The meeting was called to order by Mayor Blankley at 6:00 PM.

Mayor Blankley opened Public Comment.
The following members spoke on items that were not on the agenda:
James D. Polo brought to Council’s attention about construction work noise
violation on First and Wren.
Jeff Orth, Chairman of Gilroy Downtown Business Association (GDBA), provided
an update about the makeup of the GDBA.
Ron Kirkish thanked the City Administrator and Public Works for their work with
regard to keeping the City in good shape during the rainstorms.
Robert Zepeda spoke about the need to protect children from sexual predators.
There being no further speakers, Mayor Blankley closed Public Comment.
4. REPORTS OF COUNCIL MEMBERS
Council Member Bracco reported on the Santa Clara Library Joint Powers
Authority.
Council Member Armendariz had nothing to report.
Council Member Marques had nothing to report.
Council Member Hilton reported on VTA Policy Advisory Committee and Silicon
Clean Energy Authority JPA Board.
Council Member Cline had nothing to report.
Council Member Tovar had nothing to report.
Mayor Blankley reported on Economic Development Corporation. She also
mentioned that the Interfaith Community of South County will be hosting their
annual MLK Interfaith gathering, Sunday, January 15th, at St. Mary's.

6. FUTURE COUNCIL INITIATED AGENDA ITEMS
Council Member Tovar requested that Council discuss the creation of a Standing
Committee for Downtown. The item received majority support.
Council Member Armendariz requested Council to discuss having a weather
shelter within the City. The item received majority support.

7.1. Action Minutes of the December 12, 2022 City Council Special Meeting
A motion was made to approve the minutes.
7.2. Removal of Commissioner Destiny Saldate from Youth Commission
Pursuant to Gilroy City Charter Section 900.
A motion was made to remove Commissioner Destiny Saldate from Youth
Commission.
7.3. Acceptance of the Annual Development Impact Fee Report for Fiscal Year
2021-2022 as Required under Government Code 66000
A motion was made to accept the Annual Development Impact Fee Report for
Fiscal Year 2021-2022.
7.4. Adopt an Ordinance of the City Council of the City of Gilroy Repealing
Ordinance Number 99-13, Removing the Use of Liens to Collect for
Delinquent Garbage Fees
A motion was made to adopt the ordinance.

7.5. Claim of Roohi Eskandarian (The City Administrator recommends a “yes”
vote under the Consent Calendar shall constitute the denial of the claim.)
A motion was made to deny the claim.

10.1. Annual Appointments to City Boards, Commissions, and Committees
With Seats Vacant or Expired as of December 31, 2022
Mayor Blankley opened Public Comment.
There being no speakers, Mayor Blankley closed Public Comment.
Council appointed the following individuals to the various boards and
commissions:
Arts and Culture Commission
No appointment was made to the Arts and Culture Commission with a term
expiring 12/31/2024; and
No appointment was made to the Arts and Culture Commission with a term
expiring 12/31/2025; and
Ruben Dario Villa and Adilene Moreno were appointed to the Arts and
Culture Commission Two with terms expiring 12/31/2026.
Building Board of Appeals
Ronald Robinson, Jr. was appointed to the Building Board of Appeals with a
term expiring 12/31/2026.
Library Commission
No appointment was made to the Library Commission with a term expiring
12/31/2026.
Open Government Commission
Terrence Fugazzi was appointed to the Open Government Commission with a
term expiring 12/31/2024; and
Diane Sanchez Bentz and Shayne Somavia were appointed to the Open
Government Commission with terms expiring 12/31/2026.
Parks and Recreation Commission
Luis Ramirez was appointed to the Parks and Recreation Commission with a
term expiring 12/31/2026.
Personnel Commission
No appointments were made to the Personnel Commission with terms expiring
12/31/2026.

Physically Challenged Board of Appeals
No appointments were made to the Physically Challenged Board of Appeals
with terms expiring 12/31/2025; and

Planning Commission
Michelle Montez was appointed to the Planning Commission with a term
expiring 12/31/2023; and
Manny Bhandal and Kelly Ramirez were appointed to the Planning
Commission with terms expiring 12/31/2026.
Youth Commission
Melanie Reynolds and Jaimee Nguyen were appointed to the Youth
Commission with terms 9/30/2024.
11. INTRODUCTION OF NEW BUSINESS
11.1. A Resolution of the City Council of the City of Gilroy Authorizing the
Submittal of Applications for Payment Programs and Related
Authorizations
Public Works Director Jordan provided staff presentation and responded to
Council Member questions.
Mayor Blankley opened Public Comment.
There being no speakers, Mayor Blankley closed Public Comment.
Possible Action: Adopt a resolution authorizing the City’s application for
recycling program funding through the annual CalRecycle program.

City Administrator Forbis provided staff presentation and responded to Council

Council directed staff to come back to Council with a fine amount of $1,000.00
and provide Council recommendations on the number of days for the City to
cite citations.
11.3. Downtown Survey Results.
Assistant to the City Manager Atkins provided staff presentation and responded
to Council Member questions.
Mayor Blankley opened Public Comment.
There being no speakers, Mayor Blankley closed Public Comment.
Council received the report.
12. CITY ADMINISTRATOR'S REPORTS
12.1. Federal Budget Update – Gilroy Allocations
City Administrator Forbis provided a brief report on this item and an update on
the City’s status in dealing with the rainstorms.
13. CITY ATTORNEY'S REPORTS
13.1. 2023 Brown Act Update (AB 2449)
City Attorney Faber provided a report on this item and responded to Council
Member questions.
14. ADJOURN TO CLOSED SESSION IN MEMORY OF DON CHRISTOPHER

Mayor Blankley opened Public Comment.
There being no further speakers, Mayor Blankley closed Public Comment.
A motion was made by Mayor Blankley to go into Closed Session. The vote was
unanimous.
Mayor Blankley adjourned Regular Meeting to Closed Session at 7:23 PM.
The City Council convened into Closed Session at 7:32 PM.
The vote to stay in Closed Session was unanimous.
15.1. Conference with Negotiator – Collective Bargaining Unit Pursuant to
Government Code Section 54957.6, Gilroy City Code Section 17A.11 (4)
