Minutes 1996/09/30 6864 Ro II Call Posting Agenda Falcon Cable TV <"",,,,-,,,,,,,,,-,,,,,-,,,,,-":''-.,-.:',,-'" Special Meeting September 30, 1996 Gilroy, California The Mayor led the Pledge of Allegiance to the Flag. Present: Councilmembers: K. A. Mike Gilroy, Charles S. Morales, Connie Rogers, Suellen C. Rowlison, Thomas W. Springer, Pete Valdez, Jr. and Donald F. Gage. - 7:00 p.m. The City Clerk noted the Agenda had been posted on September 26, 1996 - 8:20 a.m. Sue Buske, Consultant addressed the Council and summarized fmdings and recommendations regarding Falcon Cable Television's past performance and future community cable related needs and interests. The Mayor asked if there was anyone in the audience wishing to speak for or against the proposal. Mr. Larry Hans, Santa Barbara Street, addressed the Council noting his disgust with Falcon Cable's services. City Administrator Baksa recommended Council approve the fmdings and recommendations and direct Staff to implement the recommendations. Adjrnmt. 636~j Motion was made by Councilman Valdez seconded by Councilwoman Rogers and carried that the [mdings and recommendation regarding Falcon Cable's past performance be accepted and that Staffbe directed to implement Items 1-7 of the recommendations, specifically as follows: 1) To the extent permitted by law, assure through an enabling ordinance and negotiated franchise agreement that any cable system serving the City of Gilroy is designed and operated in a manner that provides adequate channel and technical capacity to meet the current and future community needs and interests of Gilroy. 2) Establish and enforce customer service standards (which exceed the minimum obligations established by the FCC) for any cable operator doing business in Gilroy. 3) Establish and enforce minimum technical performance standards for any cable operator doing business in Gilroy. 4) Meet with Falcon Cable to address the issue of past underpaid franchise fees. 5) To the extent permitted by law, assure through an enabling ordinance and negotiated franchise agreement that there is spectrum/channel capacity, equipment, facilities, and support services for community use of the cable system (PEG access) which will meet current and future community needs and interests of Gilroy. 6) Assure that access is managed and operated by a nonprofit organization established specifically for such purposes, and that an access community media center is available to citizens of Gilroy. 7) To the extent permitted by law, assure through an enabling ordinance and negotiated franchise agreement that the cable communication system(s) serving the Cities of Gilroy, Hollister, Morgan Hill, San Juan Bautista and Santa Clara County are interconnected, and that such interconnection shall also be extended to neighboring cable systems.
