City of Gilroy, a public entity, (hereinafter referred to as City) does hereby Remise, Release and
Forever Quitclaim and Release any present and after Acquired Title to the Santa Clara Valley
Transportation Authority, (hereinafter referred to as VTA), in and to all that real property in the
City of Gilroy, County of Santa Clara, State of California, more particularly described in
Exhibits attached hereto and made a part hereof, which descriptions by these references are
incorporated herein.
City, by this reservation, does not accept an obligation for the repair or maintenance of any
bridge, roadway, or other structure installed by VT A.
In Witness whereof, said corporation has caused its corporate name to be hereunto
subscribed and its corporate seal to be affixed hereto, this 8th day

All that certain real property situate in the City of Gilroy, County of Santa Clara, State of California being a
portion of Parcel One as described in the Deed from Gilroy Foods, Incorporated, a California corporation,
to Conagra, Inc., a Delaware corporation, recorded as Recorder's Document Number 13425222, Santa
Clara County Records described as follows:
A TEMPORARY EASEMENT to tenninate December 31,2005 for construction purposes and incidents
thereto, under, upon, over and across that certain real property described as follows:
BEGINNING at a point in the easterly line of said Parcel One; said point bears, along said westerly line
S2042'52"W 10.811 meters from the intersection of said easterly line with the southerly line of that certain
2.479 acre parcel of land described in the Deed from Ella K. Hosang, a widow, to the State of California
recorded April 3, 1958 in Book 4044 of Official Records at page 362 Santa Clara County Records; thence
from said POINT OF BEGINNING, from a tangent bearing ofN70036'08"W along a curve to the left with
a radius of851.100 meters, through a central angle of 7024' 19" for an arc length of 110.002 meters; thence
from a tangent beari.ng ofN78000'09"W along a curve to the left \vith a radius of901.130 meters, through a
central angle of 1043'10" for an arc length of 27.043 meters; thence radially SI0016'41"W 3.000 meters;
thence concentric with and distant 3.000 meters southerly, measured radially, from above said courses with
lengths of 27.043 and 110.002 meters the following two courses: from a tangent bearing of 879043' 19"E
along a curve to the right with a radius of 898.130 meters, through a central.a9-g1e of 1043'10" for an arc
length of 26.953 meters; thence from a tangent bearing of S78000'27"E along a curve to the right with a
radius of848.100 meters, through a central angle of 7029' 16" for an arc length of 110.834 meters to a point
