SEWER EASEMENT
FOR GOOD AND VALUABLE CONSIDERATION, receipt and sufficiency of which are hereby acknowledged,
ANTIIONY M. OliVERI and JUliEANNE OliVERI, husband and wife as joint tenants (hereinafter referred
to as "Grantors"),
hereby GRANT to
the CITY OF GILROY, a Municipal corporation,
a public utility easement for purposes of constructing, installing, replacing, inspecting and maintaining underground sanitary
sewer pipelines, connections, manholes and such other appurtenances in connection therewith, on, over, under and across
certain property located in the City of Gilroy, County of Santa Clara, State of California, more particularly described as
follows:
Being a portion of that certain Parcel 3 as shown upon that certain map entitled, Parcel Map in
the City of Gilroy, the County of Santa Clara, State of California, Portion of Lots 1, 2 & 3,
Block 4 South, Range 1 West as shown on Map No.5, Las Animas Partition Suite, which map
was recorded February 11, 1976 in Book 367 of Maps, at Page 52, Santa Clara County
Recorder;
A fifteen (15) foot wide strip of land that lies east of and contiguous to the following described
property line:
Beginning at the most northwesterly comer of parcel described in deed filed June 16, 1983, Book
H638 Official Records at Page 289, Office of the Recorder of Santa Clara County.
Thence along the westerly line of aforesaid parcel S. 200 00' E, a distance of 80.00 feet to the
terminus which is the southerly line of aforesaid parcel.
and as shown on Exhibit "A" attached hereto, together with such rights incidental thereto, including, without limitation,
pedestrian and vehicular ingress and egress into, over and across Grantors' real property, and the right to excavate and
remove soils from the area of the easement.
In no event shall Grantors hereafter contract or install, or cause or permit the contraction or installation of, any building
structure, fence or tree upon or within ten (10) feet of the area of said easement, without the prior written consent of the
City of Gilroy, which consent shall not be unreasonably withheld.
This easement shall inure to the benefit of the City of Gilroy and its agents, employees, contractors and subcontractors,
successors and assigns.
