The James Group
Public Hearing on a Tentative Map request to create 17 lots on approximately 7.45
acres on property zoned GD (Gateway District), located at Monterey and Eleventh Streets
(just south of Platinum Theaters). The James Group (c/o James Suner), applicant,
TM 06-11.
Councilman Bracco recused himself from discussion and vote on this issue, due to
financial interests in the area, stepped down from the dais, and left the room.
The staff report was noted and further explained by Planner II Polubinsky.
Mayor Pinheiro deviated from the agenda to hear interested persons in the audience
(relating to the Consent Calendar).
Darcy Foster spoke regarding a claim on Item III.E. and reiterated her concerns with
regard to damage to her mother's home.
John Peters also spoke on Item III.E. regarding his claim and his dissatisfaction and
asked for assistance in working with the contractor.
Mayor Pinheiro returned to the regular order of the agenda.
Mayor Pinheiro opened the Public Hearing.
James Suner noted that he distributed the packet of information on the elevations for
the units to the Council. He reviewed the concerns of the neighbors. He noted that he is
still willing to work toward a downtown entry arch and that he will write up a proposal.
Councilman Gartman stated that he met with the applicant several times regarding
this project.
Mayor Pinheiro closed the Public Hearing.
Motion was made by Councilman Velasco, seconded by Councilman Correa and
carried (Councilman Bracco absent) to direct staff to prepare a resolution approving
TM 06-11.
Councilman Bracco returned to his seat at the dais.
City of Gilroy - Impact Fees
Public Hearing to consider revisions and adjustments to the Water Impact Fee of the
City of Gilroy.
The staff report was noted and further explained by City Administrator Baksa.

The following Councilmembers volunteered as follows: Councilman Arellano as the
alternate to the Santa Clara County Cities Association Board of Directors; Councilman
Correa as the alternate to the Santa Clara County Cities Association Legislative Action
Committee; Councilman Valiquette as the representative and Councilman Correa as the
alternate to the Santa Clara County Cities Association City Selection Committee; and
Councilman Velasco to replace Mayor Pinheiro on the VT A Board of Directors.

Adoption of the City of Gilroy Investment Policy for 2007 and update on the
Treasury .
Assistant Finance Director Turner and Michael Dorn gave an update on the City of
Gilroy investments.

carried to adopt the City of Gilroy Investment Policy for 2007.

An Emergency Ordinance of the City Council of the City of Gilroy repealing
Ordinance No. 2006-19 and adopting a new Article VI entitled "Seismic Safety"
regarding a mitigation program for Unreinforced Masonry Buildings.
The staff report was noted and further explained by Community Development
Director Rooney.

City of Gilroy - Unreinforced Masonry Buildings
An Ordinance of the City Council of the City of Gilroy repealing Ordinance No.
2006-19 and adopting a new Article VI entitled "Seismic Safety" regarding a mitigation
program for Unreinforced Masonry Buildings.
No action was taken at this time.
City Administrator's Report
Discussion of the City Clerk recruitment process.
Council agreed to provide comments to the City Administrator regarding an "ideal"
candidate for City Clerk, and interview the finalists.
City Administrator Baksa stated that the Police Department staffing consultant
preparing the Police Management Study would like to meet with each Councilmember,
and Karen Pogue will call to set those appointments up.
Council Members Report
Councilman Velasco requested PERS contribution amounts that the City of Gilroy
has paid.
Mayor's Report
Mayor Pinheiro stated that he met today with VT A regarding community bussing. He
asked Councilmembers to let him know if they have any comments to forward to VT A
regarding this issue.
