The Mayor announced that the Council had adjourned from a Closed Session
regarding Conference with Legal Counsel - Anticipated Litigation, pursuant to
Government Code Section 54956.9(b) regarding a claim by Randall Scott Gaydos,
and that action would be taken at this time regarding this claim.
Motion was made by Councilman Dillon, seconded by Councilman Arellano
and carried to deny the claim of Randall Scott Gaydos.
The Mayor led the Pledge of Allegiance to the Flag.

The Mayor noted direction for staff to prepare a resolution to approve the
project priorities, commit future local match should funds be awarded, and to
authorize submittal of the project list to VT A for the VT A Valley Transportation
Plan 2020, Local Streets and County Roads Program.
Councilman Arellano requested additional priorities regarding sidewalk and
bikeway provisions. The City Administrator stated they will be added to the final
resolution.
Motion was made by Councilman Morales, seconded by Councilman Arellano
and carried to direct staff to prepare a resolution to approve the project priorities,

Motion was made by Councilman Pinheiro, seconded by Councilman Morales
and carried to award the bid to Best Roofing & Waterproofing, Inc. for City
Building Reroofing Project No. 04-ASD-118 (reroofing City Hall, Gilroy Senior
Center, Wheeler Community Center, Gilroy Community Youth Center, and
Alternate No.1, eliminating the Police Station) in the amount of $227, 100.00.
The Mayor stated it was the time and place scheduled for a Public Hearing on
a request to consider a report by the Gilroy Police Department recommending
projects/programs for funding under the State Law Enforcement Block Grant
monies for the 2003-04 Fiscal Year.
The staff report was noted and further explained by the City Administrator.
The Mayor opened the Public Hearing. There being no comment, the Mayor
closed the Public Hearing.
Motion was made by Councilman Morales, seconded by Councilman Dillon
and carried to accept the funding for projects/programs as recommended.
The Mayor stated it was the time and place scheduled for a Public Hearing to
consider an Ordinance amending Gilroy City Code Section 5B.2 of Article I of
Chapter 5B pertaining to blighted commercial and industrial property, and adding
Chapter 5C pertaining to blighted residential property.
The staff report was noted and further explained by the City Administrator.
The Mayor opened the Public Hearing.
Ellyn Atkins commented that many properties have chain link fences with high
weeds, specifically the corner of Miller and First. It was noted that the component
tonight is for the residential areas of town, rather than the commercial area that she
indicated. It was explained that the City already has an ordinance relating to the
commercial areas of Gilroy.
Felicia Rosas stated that she has property on Alexander Street, and noted junk
in yards in her area. She asked that something be done about this. She was told
that this ordinance would help alleviate the junk in the residential area yards.
The Mayor closed the Public Hearing.

Motion was made by Councilman Pinheiro, seconded by Councilman Dillon
and carried to read the ordinance by title only and waive further reading of the
ordinance. The City Clerk read the ordinance by title only.
Motion was made by Councilman Pinheiro, seconded by Councilman Dillon
and carried to introduce an Ordinance of the City Council of the City of Gilroy
amending the City Code regarding blighted residential, industrial, and commercial
property.
Councilman Gartman recused himself from discussion and vote on the next two
items, due to his employment with the Gilroy Unified School District, stepped
down from the dais, and left the Council Chambers.

and carried to approve the scope and location of the Veterans Flag and Monument
Project.
Council Retreat The City Administrator noted a request to set the Council Retreat in January,
2004. Council agreed to set the retreat for January 16/17, 2004 and noted the
need to set an interview date for December, 2003.
The City Administrator noted the November 21, 2003 joint CouncillPolice
Department and CouncillFire Department retreats. He requested topics of interest,
and that staff would send out a reminder Email.
The City Administrator distributed three ordinances scheduled for Public
Hearing on September 15, 2003 for Council review.
The City Administrator noted that on September 12, 2003 the City will go to
the Regional Water Quality Control Board to give a presentation to the Board on
the Perchlorate issue. He distributed a presentation regarding the Perchlorate
Issue.

Perchlorate The City Administrator and Community Development Director Rooney gave
an update on the Perchlorate issue.
Bd./Com. The Mayor noted City Commission and Board appointments effective
Appointments January 1,2004 to expire December 31,2007.
Motion was made by Councilman Pinheiro, seconded by Councilman Velasco
and carried to set the deadline to receive applications as December 3, 2003, the
date for candidate interviews as December 8,2003, and appointments to be made
on December 15,2003.
The Mayor asked that the Council hold October 27, 2003 for a potential
special meeting on the Glen Loma EIR.
The Mayor commended Councilmen Dillon and the community for their
contributions to the McCarthy family.
Councilman Pinheiro questioned Item IX.B.l 0 regarding the Passport
Application Acceptance Agents. He was told that the City of Gilroy now accepts
passport applications to process.
