DEDICATION FOR STREET AND UTILITY PURPOSES
The undersigned, being the legal owners of the real property hereinafter
described, hereby dedicate to public use a right of way for Street and
utility purposes, including but not limited to electric, gas, telephone,
cable TV, water storm drainage, sanitary sewers, etc" under, over, on and
across the real property hereinafter described.
The undersigned further irrevocably offers to dedicate to the City of
Gilroy for use of the public a right of way for street and utility purposes
over, under on and across tIle real property hereinafter described said
dedication to be accepted only when tile City Council of the City of Gilroy
adopts and records in the office of Recorder of the County of Santa Clara
a resolution accepting said right of way. Until said right of way is
recorded the City of Gilroy shall not be responsible for maintaining said
right of way and improvements thereon.
If any change in change in alignment, length or width of right of way
approved by the City of Gilroy results in vacation of any part of tile real
property dedicated herein, such vacation sllall terminate the dedication as
to the part vacated.
The provisions hereof shall inure to the benefit and be binding upon
the heirs, successors, assigns and personal representatives of the respect-
ive parties hereto.
BEING a portion of Lot 2 in Block 4 South, Range 2 West, In the City
of Gilroy, as shown on Hap No.9 accompanying the Final Report of tile
Referees in the Las Animas Rancho Partition Suit, Action No. 5536
had in the Superior Court of the State of California, in and for the
County of Santa Clara and being more particularly described as follows:
"BU;INNING at the intersection of the northeasterly line of Church
Street with the northwesterly line of Tenth Street, as shown on
saicJ Hap, and running thence along the northeasterly line of Chllrch
~)treet N.20000'W. 20.00 feet; thence leaving said line along a
curve to the left \.lith a radius of 20.00 feet, from a tangent hear-
inq of 5.20.000"E., throuqh a central angle of 90000' for a dis-
tance of 31.42 feet to E1 !,o.int in the northwesterly line of Tenth
Street; thence along said northwesterly line S.70000'W. 20.00 feet
