RESOLUTION NO. 2013-41
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
GILROY ORDERING THE VACATION OF TWO CERTAIN
STRIPS OF LAND DESIGNATED AS A PUBLIC ALLEY
RIGHTS OF WAY DESIGNATED FOR PUBLIC USE, THE
ALLEY SHOWN SOUTH OF LOT 78 AS SHOWN UPON THAT
CERTAIN MAP ENTITLED TRACT 1862, SHERWOOD PARK,
UNIT NO. 2 FILED WITH THE COUNTY RECORDER OF
SANTA CLARA COUNTY CALIFORNIA.
WHEREAS, pursuant to the provisions of Chapter 4 of the California Streets and
Highway Code, Section 8330 et seq., the City Council may summarily vacate a public alley
when the alley has been impassable for vehicular traffic for five years and no public money has
been expended for maintenance during such period; and
WHEREAS, the public ally were dedicated to the city on Tract Map 1862, Sherwood
Park, Unit No. 2 on October 17, 1957, which map is recorded on the County Recorder's Office
Book of Maps, book 85, page 48; and
WHEREAS, the City Council having duly considered all evidence, and followed the
procedure prescribed by law, hereby finds and determines from all evidence submitted that the
proposed order of vacation of the public ally conforms with the provisions of Section 8333 of the
California Streets and Highway Code.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
GILROY AS FOLLOWS:
1. That the public ally shown south of Lot 78 as shown on Tract Map 1862,
Sherwood Park, Unit No. 2, between Wayland Lane and the property owned by Gilroy
Elementary School District dedicated on Tract Map 1862, the alley has been impassable for
vehicular traffic for five years and no public money has been expended for maintenance during
such period.
2. That the City Council, pursuant to Streets and Highway Code, Chapter 4, Section
8330 et seq., hereby orders the vacation of the alley shown south of Lot 78 as shown on Tract
Map 1862, Sherwood Park, Unit No. 2, between Wayland Lane and the property owned by
Gilroy Elementary School District on and described in Exhibit "A" attached hereto; and
3. This Resolution shall become effective on November 4, 2013, and shall be

recorded by the City Clerk in the Santa Clara County Recorder's Office shortly thereafter; and
4. From and after the date this Resolution is recorded in the Santa Clara County
Recorder's Office, the public ally shall no longer constitute a public ally and the land subject to
the public ally shall revert to the property located at 8411 Wayland Lane, Gilroy, California,
APN 790 -25 -014, and 8407 Wayland Lane, Gilroy, California, APN 790 -25 -015, as described in
Exhibit `B" attached hereto, pursuant to Streets and Highway Code Section 8351.
