BKF Engineers - 2018 Agreement for Engineering Services - Amendment No. 1
AMENDMENT TO THE AGREEMENT FOR SERVICES BETWEEN CITY OF GILROY AND BKF ENGINEERS FOR THE DESIGN OF THE MONTEREY ROAD REHABILITATION PROJECT NO.18-PW-400 PURCHASE ORDER NO. 180952 DATED 06/19/2018 AMENDMENT NO. 1 This Amendment shall become effective when it has been signed by the City Administrator, Project Manager, and Consultant. All copies forwarded to Consultant for signature shall be returned to the City of Gilroy properly filled out. Upon acceptance by the City, the Consultant's copy will be returned to him as his authoritv to Droceed with the work. This amendment is for scope of work includes preparation of all of the memos requested by Caltrans in their letter dated 9/24/18 in order to be eligible for a NEPA Categorical Exclusion with technical studies under Caltrans NEPA Assignment (Further details are provided in the proposal from David J. Powers & Associates, Inc. to BKF Engineers dated September 26, 2018 as attached) for the design of Monterey Road Rehabilitation Project that were not included in the original scope for the project in an amount not to exceed $18,490. This Amendment extends the term of the Agreement for Services between the City of Gilroy and BKF ENGINEERS dated May 21, 2019 to December 31't, 2019. All requirements of the original Agreement Documents shall apply to the above work except as specifically modified by this Amendment. The contract time shall not extend unless expressly provided for in this Amendment. BKF Engineers 1730 N 1st St, Suite 600 San Jose, CA 95112 Sent via email: bsilkwood(a)bkf.com RE: Monterey Road Rehabilitation Project [RSTP-5034(027)] Dear Blake, In response to your request, I have prepared the following scope of work for the City of Gilroy Monterey Road 1st Street to 81h Street road rehabilitation project. It is our understanding the project includes: • Between 1st Street and 4th Street - pavement rehabilitation work, ADA upgrades to curb ramps, upgrade striping and markings, protect existing facilities • Between 4th Street and 8th Street - perform slurry sealing, ADA upgrades to curb ramps, upgrade ADA-accessible parking, upgrade striping and markings, protect existing facilities (drainage facilities, traffic detector loops, outdoor dining structure) All work will remain within the existing top of curb, except for isolated work in the sidewalk for ADA curb ramp upgrades. No Temporary Construction Easements (TCEs) are assumed. The maximum depth of excavation for the pavement rehabilitation will be approximately one foot deep, for the slurry seal will be at the surface (approximately 1-2 inches) and excavation for the ADA curb ramps will be approximately one foot deep. At this time, the types of construction equipment to be used include vibratory rollers, grinders and pavement spreading equipment. This project will be funded with a federal grant and, therefore, the City has been working with Caltrans Local Assistance for processing and NEPA environmental review will be required. The project is expected to be eligible for a NEPA Categorical Exclusion with technical studies under Caltrans NEPA Assignment (Section 23 USC 326) 23 CFR 771 activity (c) 26, Modernization of a highway by resurfacing, restoration, rehabilitation, reconstruction, adding shoulders, or adding auxiliary lanes (including parking, weaving, turning, and climbing lanes). A kickoff/field review meeting was held with the Caltrans environmental planner, Dan Rivas, which was followed by a 9/24/18 letter from Caltrans that specified the required technical studies. Caltrans Technical Memoranda The below scope of work is based upon the technical studies listed in the 9/24/18 letter from Caltrans. This scope of work assumes DJP&A will prepare all of the memos described below. All memos prepared by DJP&A will be provided to BKF for first review, and then to the City to be printed onto City letterhead and submitted to Caltrans. Once these memos are accepted by Caltrans as complete, Caltrans will issue the NEPA Categorical Exclusion for the project. DIP&A will provide coordination services with Caltrans for all technical memos prepared by DJP&A. 1. Traffic Memo DJP&A will prepare a Traffic Technical Memorandum that generally describes traffic conditions in the project area, parking locations, and how traffic will be treated during construction, including any necessary traffic controls, any detours or use of flag persons, and temporary impacts to parking. DJP&A will complete this memo and revise it in response to comments received from Caltrans, as needed. 2. Construction Noise DJP&A will prepare a Construction Noise Technical Memorandum describing the proposed construction schedule and duration of tasks, any proposed night/weekend work, nearby sensitive receptors, local noise ordinances, and how the project will comply with applicable regulations. DJP&A will complete this memo and revise it in response to comments received from Caltrans, as needed. 3. Hazardous Waste Technical Memorandum DJP&A will prepare a Lead Paint Compliance Plan/Thermoplastic Striping Memo that describes whether lead -containing yellow paint stripes and markings will be removed and how the waste will be disposed. DJP&A will complete this memo and revise it in response to comments received from Caltrans, as needed. 4. Water Qualitv Technical Memorandum DJP&A will prepare a Water Quality Memo according to the requirements of Caltrans. This memo will describe the potential for the project to result in water quality impacts during and after construction. Mitigation measures (primarily BMPs) for potential impacts will be described. DJP&A will complete this memo and revise it in response to comments received from Caltrans, as needed. 5. Equipment Staging Technical Memorandum DJP&A will prepare an equipment staging memo that describes where and how construction staging will occur. It is recommended that all staging occur on existing paved streets, sidewalks, and/or parking lots. DJP&A will prepare this memo and coordinate any necessary revisions. Project Coordination DJP&A will coordinate with BKF and the City, as appropriate, by phone and email, throughout the project. This scope does not include any meeting attendance by DJP&A. Assumptions This scope is based upon the assumption BKF will provide the following: 1. An aerial showing Area of Potential Effect (APE) for permanent and temporary construction. 2. Construction plan for DJP&A to prepare traffic tech memo. 3. BKF will fill out MTC air quality conformity questionnaire and submit to MTC Air Quality Conformity Task Force. This scope assumes the project will NOT be found to be a project of air quality concern and no PM2.5 hot -spot analysis will be required. If needed, the PM2.5 hot spot analysis can be added to this scope as an additional task on a time and materials basis. 4. BKF will provide info on proposed stormwater quality control measures/BMPs, for DJP&A to prepare stormwater quality memo. 5. BKF will provide info on construction staging, duration, equipment use, etc. 6. BKF will complete the Caltrans Encroachment Permit (Traffic control + signage for State Route 152) Cost Estimate DJP&A will complete this scope for a not -to -exceed fee of $18,490. Our work would be billed monthly on a time and materials basis, in accordance with the attached fee schedule. If we do not need all the time that has been budgeted, we will only bill you for the time that we have actually spent completing the work.
