RESOLUTION OF THE COUNCIL OF THE CITY OF GILROY ORDERING VACATION
OF A 10 FOOT EASEMENT CROSSING THE REAR YA~DS OF LOTS 12, 13, 15,
16, 17 AND 18 OF TRACT 6012, MESA ROAD SUBDIVISION.
WHEREAS, the Council of the City of Gilroy did on February
5, 1979, adopt Resolution No. 79-4 declaring its intention to pro-
ceed under the Street Vacation Act of 1941, Streets and Highways
Code Section 8300, ~~ ~ to vacate the 10 foot public utility
easement crossing the rear yards of Lots 12, 13, IS, 16, 17 and 18
of Tract 6012 Mesa Road Subdivision, as shown upon the map attached
hereto, Exhibit "B" and legal description of same, Exhibit "A" and
WHEREAS, notices of the adoption of such resolution were
published and posted as required by law, and
WHEREAS, no objection to the proposed vacation of the por-
tioD of public utility ~a8ement was filed at or before the hearing
by the Council on February 20, 1979, at 8:00 o'clock p.m., in the
Council Chambers in the City Hall at 7390 Rosanna Street, Gilroy,
California, the time and place fixed for the hearing in said notices,
and the hearing having been duly held, and the Council having duly
considered the evidence presented as to the vacation of the portion
of the public utility easement described herein;
The Council does hereby find that the described portion
of public utility easement is unnecessary for uresent or prospective
public use.
NOW, THEREFORE BE IT RESOLVED by the Council of the City
of Gilroy that the described strip of land be vacated,as shown upon
the map attached hereto.
PASSED AND ADOPTED this 21st day of February, 1979, by
the following vote:

EXHIBIT "A"
That certain public utility easement which runs across
Lots 12, 13, 15, 16, 17 and 18 as said lots are shown on the
map for Tract 6012 which map is recorded in Book 896 of maps at
page 50 in the office of the recorder of the County of Santa Clara,
State of California being more particularly described as follows:
Two Ten (10) foot wide public utility easements, one
lying northerly and the other lying southerly of the
following described line.
BEGINNING at a point in the common line between Lots
15 and 16, said point being at its intersection with
the southerly edge of the 10' public utility easement
which runs along the southwesterly side of Nicole Way
as said lots and street are shown on the map for Tract
6012; thence proceeding along said common line S. 750
00' 00" W. to the northwest corner of Lot 15 at which
point the easement on the south of this line terminates;
thence continuing S. 750 00' 00" W. to the southwest
corner of Lot 16 at which point the easement on the
north side terminates; and,
A Ten (10) foot wide public utility easement the center-
line of which is described as follows;
BEGINNING at a point in the common line between Lots
16 and 17 of Tract 6012 distant thereon 8.29 feet from
the southeast corner of Lot 17; thence S. 830 48' 44"
TN. ,67.34 feet; thence S. 460 10' 21" W., 170.44 feet.
