real property hereafter described. BRUCE M. JACOBS, ESQ., appearing
for the petitioners, came on regularly for hearing on
9, 1972. The Court, after examining the return and
and hearing the evidence, finds that:
1. Notice of the hearing on the return and petition has been
prescribed by law.
2. After due publication of notice of sale, the Co-
Administrators of the estate of decedent, sold on October 6, 1972,
at private sale the real property belonging to the estate described
herein to THE CITY OF GILROY, a Mur.tcipal Corporation, for the sum
of Forty Thousand ($40,000.00) Dollars cash, subject to confirmation
of sale by this Court. Rental, taxes, and insurance on the property
are to be prorated as of the date of confirmation of sale, and

escrow charges, examinat~on of title, recordi.ng of conveyance, any
transfer tax, and any t~7th~ in,'>Lt'lmee policy are to be at the

expense of the purchaser.

1 3. The sale was made subject to current taxes, covenants,
2 conditions, restrictions, reservations, rights, rights of way, and
3 easements of record.
4 4. The sale was legally made and fairly conducted, and ndice
5 of the time, place, and terms of sale was given as prescribed by
6 law. Good reason existed for the sale.
7 5. The reol property has been appraised within one year of
8 the sale and the sum offered at the sale is at least 90% of the
9 appraised value and is not disproportionate to thE': value of the
10 property sold.
11 6. A sum exceeding th(~ bi.d by at least 10% on the first

$10,000 bid and 5% on the amount of the bid in excess of $10,000,
exclusive of the expenses of a new sale, COL1ld not be obtained.
7. No real estate broker was employed to secure the
purchaser of the property.
~. Petitioners desire to deposit said sale proceeds in the
amount of $40,000.00 pursuant to Probate Code Section 541.1 when

received and file a receipt therefor with the Court ~o as to
eliminate the necessity of additional bond; that it is to the
advantage of the estate to thus reduce the expense of bond premiums

IT IS ORDERED that:
1. The sale so made of all right, tltle and lnterest of the
23 estate in the real property described below to THE CITY OF GILROY,

a Municipal Corporation, is confirmed; and upon receipt of the
purchase price the Co-Administrators of decedent's estate are
authorized and directed to execute and deliver a deed of conveyance
to the purchaser.

Gilroy, County of Santa Clara, State of California,

that certain mE.p entitled "map of the Subdivision
of Las Animas Sub Lot 11 and Las Animas Ranch Lot 39
in the Rancho Las Animas and City of Gilroy, County
of Santa Clara, State of California", which map was

filed for record in the office of the recorder
of the County of Santa Clara, State of California,
on August 12, 1886 in Volume "F1" of Maps, at
Page 4.
BEGINNING at the point of intersection of the
common line between Lot 7 and Lot 10 and the common
line between Lot 10 and Lot 11, and running thence
N. 700 30' 47" E. 537.77 feet to the point of inter-
section with the southwesterly line of that certain
2.415 acre parcel conveyed by grant deed to the
State of California, recorded in the office of the
said Recorder in Book 9008 of Official Records at
page 173 therein;
