FOR EIGLEBERRY STREET RESURFACING PROJECT (O-V 21$), PURCHASE ORDER No. 150724 DATED MAY 8, 2015 1 qk- )�'N'MENDMENT NO. 1 This Amendment shall become effective when it has been signed by the City Administrator, Project Manager, and Consultant. All copies forwarded to Consultant for signature shall be returned to the City of Gilroy properly filled out. Upon acceptance by the City, the Consultant's copy will be returned to him as his authority to proceed with the work. As per the attached proposal, this amendment is for additional construction management and project modification services for the Eigleberry Street Resurfacing Project, in an amount not to exceed $160,500. Additional construction management services were requested to address unforeseen field conditions such as: ADA ramp re- design, adjustments of curb, gutter, sidewalks and pavement repair which differed from the original design. This extra work required MNS to expend additional man hours in the performance of its construction management duties. This Amendment extends the term of the Agreement for Services between the City of Gilroy and MNS Engineers, Inc. to April 30, 2016. All requirements of the original Agreement Documents shall apply to the above work except as specifically modified by this Amendment. The contract time shall not extend unless expressly provided for in this Amendment. MNS Engineers, Inc. hereby agrees to perform the above work subject to the terms of this Amendment for additional construction management services for the Eigleberry Street Resurfacing Project. ;Co nsultant:' N Engineers, Inc. er Date ACCEPTED City dministrator Date � d MNS AMENDMENT December 2015 Additional Scope and work performed on behalf of the City of Gilroy including: o Additional 119 work days of inspection services due to additions and changes to the project scope including: • Leading the contractor in developing a customized "work around" solution for 23 handicapped ramps installed as part of the project. This was made necessary as the intended design of these ramps did not match existing site conditions. As a consequence, each ramp needed a customized layout that required extensive time and effort to develop in the absence of correct design drawings. • Development of contract award documentation required of the City by Caltrans; this was not part of the original MNS scope of work. • In addition, the quantity of work required to complete field condition changes exceeded the original estimated quantities substantially. For example: • Item 13— Remove Concrete Curb — exceeded original quantity by 700% • Item 20 -Minor Concrete Curb and Gutter— exceeded original quantity by 800% • The following additional work was added to the MNS' scope: • 9th Street — Layout and install cross gutters and conforms • Change in scope of the Remove Concrete Pavement item to include complete removal and replacement of failed areas to a depth below subgrade, replacement of subgrade, and pouring of new concrete slab sections. • Develop /evaluate asphalt paving alternatives This extra work required MNS to expend additional man hours in the performance of its construction management duties. Total Cost of this Additional work is $160,500. This Amendment extends the term of the Agreement for Services between the City of Gilroy and MNS Engineers, Inc., dated January 21, 2015, to April 30, 2016.
