CERTIFICATE OF CANCELLATION
OF LAND CONSERVATION CONTRACT
Pursuant to the California Land Conservation Act of 1965, the City of
Gilroy does hereby issue a Certificate of Cancellation of the following
described contracts thereunder and certifies;
1. The County of Santa Clara and JOSEPHINE S. HOEY, JOSEPHINE SOPHIA
J- HOEY, and EDWARD J. HOEY entered into land conservation contracts in
accordance with the California Land Conservation Act of 1965. Copies of

said contracts were recorded on August 1, 1969, in Book 8625 at Page 340;
February 24, 1971, in Book 9230 at Page 257, and February 28, 1969, in Book
8451 at Page 63 of Official Records in the Office of the Recorder of the
County of Santa Clara. Subsequently, the land affected by said contract was
annexed into the City of Gilroy. The land referred to in the aforementioned
contracts is legally described on Exhibit "A" attached to this certificate
and incorporated herein.
2. By Resolution No. 82-126, the City Council of the City of Gilroy
tentatively approved the cancellation of the above-described contracts
subject to the conditions set forth in the certificate of tentative

cancellation dated February 8t 1983. At the time of tentative cancellationt
HOEY RANCH COMPANY and GILROY COUNTRY CLUB ESTATESt a California general
partnershipt were the owners of the land under such contracts and each
requested cancellation as to their respective ownerships. The certificate
of tentative cancellation was recorded on February 12t 1983.
3. The following conditions and contingencies set forth in the
certificate of tentative cancellation have been satisfied:
a. Payment in full of the cancellation fee ($33t941.00 for
HOEY RANCH COMPANY; ($145t107.00 for GILROY COUNTRY CLUB
ESTATES) certified by the County Assessor and City Council
as being due pursuant to Government Code section 51283.
This fee was paid within one year from the date of the
recording of the certificate of tentative cancellation.
The City of Gilroy hereby certifies that the above-described Land
Conservation Contracts are cancelled.
