A non-exclusive easement for ingress and egress and a permanent
water line in and over a strip of land 10.00 feet in width,
the Southerly line of which is described as follows:
BEGINNING at the point of intersection of the line common to Lots
10 and II, ~ith the Westerly line of Morey Avenue (commonly called
Day Road), as shown on that certain Map entitled, "r-lap of a
Subdivision of the Lands of S. P. Fine inthe Solis Rancho, Santa
Clara County, CaI i fornia", which r.lap was fi led for record in the
office of the Recorder of the County of Santa Clara, State of
California, in Book F-2 of Maps, at" page 46, from the most Easterly
common corner of said Lots 10 and 11, in the Easterly line of the
Solis Rancho and the center line of ~Iorey Avenue hears ""-orth 89'" 51'
East 20.08 feet; and running thence along the line common to said
Lots 10 and 11, South 890 51' East 557.19 feet to the terminus of
said easement.
Conditions:

This easement is granted upon the following conditions:
1. Grantee shall install all pipes with a cover of 4 feet
below the present grade of property.
2. Grantor shall reserve and retain the right to fully use
and enjoy the aforesaid premises, except to the rights herein
granted. Without limitation of the foregoing, Grantor reserves
the right to fence, landscape and place other improvements on,
over and across the above described easement.
3. Grantee in its exercise of the rights herein granted hereby
agrees to hold and save Grantor harmless from any and all
damage arising from Grantee's use of the easement herein granted.
Grantee shall repair and replace any fences, landscaping or other
improvements hereafter placed on the easement which may be
damaged as a result of Grantee's use of the easement.

1965, at a regular meeting of said Council, a certified copy of which
resolution is on record in the office of the County Recorder of the
County of Santa Clara, State of California, in Book ]02], page 228, I,
as said City Administrator, do hereby accept on behalf of the said
