I. CALL TO ORDER AT 6:00 P.M.

II. CLOSED SESSION
A. PUBLIC EMPLOYEE PERFORMANCE EVALUATION, Pursuant to Govt. Code
Section 54957, Gilroy City Code Section 17A.8 (a) (4), Title: City Administrator
B. CONFERENCE WITH NEGOTIATOR - COLLECTIVE BARGAINING UNITS, Govt.
Code section 54957.6, Gilroy City Code Section 17A.8 (5), City Negotiators:
Thomas Haglund, City Administrator and LeeAnn McPhillips, City Human
Resources Director, Charles Sakai, City Legal Counsel, Collective Bargaining
Units: Local 2805, IAFF Fire Unit Representing Gilroy Fire Fighters, Gilroy
Management Association Representing Employees Designated as "Exempt",
Excluding Confidential and Council Appointed Employees, AFSCME Local 101
Representing Employees Affiliated with AFSCME, Local 101 ,Gilroy Police Officers

Public comment
Mitch Madruga of the Gilroy Police Officers Association spoke on the upcoming POA
contract negotiations stating that the Association was asking to extend the current
contract to June of 2010 with no raises. He stated that the Association was hoping to
help the City through the hard times. He then explained that the Association was
suggesting that the step increases in the contract continue to take place, but cost of
living adjustment increases would not over the next fiscal year.
Tina Acree the Business Agent representing AFSCME spoke on the merit increases in
the AFSCME MOU explaining that AFSCME was standing by the contract in place. She
explained that the public was misled by the recent article in the local newspaper

suggesting that the City work with the unions as a team.
Council Member Peter Arellano, M.D. joined the meeting at 6:10 P.M.
Carla Ruigh, President of the Gilroy Management Association spoke on the impacts of
freezing merit increases, explaining that the performance pay plan was a motivation for
the retention of quality employees.
Pat Bentson spoke on attaining her Bachelors Degree and her ability to attain the
Financial Analyst position with the City, sharing her point in the merit step process. She
explained that her pay had nothing to do with her tenure with the City and was tied to her
directly to her performance. She then asked the Council not to terminate the City
Administrator as he was doing a good job in a tough situation.
The Council adjourned to Closed Session
Council Member Craig Gartman joined the meeting at 6:25 P.M.
ADJOURN to Open Session. Public Report of any action taken in Closed Session and
the vote or abstention of each Councilmember, if required by Government Code Section
54957.1.and Gilroy Code Section 17A.13 (a), Public Report of the vote to continue in
closed session if required, Gilroy Code Section 17 A.11 (e)

II. A. PUBLIC EMPLOYEE PERFORMANCE EVALUATION
Motion was made by Council Member Woodward and seconded by Council
Member Tucker to take no action other than to conduct the City Administrator's
Annual review as scheduled in May, 2009. The Roll Call Vote carried with a 6-1
vote (Council Member Gartman voting no)
II.B. CONFERENCE WITH NEGOTIATOR - COLLECTIVE BARGAINING UNITS
Motion was made by Council Member Woodward, seconded by Council Member
Tucker to direct the City Administrator to exercise his discretion and therefore
grant no performance pay increases, otherwise known as merit step increases,
effective immediately through June 30, 2010. The Roll Call Vote carried 6-1
(Council Member Arellano voting no)
III. OPEN SESSION
A. Review and Consideration of Pay Policy Changes for All Non- Union, Un-
represented Employees
There were no public comments.
Motion on Item III.A.
Motion was made by Council Member Tucker, seconded by Council Member
Bracco to Direct the City Administrator to exercise his discretion and grant no
performance pay increases, otherwise known as merit step increases, effective
immediately through June 30, 2010 with the inclusion of the Part Time salary scale
to be frozen as it exists today. The Roll Call Vote carried 6-1 (Council Member
Arellano voting no)
