SEWER EASEMENT
FOR GOOD AND VALUABLE CONSIDERATION, receipt and sufficiency of which are hereby acknowledged,
Gilbert E. Love, an unmarried man (hereinafter referred to as "Grantor"),
hereby GRANTS to
the CITY OF GILROY, a Municipal corporation,
a public utility easement for purposes of constructing, installing, replacing, inspecting and maintaining underground sanitary
sewer pipelines, connections, manholes and such other appurtenances in connection therewith, on, over, under and across
certain property located in the City of Gilroy, County of Santa CI~, State of California, more particularly described as
follows:
Being a portion of that certain parcel of land described in a Partnership Grant Deed filed at
Pages 1109 and 1110 of Book K395 of the Official Records of Santa Clara County on December
18, 1987;
A fifteen (15) foot wide strip of land that lies east of and contiguous to the following described
property line:
Beginning at the most northwesterly comer of parcel described in deed filed December 18, 1987,
Book K395 Official Records at Pages 1109 ancL1110, Office of the Recorder of Santa Clara
County;
Thence along the westerly line of aforesaid parcel S. 200 19' 11" E, a distance of 40 feet to the
terminus which is the southerly property line of aforesaid parcel. Also being the northerly line
described in deed filed April 11, 1978 in Book D584 Official Records at Pages 624 and 625,
Office of the Recorder of Santa Clara County;
and as shown on Exhibit "A" attached hereto, together with such rights incidental thereto, including, without limitation,
pedestrian and vehicular ingress and egress into, over and across Grantor's real property, and the right to excavate and
remove soils from the area of the easement.
In no event shall Grantor hereafter contract or install, or cause or permit the contraction or installation of, any building
structure, fence or tree upon or within ten (10) feet of the area of said easement, without the prior written consent of the
City of Gilroy, which consent shall not be unreasonably withheld.
This easement shall inure to the benefit of the City of Gilroy and its agents, employees, contractors and subcontractors,
successors and assigns.
