Combining of Lots: Subject to all applicable subdivision, building and fire cooes and laws of the City. a~d only after obtaining the prior written approval of the Board or the Committee, the Owner or Owners of two (2) or more Lots which are adjacent may physically combine those Lots into a sitJglc Lot, for purposes of use, if those portions of the Corrunon Area affected by the proposed combination are not required for structural support, serve as seismic support stmctures, bearing walls or shear walls, . and the Owner of such Lot pays for any structural, construction. decorative, mechanical or utility charges or costs incurred or necessitated bv such combination. Those walls between Lot which are non-bearing or shear wans and do not otherwise provide structural support for the Building may be removed by an Owner who is combining Lots. Those walls between Lots which are bearing walls, shear walls or otherwise provide structural support for the Building shall not be removed; however, the Owner who is combining Lots milY insert or cut doorways or other openings or penetrations into such bearing, shear or structur~l walls after approval of the Board or Committee based upon written analysis of a qualified structural engineer, architect or other qualified professional that such doorways or other penetrations will 'not mnterially adversely affect the structural and seismic capabilities of the Building and will comply with aU City requirements. The Lot Owner of Lots being combined shall indemnify and hold hnrrn1ess the Association from any claims arising from any physical construction or modifications to the Building based upon the Owner's combining of Lots. A. The Owner or Owners of the combined Lots shall be entitled to cast the votes att-ributable to each of the combined Lots in the same manner as if they had not been combined. A combined Lot shall be assessed based upon the assessm~nts levied upon such Lots as if such Lots were 110t combined. Except as expressly approved by the Board, no combined Lots may be sold or leased unless all of the Lots so combined are sold or leased to the same person or entity, or the combined Lots are reconstnlCted as separate and independent Lots as shown on the Map at the sole cost and expense of the Owner(s) thereof. B. Lots which have been combined can be separated into separate Lots provided that prior written notice is given to the Board, and that they are separated along the same boundaries as were originally established in the Plan, and that the utility cOImections and facilities, walls, ceilings and/or floors which were removed, altered or modified are returned to the conditions as they were in prior to the combination of such Lots, or replaced by structural components which have been approved by the Board or Committee, provided tha.t all requirements of the City are satisfied. CITY ENGINEER'S CERTIFICATE: Notice is hereby given that the property described in Exhibits "A" and "B" attached hereto and made a part hereof, do not create new parcels, but only combines these parcels for purpose of use. And to allow ingress and egress between the units as provided in the CC & R's for Tract 9228. This Certificate of Compliance (Lot Line Adjustment)- complies with the provisions of Division 2 of Title 7 ofthe Government Code of the State of California, cited as the Subdivision Map Act. and all local ordinances enacted pursuant thereto. Further, that as a result of this Certificate of Compliance (Lot -Line Adjustment), the sale, lease or financing of any parcel of land described herein shall not constitute a violation ofthe Subdivision Map Act or local ordinance.
