MERITAGE HOMES OF CALIFORNIA, INC., a California Corporation ( "Grantor "), For
Valuable Consideration receipt of which is hereby acknowledged, does hereby GRANT to the
CITY OF GILROY, a Municipal Corporation of the State of California ( "Grantee "), an easement
for public ingress and egress and any and all public service purposes including, but not limited to,
the construction and maintenance of poles, wires, and conduits, for storm drains, sanitary sewers,
water lines, gas lines, electric lines, telephone lines, television and traffic signal facilities,
sidewalks, public utilities, and appurtenances to all the above, over, under or across all that certain
real property designated as "Public Service Easement ("PSE "), and situated in the City of Gilroy,
County of Santa Clara, California, described in Exhibit "A" and shown in Exhibit "B ", both
attached hereto and made a part thereof. The above mentioned easements shall remain open and
free from buildings and structures and their appurtenances, except for irrigation systems and their
appurtenances, lawful fences, walkways, and all lawful unsupported roof overhangs.
See Exhibits "A" and `B" attached hereto and made a part hereof, which description and
plat are by reference incorporated herein.

portion of "Parcel A" as shown on the Parcel Map filed January 24, 2013 in Book 858 of Maps,
Pages 48 and 49, Records of Santa Clara County, California more particularly described as

Commencing at a point on the east line of said "Parcel A ", said point being a 1 -1/2 inch Iron
Pipe at the northwest comer of "Parcel A" as shown on the Amended Record of Survey filed July
