The petition for preliminary distribution of KENNETH E.
DeBELL, CRAIG S. DeBELL, DAVID J. DeBELL, and MICHAEL L. DeBELL

came on regularly for hearing by the court this date. On evidence
17
given to the satisfaction of the Court,

THE COURT FINDS that
1. Notice of the time and place of hearing has been duly
20

given as required by law.
2. Notice to creditors has been published in the manner and
for the period prescribed by law.
3. More than two months have elapsed since the issuance of
24

letters as provided in Section 700 of the Probate Code, and the
period for filing or presenting claims against the estate has
expired.

4. No claims have been filed against the estate. However,
the widow, MARLYS K. DeBELL, has filed a Petition for Determination
1 of Entitlement to Distribution under Probate Code 91080.
2 5. The estate is but little indebted.
3 6. The estate is not in a condition to be finally closed and
4 distributed, but the distribution of property requested in the
5 petition may be made at this time without loss to the creditors or
6 injury to the estate or any person interested therein.
7 7. The distribution requested in the petition need not be
8 conditioned on the execution of a bond.
9 8. In all other respects not covered by the foregoing
10 findings the allegations of the petition are true.
11 IT IS ORDERED THAT:
12 1. The personal representatives shall distribute the
13 following property in the estate to the following persons:
14 The sum of One Million ($1,000,000) Dollars
15 to the CITY OF GILROY for the development of
16 Uvas Park Preserve.
17 The sum of One Hundred Thousand ($100,000)
18 Dollars to the MAYOR OF THE CITY OF GILROY,
19 GILROY SUPERINTENDENT OF SCHOOLS and PRESIDENT
20 OF GAVILAN COLLEGE, as Trustees, to be invested,
21 with the income therefrom to be expended for
22 scholarships to four (4) year colleges or
23 universities for approved degree programs for
24 students from Gilroy who might not otherwise
25 be financially able to obtain a college degree.
26 The sum of Twenty-Five Thousand ($25,000)
27 Dollars to RUDY TELLEZ.
