Amoroso Construction Co., Inc. Contract Date: 8/16/04 This order shall become effective when the City Administrator, City Engineer, Project Engineer, and Contractor have signed it. All copies forwarded to Contractor for signature shall be returned to the City of Gilroy properly filled out. Upon acceptance by the City, the Contractor's copy will be returned to him as his authority to proceed with the work. DESCRIPTION OF WORK: As described in letter 004 to you dated September 13, 2004, regarding "Substitution Requests ", the Contract provision within the Contract Specification Section 01600- 2,3.2, 2 & 3, which requires all substitution requests to be submitted within thirty-five (3 5) days of the Notice of Award ( "Award of Contract'). This provision is revised by: Section — 1600 -2, 3.2, 2: Unless otherwise provided by law or authorization in writing by the Construction Manager, the "Substitution Request Forms(s)" shall be submitted within a 35 -day period after Notice to Proceed. Notice to Proceed being September 7, 2004. All "Substitution Request Form(s)" shall be submitted by 5:00 pm on October 12, 2004. Section 01600 -2, 3.2, 3: Wherever a proposed substitute item has not been submitted within the 35 -day period after the Notice to Proceed data, or wherever the submission of a proposed substitute material or equipment has been judged to be unacceptable by the Construction Manager, the Contractor shall provide the product, material, or equipment indicated in the Contract Documents. It is further agreed that the Contractor, shall in conformance with and in conjunction to, Contract Specification Section 01600- 3,3.3,6 and the following: Submit any realized cost savings for the requested substituted item or items for which was original specified within the Contract Documents. The Contractor and Construction Manager shall negotiate toward an agreement of a fair and equitable savings. Upon completion of the negotiation the Construction Manager shall issue a Contract Change Order for the applied credit. If there is an increase in the price to the substitution the Construction Manager shall issue a Contract Change Order for the delta between what was originally specified and the increase price of the substitution. THIS IS A NO COST CONTRACT CHANGE ORDER. This change order constitutes full and complete compensation for all labor, equipment, materials, overhead, profit any and all indirect costs, and time adjustments to perform the above - described change.
