'll'HIS INDENTURE, made this 19/~ay of September, 1961,
between JOSEPH P. LEON and JENNIE L. LEON, his wife, parties of the
First Part, and the CITY OF GILROY, a municipal corporation in the
County of Santa Clara, in said State, the party of the Second Part;

Parties of the First Part, for and in consideration of the
sum of ONE ($1.00) DOLLAR, cash in hand, paid to the party of the
Second Part, a receipt hereby acknowledged by the parties of the
First Part, have this day granted, bargained and sold and by these
presents do grant, bargain, sell, convey, transfer and deliver unto
the ~ty of the Second Part a permanent easement and right-of-way
for the installation and maintenance of an underground sanitary sewer
line over, under, in, through and across the following described
premises located in the City of Gilroy, County of Santa Clara, State
of California, to-wit:
A strip of land of a uniform width of 10 feet, the
southwesterly line of which is described as follows:
"BEGINNING at a point in the northeasterly line of East
Street, distant thereon S. 200 E. 5.00 feet from the
intersection thereof with the northwesterly line of
seventh street as shown on the Map hereinafter referred
to, and running thence along the northeasterly line of
East Street and the line common to Sublots 17 and 18,
N. 200 W. 248.42 feet; and being a portion of Sublot 18
as shown on Map No. 8 and a portion of Lot 1 in B1.ock, 2;,
South, Range 7 East, in the City of Gilroy as shown on
Map No. 10, said maps being those filed with the final
report of the referees in the Las Animas Rancho Partition
Suit, Action No. 5536 had in the Superior Court of the state
of California in and for the County of Santa Clara.
Including the perpetual right to enter upon said easement

land at any time and construct, install, maintain and repair an
underground sanitary sewer line for the purpose of conveying sewage

over, across, through and under the lands hereinbefore described,
~_ together with the right to excavate and refill ditches and or trenches
for the location, placing, replacing, maintenance and repairing of

said sewer line and the further right to remove trees, bushes, under-
growth and other obstructions, if any, interfering with the location,
construction, installation, repair and or maintenance of said sewer
line.
The said easement above described is hereby granted to the
party of the Second Part upon the condition that the parties of the
First part, their heirs, successors and assigns shall have the right
to make one house service connection with the said sewer line, when
the same is installed, without the payment of any fee or service
charge to the city of Gilroy; but the cost of connecting the line or
lateral and of the installation thereof shall be born by the First
Parties, their heirs, successors or assigns. The foregoing condition
shall be a covenant running with the land.
IN WITNESS WHEREOF, the parties of the First Part have
hereunto set their hands the day and year first hereinabove written.
