Christopher Ranch - Rodriguez Labor Camp (2020)DocuSign Envelope ID: F9A5AC5E-9DD8-4172-9EA7-7D82BC9BE963 AGREEMENT FOR PROVISION OF LIMITED MUNICIPAL SERVICES TO PROJECT SUPPORTING AGRICULTURAL INDUSTRIES This AGREEMENT FOR PROVISION OF LIMITED MUNICIPAL SERVICES TO PROJECT SUPPORTING AGRICULTURAL INDUSTRIES ("Agreement") is made this 10 day of March 2020 by and between The City of Gilroy, ("City") a California Charter City, and Christopher Ranch LLC, ("Christopher") a California Limited Liability Company with reference to the following facts and circumstances: WHEREAS, a facility formerly known as the Rodriguez Labor Camp has existed since the 1950s on property at 935 Southside Drive, Gilroy, California (APN 841-15-005, the "Property") owned by Christopher; and WHEREAS, although the Rodriguez Labor Camp has not been in use for several years, Christopher desires to refurbish the Property for a project (the "Project") that will utilize existing buildings for the purpose of providing seasonal agricultural worker housing only. The only new building construction will be a small modular home (750 sf) solely to be occupied by an on -site manager for security and maintenance of the Property to preserve its suitability for agricultural worker housing; and WHEREAS, workers to be housed at the facility will be employed exclusively in support of agricultural industries; and workers will be housed in dormitory -style accommodations, not in independent residential living units, with communal cooking and restroom facilities, which shall be occupied only eight to nine months per year (April to December) or less; and WHEREAS, a City main north -south sanitary sewer line leading to the nearby South County Regional Wastewater Treatment Plant is located immediately adjacent to the eastern border of the Property, and since the 1980s the City has provided sanitary sewer service to the Property by means of a direct physical connection from the Property to this sanitary sewer line; and WHEREAS, a City municipal water line for many years has been located on the Southside drive frontage of the Property; and WHEREAS, the Property is Iocated within the County of Santa Clara. The County has issued a use permit, architectural and site approval and grading approval for the Project on or about February 27, 2020 (the "County Permits"), subject to various conditions of approval; and WHEREAS, the City has surplus capacity in its municipal water system to provide municipal water service to the Property and capacity through the South County Regional Wastewater Authority to continue to provide sanitary sewer services to the Property, for the uses consistent with the County Permits and this Agreement; and WHEREAS, due to the isolated location of the Property and the limited agricultural employee housing use to which it will be put under the County Permits 4842-6099-73020 ALR04706223 DocuSign Envelope ID: F9A5AC5E-9DD8-4172-9EA7-7D82BC9BE963 (which explicitly do not allow general residential use), the City has found and determined that the extension of surplus water service to the Property limited to the uses described above will support agricultural industries and will not either support or induce development, and thus is consistent with the provisions of California Government Code Section 56133(d)(3) and does not require approval of the Santa Clara County Local Agency Formation Commission. NOW, THEREFORE, in consideration of the foregoing recitals and the mutual covenants and conditions contained herein, the parties hereto agree as follows: I) City agrees to provide municipal water service and sanitary sewer service to the Property for the uses permitted in the County Permits (but not for any possible general residential uses of the Property). Sanitary sewer service will be provided through the existing line east of the Property, with the existing connection. Water service will be provided from the City's water line on the Property's frontage on Southside Drive. As a condition precedent to provision of either of these services, Christopher shall either replace the existing eight -inch -inch diameter plastic (PVC) water main with the City's standard Ductile Iron Pipe (DIP) material or place a tracer wire over the existing plastic pipe for ease of locating the existing pipe for future repair and maintenance activities. All such work shall be done pursuant to City review and prior authorization. 2) The provision of water and sanitary sewer service under this Agreement is subject to all of the City's normal policies and procedures, including all ordinances, policies, regulations and procedures now in effect or hereafter adopted for commercial municipal water and sanitary sewer customers. Christopher shall pay when due all customary and normal connection and service charges for these services. 3) The provision of water and sanitary sewer services is solely intended for the use of the agricultural employee housing project described in the County Permits. It is not to be used for general residential purposes. 4) For a violation of any of the terms of this Agreement, the City may cease to provide water and/or sanitary sewer services at its discretion.
