GRANT OF PUBLIC SERVICE EASEMENT
JAMES W. HOEY and DEBRA J. HOEY, OR THEIR SUCCESSOR(S), TRUSTEES UNDER
REVOCABLE TRUST AGREEMENT DATED APRIL 12, 1991, AS AMENDED
("Grantor "), does hereby GRANT to the CITY OF GILROY, a municipal corporation of the
State of California ( "Grantee"), an easement for any and all public service purposes including,
but not limited to, the construction and maintenance of poles, wires, and conduits, for storm
drains, sanitary sewers, water lines, gas lines, electric lines, telephone lines, television and traffic
signal facilities, sidewalks, public utilities, and appurtenances to all the above, over, under or
across all that certain real property situated in the City of Gilroy, County of Santa Clara,
California, described as "Public Service Easement" ( "PSE ") in Exhibit "A" and shown in
Exhibit `B ", both attached hereto and made a part hereof. The above - mentioned easements shall
remain open and free from buildings and structures and their appurtenances, except for irrigation
systems and their appurtenances, lawful fences, walkways, and all lawful unsupported roof
overhangs.
See Exhibits "A" and "B" attached hereto and made a part hereof, which description and
plat are by reference incorporated herein.

This is to certify that the interest in real property conveyed by the Grant of Public Service
Easement from JAMES W. HOEY AND DEBRA J. HOEY, OR THEIR SUCCESSOR (S),
TRUSTEES UNDER REVOCABLE TRUST AGREEMENT DATED APRIL 12, 2991, AS
AMENDED dated October 27, 2016 to the City of Gilroy, a municipal corporation of the State of
California, is hereby accepted by the undersigned officer or agent on behalf of the City of Gilroy
pursuant to authority conferred by Resolution No. 2015 -55 of the City of Gilroy adopted October
27, 2015, a certified copy of which resolution is on record in the office of the County Recorder

Land Description of that parcel of land situate in the City of Gilroy, County of Santa Clara,
State of California, same being portions of Parcel 1 as created on that Parcel Map filed on
September 10, 2008 in Book 827 of Maps at Pages 12 through 13, Official Records of said
County, and being more particularly described as follows:
Public Service Easement Parcel B
Commencing at the southwest corner of said Parcel 1; Thence along the west line of Parcel 1,
North 00° 39'40" West - 14.50 feet for the Point of Beginning hereof; Thence continuing along
said west line, North 000 39'40" West - 28.00 feet; Thence crossing through Parcel 1 for the
following thirteen (13) courses: (1) North 89° 59' 23" East - 157.32 feet, for the beginning of a
curve to the left, (2) in an easterly direction, 80.33 feet along the arc of said curve to the left,
