city Administrator Baksa presented and explained a recom-
mendation to award bids for street maintenance materials.
Motion was made by councilman Kloecker seconded by
councilwoman Rowlison and carried that the eight (8) bids for
street maintenance materials be awarded as recommended.
The Mayor stated that it was the time and place scheduled
for the continued public Hearing to consider a General plan
Amendment request to increase residential density on 10.2 acres
from Low Density Residential to Medium Density Residential,
located west of Kern Avenue, east of Santa Teresa Boulevard and
north of Welburn Avenue, along the planned extension of Mantelli
Drive, Filice Family Estates, GPA 93-02. (continued from 3-21-
94, 4-18-94, 6-6-94, 7-5-94 and 7-18-94.)

The staff Report was noted and further explained by
Planning Director Dorn including modifications to the mitigation
measures agreed upon by the applicant.
The Mayor asked if there was anyone in the audience wishing
to speak for or against the proposal. The following addressed
the council:
Marie Juncker, Executive Director, south county Housing,
7455 Carmel street, representing the applicant, noting they agree
to improvement of one-half of Kern Avenue and installation of
sidewalks by Rod Kelly school and agree to improvement of the
extension of Mantelli Drive. She further noted that a decision
for approval of this project is needed in order to receive
funding for their project.
shannon Kara, 848 Ramona Way, noting concern for the
increase of traffic in the area as a result of the proposed
project. she noted that no crosswalks are proposed for children
crossing the street at Ramona on Kern Avenue. She opposed the
density of homes to be allowed and requested extension of
Mantelli Drive to santa Teresa Boulevard.
Mark Moore, 575 San Pedro, Morgan Hill, Board of Directors
- south county Housing, noting that this is a much needed project
for Gilroy.
Don Culver, 8539 Kelton Drive, noting he contacted the
majority of the neighborhood and explained the problems that
would result from the proposed project. He further noted numer-
ous high density projects on Kern Avenue and that the proposed
project would add to these problems. He noted that no crosswalk
proposed for Ramona Way at Kern Avenue would be a school safety
problem. He thanked south County Housing for addressing the
issue and for their positive response including the developers,
School District, city staff, City council and Planning
commissioners.
Marcia Arnold, Healthy start Consortium, noting need for
this affordable housing project.
Margaret Garces, 926 Howard Avenue, opposed to the proposed
housing project because of the increased traffic especially
during school hours. she requested Council deny this project.
Lloyd Little, 825 Ramona Way, noted that south County
Housing agreed to improving Kern Avenue, but that the right-of-
way has not been received and if the City does not have the funds
inquired if only one half of Kern would be improved. He inquired
if the drainage ditch would be improved. He noted that he is not
opposed to the development but wants it done correctly. He noted
Mantelli Drive needs to be extended to Santa Teresa Boulevard.
Wendy Filice stramitz, Ramona Way, noted the need for
affordable housing.
Debra Petro, 9045 Kern Avenue, opposed to the project
because of the increased traffic proposed. Agreed that the
extension of Mantelli Drive to Santa Teresa Boulevard would
alleviate the problem.
Mr. Gonzales, old Gilroy street, supports affordable
housing project in Gilroy and in favor of this proposed project.
Consuela Espinosa, 762 B El cerrito Way, supported this
affordable Housing project.
Sally salas, 530 Ronan Avenue, noted she works with low-
income citizens and noted the need for affordable housing in
Gilroy.
Hans K. Buror, 849 Ramona Way, criticized the traffic
impact on Kern Avenue.

Ronnie Mack, 8529 Kelton Drive, noted that there is no
guarantee that local residents would obtain affordable housing
provided by this project.
stuart Taylor, 8500 Kelton Drive, agreed with affordable
housing in some other location because of the traffic problems on
Kern, Howard and Kelton.
Michael Amet, 1181 Driftwood Terrace, in favor of
affordable housing and the opportunity to become established.
shauna Byers, 947 Howard Avenue, noted that Kern Avenue is
not designed for new projects and is concerned with students
attending Rod Kelly school. she is opposed to the proposed
general plan amendment because of traffic.
Marie Juncker, south county Housing, noted that priorities
are established for all projects; that affordability requirements
require the owners to reside in the homes purchased with deed
restrictions and that the rentals would be managed by south
county Housing. She noted that south county Housing will commit
to the west side of Kern Avenue but requested the city to work
with them regarding affordable assessment for the improvements
between Rod Kelly and Mantelli.
Richard David, corner of culp & Hoesch Way, opposed to the
high density and traffic.
The Mayor asked if there was anyone further in the audience
wishing to speak. There was no comment from anyone in the
audience. The Mayor closed the Public Hearing.
Keith Higgins, Traffic consultant, addressed the council
regarding the traffic within the proposed project.
At 9:01 p.m. the Mayor declared a Recess and reconvened the
meeting at 9:09 p.m.
Keith Higgins continued with further explanation of the
proposed traffic plans and recommendations noting same are and
will be studied as to the specific traffic patterns proposed.
Director of Public Works Allen noted several alternatives re-
garding traffic will be considered at the Tentative Map approval.
It was noted by staff that the General plan Amendment and
zoning cannot be conditioned; that council can require certain
mitigations in certification of the EIR.
Discussion was had by council on the matter.
Motion was made by councilman Kloecker seconded by
councilman Valdez and carried that the Negative Declaration as
amended for GPA 93-02 be approved as completed in compliance with
CEQA, as reflecting the Independent Judgement of the city.
Motion was made by Councilman Kloecker seconded by Council-
man Valdez and carried that staff be directed to prepare a reso-
resolution approving GPA 93-02 to include the applicant's
impr~vements for Kern Avenue.
Motion was made by councilman Gilroy seconded by councilman
Kloecker and carried that staff be directed to meet with the
school District to work out a solution for some access off of
Kern Avenue.
The Mayor noted that the Public Hearing for GPA 93-04
requesting amendment of the General plan Map for property located
at 8690 San Ysidro Avenue, between Leavesley Road and Las Animas
Avenue, Greg Mussallem and Ivan zubow, applicants, and Public
Hearing for GPA 93-03 for property at 8620 San ysidro Avenue,
David Ninomiya, Ann and Ben Koda were continued to March 20, 1995
and that the EIR portion of the public Hearing and action was
continued to this meeting.

Motion was made by councilman valdez seconded by councilman
Kloecker and carried that the EIR for GPA's 93-04 and 93-03 be
certified as completed in compliance with CEQA and reflecting the
independent judgement of the city.
The Mayor continued the recommendation on rev~s~ons to the
Affordable Housing Exemption from the RDO Process to December 5,
1994 as recommended. (continued from 7-18-94.)
councilman Kloecker explained the proposed expanded
employee definition in Air District Trip Reduction Rule requested
by Santa clara county Manufacturing Group through the Gilroy
chamber of Commerce.
Motion was made by councilman Kloecker seconded by council-
man Morales and carried that the Mayor be authorized to execute
the draft letter objecting to the proposed expanded employee
definition as presented.

city Administrator Baksa gave an update on Water
conservation program and 1994 water supply update.
old city Hall city Administrator Baksa presented an offer from the
Historical society of funds for repair and recommendation on a
schedule for the bell ringing of the clock at the old city Hall.
Motion was made by councilwoman Rowlison seconded by
councilman Kloecker and carried that the city accept funds from
the Historical society for repair of the old city Hall clock and
schedule of bell ringing.

A report on Eliot School/After school Program was noted.
city Administrator Baksa distributed a glossary of terms
used by the Police Department for various programs.
city Administrator Baksa noted the need for flexibility in
negotiating the first year's deadlines for RDO Performance
Agreements.
council requested the matter be agendized for council
review and action if necessary.
Discussion was had regarding the status of the Theatre
Angels' grant. Council authorized councilwoman Rowlison to
inquire at the County offices of the status of the Theatre
Angels' Grant and Train Depot.
councilman Gilroy complimented staff on the successful
city-wide Garage sale and noted that he would be absent at the
Joint Council/Planning commission study session september 20,
1994. The Mayor noted that he also would not be present.
councilman Kloecker explained the ABAG Proposals for
Constitutional Revisions. Discussion was had.

Motion was made by councilman Kloecker seconded by council-
man Valdez that the draft ABAG proposals for constitutional
Revisions to be voted upon by ABAG in December 1994 be accepted
by the following Roll call Vote: Ayes: councilmembers: Kloecker,
Morales, Rogers and valdez; Noes: Councilmembers: Gilroy,
Rowlison and Gage.
councilman Kloecker agreed to prepare a letter to ABAG with
Council's concerns regarding the proposed Constitutional
revisions.
councilman Kloecker noted that nominations to CMA citizens'
Advisory Committee will be continued.
