconded by councilman Valdez that the proposed ordinance be introduced and published by title and summary. 94-95 Budget plancom 5-5-94 A/s 94-4 6503 city Administrator Baksa distributed copies of the 1994-1999 Budget noting the first study session on the Budget is scheduled for May 18, 1994 and will be televised. The following informational items were noted with no separate discussion on same except as noted: customer service: Fire Chief re: swiftwater Rescue Team; Fire Chief's Inter-office Memo to Chemical control Division re: Pre-Treatment Program, Police chief's Inter-office Memo of congratulations to officer svardal; Gilroy Foods, Inc. League of California cities Legislative Bulletins; Bulletin #15-1994; Discussed AB 3822 regarding juvenile incarceration and parole. city Administrator Baksa noted that he would keep abreast of this proposed legislation; councilman Kloecker noted that he would be attending a meeting Thursday with ABAG's Legislative Committee and would note the city's concern; Bulletin #16-1994; and Bulletin #17-1994; city of Gilroy'S state Finance Department's population Estimate January 1, 1994 (33,264); Proclamations Issued by Mayor Gage: congratulations to Avenues to Mental Health, lnc. on Fortieth Anniversary; south valley symphony week - May 15-21, 1994; 48th Anniversary of the Founding of the Italian Republic; Monthly Cash and Investments Report - March 31, 1994; and Informational Bulletin, willdan Associates, April/May 1994. The Report of the Planning commission Meeting of May 5, 1994 was noted. The staff Report on AS/94-4 was noted and further explained by Planning Director Dorn. Motion was made by councilman Kloecker seconded by council- woman Rowlison and carried that A/S94-4 planned Unit Development on property zoned R1-PUD (single Family Residential) planned Unit Development for 14 Lot single Family Residential subdivision on three acres, located west of santa Teresa Boulevard, north of Longmeadow and Blacksmith Drives, Kaufman & Broad, Applicant be approved as presented. city Administrator Baksa noted an update on the Water Conservation program. city Administrator Baksa distributed a proposed List of upcoming items for future council Agendas through August 1, 1994. city Administrator Baksa distributed a staff Report on the zoning Ordinance proposed amendments forthcoming on the next 6506 Planning commission agenda and requested any concerns be directed to the Planning Department. city Administrator Baksa noted staff met with Local building contractors concerned with requirements of the Residential Development Ordinance noting that the Development Review committee will be studying their concerns and will report back to council in approximately two months. city Administrator Baksa noted the council Joint study session in Morgan Hill on May 26, 1995 at 6:00 p.m. to 8:00 p.m. re: Refuse Rate Review. city Administrator Baksa noted the council Joint study session in Morgan Hill on June 1, 1994 at 4:00 p.m. to 6:00 p.m. re: Cable TV. The Mayor noted a resignation of Dyan Tinsley from the Library & culture commission. The Mayor noted suggested dates from wheelchair Garlic Pressers June 4th, 11th, 18th and 25, 1994 - 2:00 p.m. and requested council notify City Clerk of their preference. councilman Valdez noted that the 11th, 18th or 25th is okay with his schedule. Discussion was had regarding the Joint Venture: silicon valley Network further explained by councilwoman Rowlison suggesting that the city donate $2500.00 to be discussed at the 1994-95 Budget study Sessions. Councilman Morales noted that he attended the strategic Planning session for the School District to be further explained by councilman Kloecker. councilwoman Rogers gave an update on the visitors' Bureau and noted that she and Councilwoman Rowlison attended a Tourism Luncheon in Santa clara. councilman Gilroy noted the senior skills Workshop at their July 6th meeting at 10:00 a.m. requesting councilmembers attend to include lunch. councilman Kloecker recommended that the city support the Joint Venture of Silicon valley Network and that Monterey County has recently started a similar proposal directed toward tourism and agriculture that might be adaptable to the City's partici- pation. councilman Kloecker reported on the strategic Planning of the School District that he and councilman Morales attended noting that one of the proposals will be for all students to participate in community service and that he will have a summary of the proposal for council review. councilwoman Rowlison noted the event scheduled on senior Day - May 20, 1994 at 6:00 a.m. for sale of newspapers in support of wheeler Manor. councilman Kloecker noted that the Santa clara county cities Association May 19, 1994 meeting has been cancelled due to lack of reservations.
