The Mayor noted that Councilmembers Sudol (ill) and Velasco (will be late)

to July 16, 2001. He stated that he is moving Item VI.E. to be the first public
hearing. He stated that staffhas requested that Item v.A. be continued to July 16,
2001.

Vol. Award The Mayor noted that Mona Banuelos, Volunteer of the Month of May, 2001,
was not present to receive her award, and will defer the presentation to July 2,
2001.

At 8:44 p.m. the Mayor called for a recess, after which he recalled the meeting

2001-2006 Financial Plan of the City of Gilroy.
The Mayor opened the Public Hearing. There being no comment, the Mayor

2001 Capital Improvement Budget.

The Council took no action on establishing voluntary expenditure ceilings for
candidates and controlled committees in municipal elections.
Councilman P. Arellano requested a Charter amendment setting a runoff
procedure for the Mayoral election, should no candidate receive a majority vote.
Motion was made by Councilman P. Arellano, seconded by Councilmember G.
Arellano and carried (Councilmembers Sudol and Velasco absent) to direct staff to
prepare a resolution amending the Charter to change the election of Mayor from a
plurality vote of the electors to a majority vote, with the possibility of a runoff
election if no candidate receives a majority vote.
Motion was made by Councilman Pinheiro, seconded by Councilman Morales
to direct staff to prepare a resolution to move the Municipal election for Mayor to
November in even numbered years and extend the Mayor's term one extra year
one time only and the following amended motion was voted on first.
Motion was made by Councilman P. Arellano, seconded by Councilman
Morales and carried (Councilmembers Pinheiro and Springer voting no and
Councilmembers Sudol and Velasco absent) to amend the previous motion to
move all Municipal elections to November in even numbered years and extend the
Mayor's and Councilmembers' terms one extra year one time only.

and carried (Councilmembers Pinheiro and Springer voting no and
Councilmembers Sudol and Velasco absent) to direct staff to prepare a resolution
to move all Municipal elections to November in even numbered years and extend
the Mayor's and Councilmembers' terms one extra year one time only.

The Mayor stated it was the time and place scheduled for a Public Hearing on
a Zoning Ordinance Text Amendment to the City of Gilroy's Zoning Ordinance for
the addition of two new sections, specifically Section 43 Street Merchandising, and
Section 44 Street Furniture Obiects, and amending the Gilroy City Code, Article
VI, Sidewalk Obstructions. City of Gilroy, applicant, Z 01-04.
The staff report was noted and further explained by Planner I Polubinsky.
The Mayor opened the Public Hearing. There being no comment, the Mayor
closed the Public Hearing.
Motion was made by Councilman P. Arellano, seconded by Mayor Springer
and carried (Councilmember G. Arellano voting no and Councilmembers Sudol
and Velasco absent) to direct staff to prepare an ordinance approving Z 01-04 for
Section 44, amendments to the City of Gilroy Zoning Ordinance, with changes to
Section 44.20 (3) changing the wording "in front" to "along" and "30 inches" to "5
feet".
Motion was made by Councilman Morales, seconded by Councilmember G.
Arellano and carried (Councilmembers P. Arellano and Springer voting no and
Councilmembers Sudol and Velasco absent) to direct staff to prepare an ordinance
approving Z 01-04 for Section 43, amendments to the City of Gilroy Zoning
Ordinance, with changes to Section 43 to reword (4) to be clearer and to add the
requirement that a certificate of insurance be submitted to the City of Gilroy.
Councilman Pinheiro stated for the record that he voted for this to give
merchants a chance to prove that the City was wrong, but if the City is right and if
it gets out of hand again, he stated that he will bring it back to the Council.
Motion was made by Councilmember G. Arellano, seconded by Councilman
Pinheiro and carried (Councilman P. Arellano voting no and Councilmembers
Sudol and Velasco absent) to direct staff to prepare an otdinance approving Z 01-
04, amending the Gilroy CiW Code.

Econ.Incentive The Mayor noted an Economic Incentive for Garlic Farm RV Park, 5878

Howard Vierra noted his concerns regarding the wording in the Economic
Incentive regarding page 4 (3) regarding 90 days, requesting it be extended to
possibly 120 days, and also requested he and the City negotiate the amount of the
City fees.

returned at 10:06 p.m.)

Motion was made by Councilmember G. Arellano, seconded by Councilman P.
Arellano and the motion failed (Councilmembers Morales, Pinheiro, and Springer
voting no, and Councilmembers Sudol and Velasco absent), to continue this
request to July 2, 2001.
Motion was made by Councilman Pinheiro, seconded by Councilman Morales
and carried (Councilmembers G. Arellano and P. Arellano voting no, and
Councilmembers Sudol and Velasco absent) to approve the economic incentive for
$635,197.84, which shall be reviewed by stafffor possible adjustment, and to also
extend the time on Page 4 (3) from 90 days to 120 days.
Councilman Morales stated for the record that he seconded the motion,
because staff, by their own admission, made an oversight.

Econ.Incentive The Mayor noted consideration of Economic Incentive for Truck/RV
Truck/RV Maintenance Facility, 5870 Monterey Road, Howard Vierra, applicant.

Community Development Director Allen reviewed the request.
Howard Vierra stated that the fees have already been paid. He noted that
Garlic Farm Annex LLC is the guarantor of this economic incentive.
Motion was made by Councilman Pinheiro, seconded by Councilman Morales,
and the motion failed (Councilmembers G. Arellano, P. Arellano, and Velasco
voting no, and Councilman Sudol absent) to enter into negotiations and prepare an
economic incentive for $146,400.00 for the Truck/RV Maintenance Facility.
Motion was made by Councilman Velasco, seconded by Councilmember G.
Arellano and carried (Councilman P. Arellano voting no, and Councilman Sudol
absent) to continue to July 2,2001 for proper documentation to be submitted.
Councilman Velasco recused himself from discussion and vote on the following
item due to the proximity of his residence to the project, and stepped down from
the dais.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GILROY
AMENDING THE CITY OF GILROY CONFLICT OF INTEREST CODE TO
ADD CERTAIN BOARD MEMBERS TO BE SUBJECT TO THE CODE.

The Mayor noted Item IX.B.l.c. on page 5, and requested a letter of
opposition be sent stating that these bills would impact how charter cities engage
in public works projects.
Motion was made by Councilmember G. Arellano, seconded by Councilman
Velasco and carried (Councilman Sudol absent) to send a letter of opposition
regarding SB 974 and SB 1119.

City Administrator Protempore Dorn noted the General Plan Update
completion schedule.
The Mayor noted the successful opening ofBonfante Gardens. He
complimented staff on the wheelchair and stroller accessibility at Bonfante
Gardens.
Councilmember G. Arellano stated that the County Library is renegotiating the
by-laws for the JP A. She requested the Mayor be more specific in his
acknowledgement when he is identifYing the Councilmembers speaking order.
Councilman Pinheiro added his congratulations to Bonfante Gardens.

Adjournment
Councilman P. Arellano also congratulated Bonfante Gardens and wished them
the best of luck.
Councilman Morales echoed what his colleagues stated regarding Bonfante
Gardens. He noted the Victory Outreach and the Repubblica Italiana
proclamations that he presented as Mayor Protempore. He also commented on the
Jeff Garcia golf classic tournament to aid Hispanic youth in receiving scholarships.
Councilman Velasco noted that Bonfante Gardens is truly a wonderful gift to
our community.
The Mayor noted a request regarding interviewing Youth Commission
applicants.
Motion was made by Councilman Morales, seconded by Councilman P.
Arellano and carried (Councilman Sudol absent) to have the City Council interview
the Youth Commission applicants, and set that for July 23,2001 with appointment
to be agendized for August 6, 2001.
