Father Dan Derry, St. Mary's Catholic Church, gave the Invocation. The City Clerk noted that the Agenda had been posted on November 10, 1999 at 9:30 a.m. Present: Councilmembers: Guadalupe Arellano, Lisabeth A Gifford, Charles S. Morales, Suellen C. Rowlison, Thomas W. Springer, Anthony C. Sudol III, and K. A Mike Gilroy - 7:00 p.m. The Mayor noted a proclamation thanking Jose Medina, Secretary of Transportation, which was previously presented to Mr. Medina. Proc. - Hunger The Mayor presented a proclamation to Dina Campeau, Emergency Housing & Homeless- Consortium, for Hunger and Homelessness Awareness Week - November 14-20, ness Week 1999. Lloyd Dickson, The Mayor read and presented a letter to Lloyd Dickson, for attaining the rank Eagle Scout of Eagle Scout. Emp. Award Consent Calendar Budget The Mayor presented the Employee Award for the Month of October, 1999, to Bill Faus, Planning Division Manager, Community Development Department. His staff also presented him with a plaque for his dedication. Motion was made by Councilman Morales, seconded by Councilman Springer and carried that the following items under the Consent Calendar be approved, by the following Roll Call Vote: Ayes: Councilmembers: Guadalupe Arellano, Lisabeth A Gifford, Charles S. Property Improvement Agreement No. 99-47, Tract No. 9201, Country No. 99-47 Estates, Phase II, Stage 1, Grading & Erosion Control Plan, Portion of AP.N. Tract 9201 783-47-001, Greystone Homes, Inc. Bid-Equipping The City Administrator presented recommendations to award a bid for Well 5-02 Equipping Well 5-02, Project No. 99-CDD-514 to GSE Construction Company, Inc. in the amount of$657,300.00. Pub.Hearing Z 99-05 Motion was made by Councilwoman Rowlison, seconded by Councilman Springer and carried to award the bid for Equipping Well 5-02, Project No. 99- CDD-514 to GSE Construction Company, Inc. in the amount of$657,300.00. The Mayor stated it was the time and place scheduled for a Public Hearing on a Zoning Ordinance Text Amendment to the City of Gilroy's Zoning Ordinance to "clean up" Zoning Ordinance Section 18.30 Commercial Use Table, Section 34 Fences and Obstructions, and Section 35 Antennas and Windmills. City of Gilroy, applicant, Z 99-05. The staff report was noted and further explained by Planner I Stice, who answered questions posed by Councilmembers. The Mayor opened the Public Hearing. ".. ~+ -.) / Motion was made by Councilmember Arellano, seconded by Councilmember Gifford and carried to refer Proposed Ordinance Change # 1 back to staff for more research regarding local businesses. Motion was made by Councilmember Arellano, seconded by Councilman Springer, and carried (Councilwoman Rowlison voting no) to approve Proposed Ordinance Change #2. Motion was made by Councilman Springer, seconded by Councilmember Gifford and carried to refer Proposed Ordinance Change #3 back to staff for modification to regulate only dishes that are one meter or larger in size. Council agreed that the ordinance shall not be prepared until the two additional proposed changes are completed. Falcon Cable The Mayor noted an Emergency Ordinance ofthe City Council of the City of Gilroy granting an extension of the non-exclusive cable franchise granted to Falcon Cable Systems Company, L.P. City Administrator Baksa reviewed the need for the Emergency Ordinance to extend the current franchise agreement. Motion was made by Councilman Springer, seconded by Councilmember Arellano and carried to adopt Emergency Ordinance No. 99-21, granting an extension of the non-exclusive cable franchise granted to Falcon Cable Systems Company, L.P. ORDINANCE NO. 99-21 EMERGENCY ORDINANCE OF THE CITY COUNCIL OF THE CITY OF GILROY GRANTING AN EXTENSION OF THE NON-EXCLUSIVE CABLE FRANCHISE GRANTED TO FALCON CABLE SYSTEMS COMPANY, L.P. PASSED AND ADOPTED this 15th day of November, 1999, by the following vote; AYES: COUNCILMEMBERS: ARELLANO, GIFFORD, MORALES, ROWLISON, SPRINGER, SUDOL, and GILl\RY NOES: COUNCILMEMBERS: NONE ABSENT: COUNCILMEMBERS: NONE Com.Fac.Dist.#1 The Mayor noted an amended Resolution calling a Special Election and ballot measure wording for the City of Gilroy Community Facilities District NO.1 (Emergency Medical Services). City Administrator Baksa explained that the previous wording was not acceptable to the County Elections Division, and this amendment is required. Res. 99-86A Motion was made by Councilwoman Rowlison, seconded by Councilman Morales, and carried to adopt amended Resolution No. 99-86A calling a Special Election and ballot measure wording for the City of Gilroy Community Facilities District NO.1 (Emergency Medical Services). RESOLUTION NO. 99-86A AMENDED RESOLUTION CALLING SPECIAL ELECTION AND BALLOT MEASURE WORDING FOR THE CITY OF GILROY COMMUNITY FACILITIES DISTRICT NO.1 (EMERGENCY MEDICAL SERVICES). There was no comment from anyone in the audience. Connie Rogers commented on agenda item IX.B.4, and requested that the issue of renaming Thomas Road be reagendized. Sandoe Hanna explained that the Thomas name has extensive Gilroy history, and requested that the name remain on the roadway. Motion was made by Councilwoman Rowlison to agendize this issue for December 6, 1999, and the motion died for lack of a second. Councilmember Gifford stated that she hoped that the advocates requesting reproductive services at St. Louise Regional Hospital back off, for fear of losing the urgent care facility that we have. Councilmember Rowlison stated that hopefully the advocates will continue and that the hospital will gain those services back. The minutes of the Advisory Council of the Council on Aging meetings of August 30, 1999 and October 4, 1999 were noted. The minutes of the South County Regional Wastewater Authority meeting of October 26, 1999 were noted. The minutes of the Planning Commission meeting of October 7, 1999 were noted, and the report of the Planning Commission meeting of November 4, 1999 was noted. The City Administrator noted January 28 & 29, 2000 is the tentative date set for the annual retreat. He stated that he just completed the tenth year of new employee customer service training. He distributed the Third Quarter 1999 Goals and Objectives. The Mayor commented on the dedication of Las Animas Veterans Park on Veterans Day. Councilwoman Rowlison stated that she attended her final VT A meeting. She stated that there will be a joint meeting of the VTA and the Santa Clara County Board of Supervisors on November 22 to talk about Measure A/B. She noted the publication Staying on Track by Peninsula Rail 2000. She stated that there will be a meeting of elected officials on November17 regarding the Pajaro River Watershed Joint Powers Authority mandated by AB 807. Councilman Morales agreed that the ceremony was successful on Veterans Day and encouraged the public to attend these ceremonies. Councilman Sudol thanked Councilmembers Rowlison and Gifford and Mayor Gilroy for the opportunity to serve with them, noting that it has been a learning expenence. Councilmember Gifford noted that she discussed the parking slots between 4th - 6th Streets with Community Development Director Allen. After staff review of the downtown parking, it was agreed that the area will be restriped, and we will gain about five parking stalls. It was noted that each parking slot is worth about $10,000 in land value. She requested citizens come down to City Hall to see the veterans display. Councilmember Arellano questioned what happened to the list of what Councilmember covers Planning Commission meetings. She requested a copy of the current list, and it was noted that this may be an item to discuss at the retreat. She stated that she attended the Housing Summit on November 5, that it was well attended, and that she has information if anyone wants to see it. She stated that she appreciated the Veterans Day ceremony and encouraged more people to attend. She commented that she talked to the Salvation Army and questioned if Councilmembers would like to ring the bell for donations this holiday season.
