SANTA CLARA VALLEY WATER DISTRICT, a public corporation ( "District ") does
hereby grant to CITY OF GILROY, hereinafter "City ", all that real property in the City of
Gilroy, County of Santa Clara, State of California, described as follows:
Being a portion of North Morey Channel as described in that certain Grant Deed, said Deed was filed
for record at Book 0156 at page 157, Official Record of Santa Clara County, California, more
particularly described as follows:
BEGINNING at the POINT OF BEGINNING, being the most Northerly common corner of Parcel A
and Parcel B as both parcels are shown on that certain Parcel Map filed for record on December 15,
1998 in Book 710 of Maps at pages 50 and 51, Official Record of said Santa Clara County, and being
a point on the southeriy'right of way of said North Morey Channel; thence North 89 °43'35" West,
along the Northerly boundary line of said Parcel A and the southerly right of way line of said Morey
Channel, 89.27 feet to the POINT OF CUSP of a non - tangent curve to the left having a radius of
10.00 feet, a radial line to said point bears South 00 °16'25" West; thence Northeasterly along said
non - tangent curve, 7.85 feet, departing said Northerly boundary line and said right of way line through
a central angle of 45 100'00"; thence North 45 °16'25" East, 8.97 feet to the beginning of a tangent
curve to the left having a radius of 20.00 feet; thence Northerly along said tangent curve, 15.71 feet
through a central angle of 45 000'00 "; thence North 00 °16'25" East, 37.57 feet to the beginning of a
tangent curve to the left having a radius of 19.00 feet; thence Northerly, 15.76 feet, through a central
angle of 47'32'11 " to a point on the Northerly right of way line of said North Morey Channel common
with a point on the southerly boundary line of that certain Final Map entitled "Tract 8940 -
Summerhill Subdivision" as said Final Map was recorded in Book 691 of Maps at pages 24 and 25;
thence South 89 143'35" East, along said Northerly right of way line common with said southerly
boundary line, 76.17 feet; thence South 00 116'25" West, departing said Northerly right of way line

and said southerly boundary line, 51.09 feet to the beginning of a tangent curve to the left having a
radius of 20.00 feet; thence southerly along said tangent curve, 15.90 feet through a central angle of
45 °32'49 "; thence South 45'16'25" East, 12.53 feet to the beginning of a tangent curve to the left
having a radius of 10.00 feet; thence southeasterly along said curve 1.32 feet, through a central angle
of 07 °34'59" to a point on the southerly right of way line of said Morey Channel common with the
Northerly boundary line of said Parcel B; thence North 89 °43'35" West, along the Northerly boundary
line of said Parcel B common with said southerly right of way line, 15.94 feet to the POINT OF
BEGINNING as shown on Exhibit B attached hereto and made a part hereof.
Containing 5,534 square feet, or 0.127 -acre of land, more or less.
Basis of Bearings:
The Bearing (North 04 °55'54" East) of the centerline of Santa Teresa Boulevard (formerly Morey
Avenue), as shown on that certain Record of Survey Map filed in Book 478 of Maps at pages 14
through 20, was used as the basis for all bearings for this legal description.
RESERVING NEVERTHELESS, unto Grantor an easement to construct, reconstruct, inspect,
maintain and repair channel protection works and appurtenant structures within the above - described
parcel; provided that this reservation and nothing herein contained shall be construed as an
assumption or acceptance by Grantor District of responsibility for the construction, reconstruction,
repair and maintenance in a condition not dangerous or defective of any roadway or structure erected
by Grantee City across said channel or within said easement area.
Furthermore it is agreed as follows:
THAT City accepts full responsibility for operation and maintenance of storm drain outfalls within
the box culvert and wing walls, as well as structural maintenance of the reinforced concrete box
culvert. District agrees to remove sediment and vegetation in and around the box culvert area.
