Meserve Engineering ~ CONTRACT FOR SERVICES OLD CITY HALL STRUCTURAL ENGINEERING This agreement is entered into this 21st day of June, 1988, by and between the City of Gilroy and Meserve Engineering, hereinafter referred to as Consultant. The parties hereto agree as follows: 1. Employment of Consultant. The City hereby engages Consultant and Consultant hereby agrees to perform the fol- lowing services: a. To provide field measurements and excavations as required to create structural drawings of the building, as it currently exists, incorporating any available drawings. b. To provide direction to the testing agency for obtaining structural strengths of key materials. c. To provide detailed structural evaluation of the building, based on the Los Angeles Division 88 Ordinance for unreinforced masonry buildings. Where reasonable, the structural repairs will be based on the 1985 Uniform Building Code forces. d. To prepare detailed drawings indicating the repairs required to achieve a reasonable upgrade in the overall seismic strength of the building consistent with the available funding. Such services shall result in the preparation and pub- lication of a structural engineering report, drawings and specifications for the abovementioned project as required by the City. Accordingly, Consultant will make every effort to prepare said report with maximum accuracy and objectivity. 2. Guidelines for Historic Structures. All repair procedures must be consistent with the "Secretary of the Interior's Standards for Historic Preservation Projects" (1983) and with the guidelines applying the standards to historic buildings. The consultant shall consult and coor- dinate project design with the California Department of Parks and Recreation, Office of Historic Preservation. The con- tract documents shall be prepared using the standard format specified in the following documents, and shall be submitted to the State Historic Preservation Officer for approval: A) Procedural Guide - Historic Preservation component, California Parks and Recreational Facilities Act of 1984 B) State Historic Building Code C) Uniform Building Code If any extensive investigation of the foundation is done, the Northwest Regional Archaeological Information Center shall be consulted regarding potential archaeological resources. .' - -2- 3. Meetings to be Attended. A representative (or representatives) of Consultant shall attend such meetings with City staff, Applicant, other resource persons and/or public hearings as will be necessary to complete the Consul- tant's obligations under this agreement. Consultant further agrees that compensation for said attendance of meetings shall be included in the amount of compensation as specified herein. 4. Responsible Consultant in Charge. Ed Meserve will serve as the Consultant principally responsible for execution of the Consultant's obligation under this agreement and shall serve as principal liaison between City and Consultant. 5. Time of Performance. The services of the Consultant are to commence as soon as practicable after the effective date of this agreement. The Consultant's effort in prepara- tion of the draft documents shall be completed 8 weeks after said effective date. Upon such completion, Consultant shall furnish to the City 3 copies of the draft documents. Follow- ing review and approval, Consultant shall make all modifica- tions and additions to said documents as deemed necessary by the City to meet the terms of this agreement, and present 11 copies of the final report, drawings and specifications, suf- ficient to issue to prospective bidders. 6. Compensation for Services. The costs of said Con- sultant's services shall be as follows: Design development Materials testing Preparation of structural report/ drawings (11 sets) General liability insurance TOTAL $11,400 $ 1,500 $ 250 $ 2,169 $15,319 Said compensation will be made within thirty (30) days of the Consultant's completion of said services and Consultant's submission to the City of an invoice in the amount due. Payment may be made, not to exceed 75% of the total sum before completion of the project, upon submittal of the invoice itemized to document work completed. 7. Termination for Cause. The City may terminate this agreement upon ten (10) days written notice and be relieved of payment of any consideration to Consultant should Consul- tant fail to fulfill in a timely and proper manner their " -3- obligations under this agreement or if Consultant shall violate any of the covenant agreements or stipulations of this agreement. In the event of such termination, the City may proceed with work in any manner which it deems proper. Thereupon, the cost to the City shall be deducted from any sum due Consultant under this agreement and the balance, if any, shall be paid to Consultant upon demand. 8. Insurance. The Consultant shall complete and return to the City a Certificate of Insurance and General Liability Endorsement as required under the provisions of "Insurance Requirements for Contractors" (attached). The Consultant shall list the City as "an additional insured" under the coverage afforded with respect to the work being performed under this agreement. The use of the City's Agreement Form is subject to Insurance Company rules. 9. Indemnification. The Consultant shall hold harmless the City and its agents and employees against any loss, liability, damage, expense, or claim arising from injury or death of any person", or damage to or loss of property, caused by negligent acts or errors or omissions of the Consultant or its agents or employees in performance of activities related to provision of services required by this agreement. It is understood and agreed that the Consultant has the professional skills necessary to perform the work agreed to under this contract, and that the City relies upon the pro- fessional skills of the consultant to do and perform its work in a skillful and professional manner, and the consultant thus agrees to perform its work. Acceptance by the City of the work performed under this contract does not operate as a release of the Consultant from such professional responsibility. It is further understood and agreed that the Consultant has reviewed in detail the scope of the work to be performed under the Contract and agrees that in its professional judgment, said work can and shall be completed for a fee within the maximum amount set forth in this contract. Approval of the insurance coverage does not, in any way, relieve the Consultant of liability under this Indemnifica- tion Clause. 10. Modifications. No alterations or variations of terms of this agreement shall be valid unless made in writ- ing and signed by the parties hereto. 11. Independent Contractor. Subject: Old Gilroy City Hall Recommended Occupancy Dear Mike; I have reviewed our files on the existing structural deficiencies is this building, plus the additional damage that has occurred in last weeks earthquake. Given the serious nature / instability of several key elements in this building, I recommend that the general pub- lic not be permitted to enter the building, or utilize the side walks adjacent to the building, until shoring is installed. I further recommend that a plywood barrier be immediately constructed to prevent any bricks that may fall from rebounding out into the remaining pedestrian and vehicle right of way. This plywood should be at least half-inch CDX, four foot high and continuous, braced by a triangular frame at four foot on center and anchored to resist wind loads at each frame. If a shoring system plus some key perpendicular ties are installed, and some temporary shear walls constructed, I believe that the center area of the building could then be utilized, as long as any second floor activities that can induce building vibrations (such as group dancing) are prohi- bited. The areas where occupancy should be prohibited is between Grid Lines 1 and 3 (attached Figure 1) - both floors, and the second floor from Grid Line 6 to 7. Part of the shoring will consist of shed coverings from both side exits. The second floor stairs adjacent to Line 6 may be utilized. C. Edward Meserve, DBA Meserve Engineering. This proposal is for a new seismic evaluation of Gilroy's Old City Hall. A structural system to repair, replace and/or rein- force the existing 2-story unreinforced brick and sandstone exterior walls will be designed, based on the program to be developed by the Project Architect. Handicapped access solutions will also be addressed. The field data obtained under a prior contract will be utilized to the maximum possible extent. WORK STATEMENT The following items shall be provided: 1. Meetings with City officials and the Project Archi- tect as required during the performance of the design work noted herein, but not more than one meeting every two weeks. The meeting locations shall be divided equally between City Hall, the engineer's office, and the architect's office. 2. Detailed structural evaluation of the structure, based on the Los Angeles Division 88 Ordinance for unreinforced masonry buildings, the state historical building code, or any other methodology the City requests. 3. Preparation of detailed pencil-on-vellum 24"x 36" size structural drawings indicating the repairs required to achieve a reasonable upgrade in the overall seismic strength for the building, consistent with the architect's preservation of the historic fabric of the structure. The required structural specifications shall be incorporated into the structural drawings. A total of 30 full sets of structural drawings shall PAGE 1 OLD GILROY CITY HALL be provided to the city of Gilroy, consisting of two prelimi- nary printings of five sets each, and a final 20 sets for the const~ction Phase. 4. Construction Phase support consisting of occasional site visits to insure construction complies with the intent of the structural drawings (maximum of one site visit per week), answering contractor questions via phone and fax, and issuing structural Clarification notices as required to provide addi- tional information not on the Permit drawings or as required to modify an existing detail because of changed field conditions uncovered. Review of only the structural steel, masonry and concrete shop drawings shall also be provided. No as-built or additional drawings shall be produced, only sketches as required for structural Clarifications. CONDITIONS 1. The Engineer shall retain the calculation and drawing originals. Copies shall be made available to the City. 2. The addition of items not outlined in the Work State- ment or the revision of drawings and calculations to reflect post-design changes made by the Architect, City or state shall be deemed Additional Services, and billed at the hourly rates stated herein. 3. The engineer wil1 complete and return to the City of Gilroy a certificate of insurance and general liability endorsement for a minimum of one million dollars as required under the city provisions for contractors. The city shall be named as an additional insured. 4. The following Items are excluded from the costs given in this Proposal: a. requests by the Contractor, Architect, Tenant or City to attend Construction Phase meetings and per- form additional calculations and/or issue structural Clarifications to direct modifications due to changes for new elements added to the Project and the modifica- tion of elements already designed. b. Special inspections and material testing as required by the building code and/or contract documents that will be produced. c. Cost estimates, bidding/negotiating, or construction administration, except as already outlined in Work Statement 4. d. Review of shop drawings beyond those noted in Work PAGE 2 OLD GILROY CITY HALL statement 4. e. _Providing services made necessary by the fault of the .~ Contractor, by major defects or deficiencies in the Work of the Contractor, or by failure of performance of other parties under the Contract for Construction. f. Providing services in connection with evaluating sub- stitutions proposed by the Contractor, City, Tenant or Architect and making subsequent revisions to Drawings, specifications and other documentation resulting therefrom. g. Making revisions to calculations or drawings when such revisions are required by the enactment or revision of codes, laws or regulations subse~lent to the prepara- tion of project documents. h. Providing services in connection with a public hearing, arbitration proceeding or legal proceeding. i. Soils engineering reports and testing. j. structural design, detailing, attachment and/or specification of the following items; 1. doors and windows 2. glazing and skylight systems 3. as-built structural drawings 4. handrails, guardrails, bumper rails 5. stairs and exiting requirements 6. formal specification typing 7. planter boxes 8. roof surfaces, awning or canopy systems 9. flexible and rigid insulation systems 10. precast architectural elements 11. site drainage or paving design 12. manufactured architectural elements, including Dry- vit systems and other styrofoam-backed products. 14. walking and wear surfaces 15. flashing and waterproofing systems 16. fixtures and their attachment, such as shelving, cabinets, fireplace mantels and plumbing. 17. This Proposal is good for sixty days. COSTS Items One through Three, as outlined in the Work State- ment, will be performed on an hourly basis for the not-to- exceed labor price of $20,200., plus direct expenses. Item Four shall be supported for the not-to-exceed labor fee of $11,300., plus direct expenses. Direct expenses are defined as reproduction costs, photography, faxes, toll calls and special deliveries, all with a 1.15 multiplier for internal accounting costs. Alternately, a lump sum for Design Phase direct expenses of $1906 is acceptable, plus Construction Phase direct expenses of $950. Billing will be on a monthly basis. Invoices not paid within 30 days of date sent will accrue interest at the rate of 1.25% per month for the unpaid balance. In addition, Engineer may suspend services under this Agreement until he has been paid in full all amounts due. If significant contract changes occur, or work is stopped per your request, employee timecards and the hourly rates noted herein shall be utilized to obtain the cost of services provided to date. If a separate formal structural specification document is required, the additional fee is $950. for preparation of the document per required format. HOURLY RATES FOR PROJECT SUPPORT Principal $90. per hour Engineer $75. per hour Draftsman $50. per hour Clerical $36. per hour Any additional work requested in 1990 will be billed monthly at these rates, which will increase on Jan 1, 1991. Subject: Gilroy Old City Hall Dear Mr. Dorn: I have received a copy of the City of Gilroy Ordinance 89-20, which provides the standards for the analysis and evaluation of unrein forced masonry bearing wall buildings. I will be using this ordinance as the standards for the seismic renovation of the Gilroy Old City Hall building. The base shear value will be 0.100W, in accordance with the ordinance, instead of 0.133W which was used in our previous design. Other than the base shear value, the ordinance standards are fairly similar to the standards used in the previous design. To obtain the required bracing of the northern second story unrein forced masonry walls, I am planning to have the exte- rior side shotcreted. This will involve removing the wood frame existing exterior wall of the adjacent building and replacing it with the shotcrete. Other methods of wall bracing that were investigated were: 1) vertical bracing members between the floor and roof (structural tubing). 2) Angle braces from the wall to the roof. 3) Shotcrete on the inside of the wall. These alternative methods and several others were discussed with Lucian Childs and were felt to be too disruptive to the interior architecture of the structure. Similarly, the eastern unrein forced masonry wall will have to be shotcreted from either the inside or the outside to .., resist the out-of-plane wall forces. There has also been some discussion about demolishing this wall and replacing it with a new reinforced concrete block wall. Either method will meet the necessary requirements. with the shot crete or rebuilding of the wall, the door and adjacent window may not need to be infilled as per the original design proposal. Also, the proposed braced frame near grid line B may not be required due to the increased capacity of this wall. Additional investigation of the latest damage, as well as the architectural aspects, will be required to determine what structural modifications must be done to the remaining walls. Proposed structural Rehabilitation INTRODUCTION Calculations have been performed for the seismic lateral load distribution of the old city hall of Gilroy. These calcula- tions have been based on the City of Gilroy ordinance "stan- dards for the Analysis and Evaluation of Unreinforced Masonry Bearing Wall Buildings". This ordinance states that the base shear shall be V=O.IW. Figures 1, 2, and 3 have been included to aid in the location and identification of the structural elements discussed in this report. Additional detailed calculations for the design of the footings, connec- tions, several shear walls, and other structural elements will begin following your approval of our proposed structural rehabilitation methods. In our proposed structural rehabilitation, a majority of the in-plane lateral forces in the main structure will be resisted by new concrete shear walls. We believe this is the most cost effective way to achieve the needed lateral stiff- ness and safety for the occupants. The Center-Core method will be utilized to minimize, destruction of the existing sur- faces where appropriate. For the lateral analysis, the rear portion of the structure (which is east of grid line 6) has been assumed to act semi- independently from the main structure to the west. This assumption is based on the structural irregularities that occur along grid line 6; The roof diaphragms have an eleva- tion difference. The stairway divides the floor diaphragms. The bay window to the south and the wall offset to the north produce substantial discontinuities in the east-west walls. Therefore the tributary lateral loads will be distributed to the shear walls within each section. Nominal ties will be installed to prevent independent movement between the two sections. -1- Gilroy Old City Hall GENERAL The following is the proposed method of repair and seismic upgrade that will be used to create working drawings for the structure: 1. All walls will be tied to the floor and roof diaphragms to provide the needed out-of-plane bracing for the walls. 2. All exterior walls and interior shear walls will be attached to the second floor and roof diaphragms for horizontal shear transfer. 3. The existing main roof sheathing will be removed and replaced with blocked plywoOd sheathing. MAIN PART OF THE STRUCTURE 4. A new concrete buttress shear wall will be installed along grid line 2 north of line G. This wall will be attached to collectors at the second floor and roof diaphragms. 5. A new concrete shear wall will be located along grid line 3. This wall will replace the existing stud wall. This wall will also directly brace the clock tower. 6. A new concrete shear wall on grid line 3.1 will be located adjacent to the new elevator. This wall will extend from the foundation to the roof. 7. A new concrete shear wall will replace portions of the existing unreinforced masonry wall on grid line 6. The brick from this wall will be used as a veneer on the west side of the wall at the first floor. Above the second floor, the narrowed down part of the wall will have wood furring to obtain the desired thickness and a pIaster finish. 8. Along grid line G, the existing unreinforced masonry wall meets the in-plane shear requirements of the Gilroy ordinance. To meet the second story out-of-plane requirements of the ordinance, the parapet of the wall will be dismantled to form a three wythe wide platform for the coring apparatus (See Item 15). A new concrete tie beam and parapet will be placed on top of the existing wall. A brick veneer will be attached on the north face of the parapet. See Figure 4. 9. One of the main east-west shear resisting elements will be located on grid line D between lines 2 and 3. This new concrete shear wall will replace an existing wood -2- Gilroy Old City Hall framed bearing wall which supports the clock tower, and will extend from the foundation to the roof diaphragm. This wall will also directly brace the clock tower. A collector from the shear wall will extend eastward to grid line 6 at both the roof and floor diaphragms. 10. At the second floor along grid line D between lines 4 and 5, a wood or steel collector member will be added below the joists. The ends of this member will be connected so that the collector forces will be transferred to the existing beams along grid line D, and then to the new shear element to the west. 11. Two new one-story concrete shear walls will be located along grid line B between lines 4 and 5. These two new walls will replace the existing stud walls and steel columns. The existing second floor double I-beams will be supported by the new walls in these locations. 12. Along grid line B, between grid line 3.2 and 5.3, the damaged upper portion of the second story unreinforced masonry wall and veneer will be rebuilt, and will have a new concrete tie beam placed on top to support the existing trusses. The reinforcing from the Center-Core method will extend into this tie beam and continue up into the various parapets. Upon repairing the top portion of this wall, the wall will meet the in-plane shear requirements of the Gilroy ordinance. 13. On the inside of grid lines 3.1 and 5.2 between lines A and B, and line A between 3.1 and 5.2, new reinforced shotcrete shear walls will be installed. By epoxy setting anchors through the red brick and into the exterior sandstone blocks, further cracking of the unreinforced masonry arches will be prevented. 14. All of the exterior walls with the sandstone veneer between the foundation and the second floor will have the veneer fastened to the red brick behind with both epoxy-set anchors and a polymer resin. The polymer resin will be used to fill the voids between the veneer and the brick. 15. All of the unreinforced masonry walls between the second floor and the roof will be reinforced to resist the out-of-plane distress using the Center-Core method, unless noted otherwise. 16. At the curved entry wall (near the intersection of grid lines 2 and B) above the second floor, the extensively damaged masonry areas will be disassembled and rebuilt as reinforced grouted brick masonry. -3- Gilroy Old City Hall 17. At the second floor landing above the curved entrance, the wood joists of the stair landing will be replaced with a horizontal steel frame to brace the walls against out-of-plane forces. The landing will be rebuilt with wood infill. 18. The white brick veneer above the second floor will be attached to the red brick with epoxy set anchors and/or a polYmer resin. EASTERN PART OF THE STRUCTURE 19. A new one-story high concrete buttress shear wall will be installed along grid line B east of line 7. This wall will be attached to a collector at the second floor. An alternate repair method that would eliminate this new wall is to infill the three windows along line B and to utilize the existing unreinforced masonry wall on grid line D as a shear wall. 20. The existing full height unreinforced masonry shear wall on grid line F meets the in-plane shear requirements of the Gilroy ordinance. This wall does not meet the out-of-plane requirements above the second floor. 21. The existing two story unreinforced masonry shear wall on grid line 7 meets the in-plane shear requirements of the Gilroy ordinance. The fallen parapet will be rebuilt with reinforced brick masonry. (See Item 23). 22. The unreinforced masonry wall along grid line 6.1 will be developed as a shear wall to resist the second floor diaphragm forces. 23. Above the second floor on grid lines 7 and F, the existing two wythe sections of the wall with large diagonal cracks will be rebuilt with reinforced grouted masonry that will match the three wythe thickness of the remaining wall on each side and below. 24.
