At 7:42 p.m. Mayor Pinheiro called for a recess, after which he recalled the meeting to order. City of Gilroy - Budget Public Hearing on 2006-2011 Financial Plan of the City of Gilroy. Councilman Velasco attempted to teleconference into the meeting to be present for Item Y.D., but was unable to hear the proceedings and did not continue the teleconference. City Administrator Baksa stated that the Councilmembers had all the documentation for this Public Hearing. Mayor Pinheiro opened the Public Hearing. Mark Zappa stated that he would like to commend Councilman Gartman regarding his views on government spending. He stated that we are letting deficit spending happen and noted his concern with it. Mayor Pinheiro closed the Public Hearing. Bryant, Home Builders Association of North em California, thanked the City Council for continuing this item and stated that she appreciates the work that is being done on this. City of Gilroy - Zoning Ordinance An Ordinance of the City Council of the City of Gilroy amending Gilroy Zoning Ordinance Section 41, Performance Standards, to incorporate noise standards consistent with requirements of the General Plan. City of Gilroy, applicant, Z 06-05. The staff report was noted and further explained by Planning Division Manager Faus. City Attorney Callon noted that language could be added regarding farm operation noises would be an exception to this ordinance. Romaine Soza stated that an air conditioner runs at about 60 dba and pool equipment is probably more. She noted that this will be retroactive and asked if the City will help with the costs to upgrade their equipment if they get complaints. Michael Ham stated that he watched the May 15,2006 meeting. He stated that they completed their pool in June, 2003. He stated that his neighbor complained of the pool and air conditioning equipment noise. He stated that no time was convenient for him to run his pool equipment per his neighbor. He explained that they did do some sound attenuation to the equipment to help with the noise. He stated that he looked into enclosing the pool equipment with a noise cover, but it was impossible to do per City requirements. He commented that Bill Faus drafted a mediation letter for the neighbors. He asked that the City measure from the property line, to change the time to end at 10:00 8538 p.m., and questioned if he could use 70 dba for his pool equipment. He questioned enforcement of the ordinance and asked that the ordinance not be retroactive. Dee Ann Harn stated that their pool was permitted and that they have complied with City requirements, that it was inspected and passed inspections. She questioned how the enforcement can be retroactive. She questioned whether the City is going to get decibel level readings before approval of pool equipment. Tim Fellows, general contractor, questioned the 3' measurement issue and stated that it should be measured on the property line. He questioned whether the hours noted are for operating the equipment only or is it for entertainment hours also. He questioned it being retroactive and stated that he hoped the City would reevaluate the wording. Denise Brolin stated that she has a pool and spa and noted concern with the ordinance being retroactive. She asked that the time be extended to 10:00 p.m. Mark Zappa stated that his air conditioner is vital to his sleep due to a medical condition. He questioned whether he would have to apply for an exemption. He stated that the ordinance is too restrictive. Peter Nesinov stated that he is against the ordinance. He stated that this will be unfair to a lot of people in Gilroy for this to be retroactive. Greg Leach stated that neighbors expect a certain amount of noise in and around a home. Marshall Silva stated that he works for the City of Gilroy and that he wanted to clear his name regarding a complaint. He stated that he witnessed some complaints, but was not a supporter of the complaint made a few weeks ago. He stated that neighbors need to live with some noise. Virginia Comito stated that the noise levels in the ordinance are fine. She noted that her neighbor's pumps cause her house to vibrate. She asked that the noise ordinance be adopted. Joshua Uribe stated that the noise is extremely loud even with the windows closed. He noted that they feel vibrations within their home. City Attorney Callon stated that if this is a health and safety issue, the City cannot grandfather in equipment, but they could give a grace period for noise muffiering equipment to be installed. City of Gilroy - Residential Development Ordinance RDO Numerical Limits for 2004-2013. City of Gilroy, applicant, M 06-06. The staff report was noted and further explained by Planning Division Manager Faus. Connie Rogers noted that some negative comments were made tonight regarding impact fees. She stated that she was glad that the City is reviewing the Rating Scale next year. She commented that the RDO limits are important and asked that the Council not conduct a competition for 2006, since the Council has already allocated over the RDO limit by 667 units. Motion was made by Councilman Correa, seconded by Councilman Gartman and carried (Councilman Velasco absent) to conduct a "2006" RDO competition, evaluate "2006" applications under the existing RDO rating point system, and in addition to using the City's established RDO Rating Scale, projects would also be assessed using" Areas of Special Interest" criteria, as revised to include 5) Transit oriented design, 6) Preservation/dedication of open space, and 7) Housing cost - price reduction/affordable by design. City of Gilroy - Fireworks A Resolution of the City Council of the City of Gilroy amending and setting forth the Administrative Penalty Schedule and Late Payment Charges for certain violations of the Gilroy City Code. RESOLUTION NO. 2006-48 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GILROY AMENDING AND SETTING FORTH THE ADMINISTRATIVE PENALTY SCHEDULE AND LATE PAYMENT CHARGES FOR CERTAIN VIOLATIONS OF THE GILROY CITY CODE. AYES: COUNCILMEMBERS: ARELLANO, BRACCO, CORREA, GARTMAN, VALIQUETTE, AND PINHEIRO NOES: COUNCILMEMBERS: NONE ABSENT: COUNCILMEMBERS: VELASCO City Administrator's Report Discussion on the Camino Arroyo Bridge Project - Schedule options for outside funding and Bridge Sidewalk Design Options. City Administrator Baksa discussed the possibility of $9 million for the Camino Arroyo Bridge if the November, 2006 infrastructure bQnd passes. 8541 Senior Civil Engineer Dey reviewed the funding for the bridge using the TIF. He noted that they looked at safety issues regarding pedestrians. He also noted that they looked to widen to a 7' pedestrian walkway plus a 5' bike lane or to put in a separation rail barricade. He stated that this would be a safe width crossing for pedestrians. Council agreed to the 7' wide pedestrian walkway with no barrier for the design. Motion was made by Councilman Valiquette, seconded by Councilman Correa and carried (Councilman Velasco absent) to pursue the funding. City Administrator Baksa stated that as part of the mini-Policy Summit they will have some really big items to discuss. He stated that they would like to allot some time to a "Wish List" discussion and asked that each Council member give him five things by June 26, 2006 that they would like to discuss under the "Wish List" discussion. Council Members Report Council member Arellano thanked everyone who took part in the Relay for Life event over the weekend. Mayor's Report Mayor Pinheiro stated that he met last week with area Mayors, Supervisors, and other jurisdiction representatives regarding an update on the EI Rancho San Benito project. He stated that the next meeting will be on the Del Webb project near the airport in Hollister. He stated that he and City Administrator Baksa met with representatives from VT A regarding important issues for the community.
