Dear All,
Unless otherwise occupied, I attend the large majority of Gilroy's City Council meetings
and I often speak to the dais on issues that I feel are of importance.
What I find extremely bothersome is at many of the meetings, both Councilwoman Rebeca
Armendariz and Councilman Zach Hilton are often disrespectful and interrupt when their
cohorts, on the council, are trying to speak to each other and to the members of the
community in the audience. Their target is often Gilroy Mayor Marie Blankley; and who
gets visibly frustrated with their rude antics.
Witnessing many of these incidents over the past two years, I told myself that if they should
ever try to interfere when I'm speaking then I would not put up with it and would strongly
confront and rebuke the person who was rudely interrupting me. That moment came
during the city council meeting held on October 03, 2022.

Gilroy City Council Meeting
On Monday, October 3, 2022, Bill James, Chairman of the SCCDP, was kind enough to drive all
the way to Gilroy to attend our (Gilroy) City Council Meeting and he spoke twice before our city
council; once during public speaking and the 2nd time during the agenda item 11.1 to decide if
the city council would vote to respectfully ask Councilwoman Rebeca Armendariz to resign her
seat if the Rebeca Recall Committee was able to obtain enough signatures to place the effort to
recall her on the ballot and save the city 1.2 to 2 million dollars; according to Gilroy's City
Clerk.
During the public speaking portion of the agenda, James endeavored to speak about my behavior
during the previous city council meeting when I strongly reacted to, and rebuked, Council
Woman Armendariz's repeated attempts to interrupt me during "my" three minutes when the
clock belonged to me and she had no right to interrupt me, and yes her multiple interruptions
angered me and I left no doubt that I strongly objected to her poor behavior; as she kept on
harassing me, even after I was walking away from the podium to go back to my seat.
I then learned that Councilman Zach Hilton took exception to one of my comments and told the
Gilroy Dispatch that he had complained to the police department and the city administrator that I
had threatened violence against him.
Bill James decided to bring this up and said that my comments were inappropriate and that I
should have been ruled out of order; even though my comment falls under the rule of "Protected
Speech": The Supreme Court has recognized that the First Amendment's protections extend to
individual and collective speech "in pursuit of a wide variety of political, social, economic,
educational, religious, and cultural ends." Roberts v. U.S. Jaycees, 468 U.S. 609, 622
(1984).Jan 16, 2019
Jame's then complained that the issue I brought up did not meet the rule that only issues
pertaining to the city council can be brought up during public speaking. Again, a bogus charge.
The issue at hand included an article in the Gilroy Dispatch with quotes from Councilman Hilton
criticizing Councilman Fred Tovar for not marching in lockstep with Hilton's own agenda. That
"is" an issue that pertains to our city council and the residents of Gilroy; especially those who
supported and voted for Tovar...once again Jame's attempt completely miss -lead the council and
Gilroy citizens.
Jame's went on to opine, complaining that I had used the term "communist" when referring to
the content of the Gilroy Dispatch article including the disparaging and "bullying" comments
that Hilton made towards Councilman Tovar. Just as Hilton and Jame's objected and unendorsed
Councilman Tovar over his political choices and freedom of thought, they now want to object to
my 1 st Amendment right to Freedom of Speech in their "bullying" attempt to control our cities
political discourse and especially to attempt to silence my ability to speak freely to the dais and
especially to residents of Gilroy.
Jame's then tried to justify his and Hilton's decision to unendorse Councilman Tovar and saying
he and Fred were able to have a nice Kum-Ba-Yah conversation to calmly discuss the issue.
Frankly, everyone could see that Councilman Tovar was "not" at all in a "Kum-Ba-Yah" mood to
see and hear James speak at the podium, directly in front of him.
THE HYPOCRISY:
Agenda Item 11.1 - Jame's refused to speak to the fact that Armendariz violated Gilroy's Social
Host Ordinance [receiving a total of 10 citations] encouraging —100 underage teens to drink
alcohol and abuse marijuana that lead to shooting of four teens and the death of two of them,
Michael Daniel Zuniga-Macias, (18) and Jesse Sanchez, {19). Did Jame's suggest that
Armendariz should be unendorsed? NO!! Instead he insisted that the recall should not go
forward and the voters should make their decision in 2024 if she should continue on as a person
on our city council do you all see the hypocrisy??? Hilton and James will not allow Fred to
think and make his own choices freely to represent Gilroy and his constituents but Armendariz's
horrible and deadly judgement cannot be punished by being unendorsed! ! ! Absolutely corrupt! ! !

Brown Act Violation Letter for Rebeca Armendariz
During the Gilroy City Council Meeting held on September 19,

Dear Mayor Marie Blankley
This letter is to call your attention to what I believe was a substantial violation of a central
provision of the Ralph M. Brown Act, one which may jeopardize the finality of the action taken
by (Gilroy City Council, City of Gilroy).
The nature of the violation is as follows:
1. In its meeting of (September 19, 2022), the (Gilroy City Council Woman Rebeca
Armendariz) took action to violate my Constitutional Right to Freedom of Speech and
Protected Speech as defined and recognized by the U.S. Supreme Court as, "The First
Amendment's protections extend to individual and collective speech "in pursuit of a wide
variety of political, social, economic, educational, religious, and cultural ends." Roberts v.
U.S. Jaycees, 468 U.S. 609, 622 (1984). Jan 16, 2019.
2. I believe Gilroy City Council Woman Rebeca Armendariz also violated "The Brown Act"
rule, 54954.3 (c) for the follow stipulation: "The legislative body cannot prohibit public
criticism of policies, procedures, programs, or services of the agency or the acts or
ommissions of the legislative body itself. Expressions of opposition to actions of the
district (provided they are not overly disruptive) constitute protected speech."
The Violation: As I was speaking during the "Public Speaking" portion of the agenda, Gilroy
City Council Woman proceeded to interrupt me on several occasions which to my
understanding "is" a sure violation of The Brown Act - 54954.3(C). Her interruptions were
intentional and designed to interfere with the message that I had intended to share with the
Mayor, members of the City Council, City Administrator Jimmy Forbis and members of his
Administration in the audience, The City Clerk and members of the community of Gilroy in
the audience and those watching the video of the meeting outside of the city council meeting
room.
The action taken was not in compliance with the Brown Act because it violated my "1st
Amendment" Rights to Free Speech, my "Protected Speech Rights" and it violated The Brown
Act Lyle, 54954.3 (3)
The violation occurred during the "Public Speaking" portion of the agenda which is set aside for
members of the community to speak to our elected leaders [and the community] on issues of
importance and interest to the speaker and from my understanding, the speaker has 3 minutes or
whatever time is allotted by the mayor to speak their piece without interference from anyone,
which includes our elected's who sit on the dais.
In the event it appears to you that the conduct of the (Gilroy City Council - Rebeca
Armendariz) specified herein did not amount to the taking of action, I call your attention to
Section 54952.6, which defines "action taken " for the purposes of the Act expansively, i.e. as "a
collective decision made by a majority of the members of a legislative body, a collective
commitment or promise by a majority of the members of a legislative body to make a positive or
negative decision, or an actual vote by a majority of the members of a legislative body when
sitting as a body or entity, upon a motion, proposal, resolution, order or ordinance."
Pursuant too that provision (Government Code Section 54960.1), I demand that the (City of
Gilroy and the Gilroy City Council) cure and correct the illegally taken action and poor
behavior displayed by Gilroy City Council woman Rebeca Armendariz.
As provided by Section 54960.1, you have 30 days from the receipt of this demand to either cure
or correct the challenged action or inform me of your decision not to do so. If you fail to cure or
correct as demanded, such inaction may leave me no recourse but to seek a judicial invalidation
of the challenged action pursuant to Section 54960.1, in which case I would also ask the court to
order you to pay my court costs and reasonable attorney fees in this matter, pursuant to Section
54960.5.

So folks, here is another reminder for ya'll Joseph Robinson is the kind
of person that Zach Hilton, Rebeca Armendariz, the South County
Democratic Club and the Santa Clara County Democrat Party [Bill James,
Chairman of the SCCDP] have selected to lead our city as a member on our
city council; along with Ronald Robinson and Jan Chargin.
So, where are darkest nooks and crannies of our city that Hilton find guys like
this??
I strongly urge you to share this extremely important information with your
neighbors, friends and family who reside in the City of Gilroy.

Here's what I would really say:
Q: Given the non -partisan nature of the office you seek, is it really
appropriate to for you to, as you've said, "heighten the distinctions", as a
strategy of your campaign?
A: What is "non -partisan", after all, when you have two parties that are in
opposition? What I support another will oppose, I see that. So, what is
the middle ground supposed to be? What does non -partisan behavior
look like? How responsive would non-partisanship be to facts on the
ground?
Right wing arguments lack coherence, because the right wing worldview
is just a constellation of rhetorical oppositions.
Theirs is a refusal to participate, finally.
They want to cut the government.
They don't want to argue, they just want there to be an argument.
They move to oppose you, rhetorically and beyond.
On any given issue, they believe the opposite of what you believe.
This isn't "also and", it's "either or".
One has to be true, the other an absurd fiction.
The temptation for those clinging to absurd fiction is to try to change
reality so it makes your point, even as you are hyperattenuating bs out of
Earth's atmosphere.
That's where a few muddle-headed billionaires and teaming masses of
wild petty-bourgeouis individuals are in their thinking.
They would like to have a turn with the surgical tools.
In their minds, there's much to be done.
Look, we have to serve "all of Gilroy", which includes those Gilroyans that
value themselves the most.
Over and over again, we'll include them, at their behest.
And here, we've included them again, and look!! one more time for good
luck.
Wow!
And now for the 58,000 other residents, including myself.
This larger part of Gilroy, of which we're supposed to be afraid, has a set
of needs and expectations, which is frightening in -and -of itself.
"What could they possibly want?" our leaders ask.
We must oppose it.
We'II need 12 additional police officers to restore non-partisanship in
Gilroy.

That's not the Gilroy way.
It gives me heartburn to see these DemonRats feminizing council
