( "GRANTOR "), does hereby grant to the City of Gilroy, a municipal corporation of the State of
California ( "CITY "), all that real property situated in the City of Gilroy, County of Santa Clara, State
of California, more particularly described as Ri t -of -Way Dedication Parcel of Exhibit "A"
attached hereto and incorporated herein by this reference (the "Right -of -Way Dedication "), and a
perpetual and exclusive easement for street purposes, public utilities, and other public purposes, in,
under, over, upon, and across all that certain real property situated in the City of Gilroy, County of
Santa Clara, California, described as Public Service Easement of Parcel of Exhibit "A" and shown
in Exhibit "B" ( "PROPERTY "), both attached hereto and made a part hereof, which description and
plat are by reference incorporated herein.
In furtherance of the foregoing, but without limiting the generality thereof, CITY reserves the right,
in, under, over, upon, and across the PROPERTY, for the construction, reconstruction, repair,
replacement and maintenance of the following items (and appurtenances thereto) (x) a public right -
of -way (including, without limitation, a public sidewalk); (y) poles, wires, and conduits, for storm
drains, sanitary sewers, water lines, gas lines, electric lines, telephone lines, television and traffic
signal facilities; and (z) landscaping (including, without limitation, an irrigation system).
