PROCLAMATION
City of Gilroy, California
WHEREAS, Mark Turner has well served the Gilroy community for
over nine years as the President and CEO of the Gilroy
Chamber of Commerce; and
WHEREAS, Mark has made significant contributions to Gilroy in the
areas of government/business relations, economic
development, and philanthropy, all of which has
improved the quality of life for the Gilroy Community;
and
WHEREAS, Mark is retiring from the position of Gilroy Chamber of
Commerce President and CEO with the sincere
gratitude and appreciation of the Gilroy City Council
for his years of dedicated service to our fine City; and
WHEREAS, Mark has left a legacy of community service,
professionalism, dedication, and a spirit of
collaboration.
NOW, THEREFORE, I, Marie Blankley, Mayor of the City of

direction regarding the Santa Clara County Civil Grand Jury (SCCCGJ) report “If You
Only Read the Ballot, You’re Being Duped”.
Consistent with the direction provided by Council, the attached letter and responses
have been prepared for final review and approval by the City Council.
NEXT STEPS
Once approved by Council, the Mayor will sign the attached letter and staff will send the
letter and responses to the Santa Clara County Civil Grand Jury as required.

Dear Judge McGowen,
Thank you for the opportunity to review and respond to the 2022 Civil Grand Jury of the Santa Clara
County Report “If You Only Read the Ballot, You’re Being Duped.” Please find below the City of Gilroy
responses to the finding and recommendations in the report on the wording of ballot measure
questions. The responses were approved by the Gilroy City Council at the December 1 2, 2022 City
Council Meeting.
Finding 1:
The Civil Grand Jury finds that in the current environment, which is unregulated at the local level, it is
easy for the author of a ballot measure question to write the question in a way that is confusing or
misleading to voters.
City of Gilroy Response to Finding 1:
The City of Gilroy disagrees with the finding that the writing of ballot measures at the local level is
unregulated. All ballot measure questions are reviewed and approved by the Gilroy City Council and
subject to State Law. In addition, there is a judicial remedy available by State Law.

The main concern raised by the SCCCGJ report focuses on Measure A submitted by Valley Water. The
City of Gilroy, therefore, disagrees that additional restrictions and oversight of the City of Gilroy by the
County of Santa Clara are necessary and does not support the removal of local control.
Recommendation 1b:
Governing entities within Santa Clara County should voluntarily submit their ballot questions to the
County Counsel for review prior to submission to the Registrar of Voters, unless and until
Recommendation 1d is implemented.
City of Gilroy Response to Recommendation 1b:
The City of Gilroy finds this recommendation unwarranted, and it will not be implemented by the City.
The City of Gilroy will retain local control of ballot measure questions and will not hand over that
responsibility to County Counsel. The Gilroy City Council will continue to review and approve ballot
measure language, as the Gilroy City Council is the body elected by, and responsible to, the residents of
the City of Gilroy. In addition, the City of Gilroy has a qualified City Attorney to provide the review as is
being proposed in Recommendation 1b.
Recommendation 1c:
Governing entities within Santa Clara County should, by March 31, 2023, adopt their own resolution or
ordinance to require submission of their ballot questions to the County Counsel for review prior to
submission to the Registrar of Voters, unless and until Recommendations 1d and 1e are implemented.
City of Gilroy Response to Recommendation 1c:
The City of Gilroy finds this recommendation unwarranted , and it will not be implemented by the City.
The City of Gilroy does not often have local measures on the ballot, and has not encountered the type
of problem discussed in the report. The Gilroy City Attorney will continue to provide the services
identified and the City will not be shifting those responsibilities to County Counsel.
Recommendation 1e:
Governing entities within Santa Clara County should submit their ballot quest ions for review by the
Good Governance in Ballots Commission pursuant to Recommendation 1d.
City of Gilroy Response to Recommendation 1e:
The City of Gilroy finds this recommendation unwarranted , and it will not be implemented by the City.
The County of Santa Clara does not have the authority to regulate another agency and, as a Charter
City, Gilroy will retain local control.

Passing legislation that would enable the County of Santa Clara to have an express grant of power over
local agencies would be a dangerous precedent and would take away local Gilroy control and grant
control to the County of Santa Clara. The elected officials of Gilroy take the ballot measure process very
seriously and will continue to satisfy their responsibilities to the residents of Gilroy to ensure a thorough
review and approval of any ballot measure questions.
The City Council has carefully reviewed and considered the concerns raised in the report. The Gilroy
City Council supports clear, accurate, and non-biased ballot measure questions and is mindful of the
issues raised. We thank the Civil Grand Jury for their interest in this important issue.

RECOMMENDATION
Council declare the list of electronic waste as surplus and designate the items to be
auctioned or discarded as deemed appropriate by the Administrative Services and
Finance Departments.
BACKGROUND
The City’s Purchasing Policy identifies that any item intending to be donated, discarded
or sold shall be declared surplus by the City Council before disposition. Attached to this
staff report is a listing of computers, monitors, and other obsolete and unused electronic

waste. Historically, the City has provided the e-waste to a contractor to auction off the
items, with 40% of the proceeds returning to the City as revenue.
Individually, each item has insufficient value to warrant the staff time and resources to
sell through competitive bidding. However, as an auction through a contracted
auctioning vendor, with revenue sharing, there is anticipated a small return on the value
of the items. As the entire amount is below the threshold for the Council to determine
value and set sale prices per the purchasing policy, the auction process is the most
efficient for staff time, and will likely return a superior value than attempting to sell each
item individually. Those items that are broken or non-operational and are not able to be
auctioned will be discarded.
ALTERNATIVES
Council may choose not to declare the items listed as surplus. This is not recommended
as the equipment is not in use and is currently consuming storage space.
FISCAL IMPACT/FUNDING SOURCE
40% of the revenue from the auction of the equipment will be deposited into the
Information Technology Internal Service Fund. Final amount will be determined by the
final auctioned amount generated.

BACKGROUND
On March 15, 2021, Giacalone Management, Inc. (Developer), representing property
owner Donald C. Christopher, or his successor, Trustee of the Donald C. Christopher
Separate Property Trust dated January 3, 2008 (Owner), submitted an application
requesting a tentative map to subdivide 8.95 acres into 3 commercial/industrial lots.

On June 3, 2021, the City of Gilroy’s (City) Planning Commission considered TM 20 -08
in accordance with the Gilroy Zoning Code and other applicable standards and
regulations and found that it conformed to the City’s General Plan and recommend ed
TM 20-08 for City Council approval.
On June 21, 2021, Giacalone Management, Inc. received Tentative Map Approval (TM
20-08) to subdivide 8.95 acres into 3 commercial/industrial lots. The subject property is
located at 6605 Automall Parkway, APN 841-16-117. [Reference: Resolution No. 2021-
27 and TM 20-08]
DISCUSSION
The Developer is requesting City Council approval of the Parcel Map and to enter into a
Property Improvement Agreement (PIA 2022-05) with the City for the project’s Public
Improvements. These improvements include new street grading, paving, curb, gutter,
sidewalk, landscape, lighting, storm drain, storm water management, water, sewer, and
necessary utility extension and connection to serve the development. As part of the
Property Improvement Agreement, the Developer is required to provide Faithful
Performance and Payment Bonds of $900,830 for 100% of the estimated construction
cost of the improvements.
Parcel Map and Property Improvement Agreement 2022-05 are ready for Recording
with Santa Clara County with approval by Council.
ALTERNATIVES
Council may deny the request to approve the Parcel Map. However, the current use of
the property (and the request to subdivide the property) is consistent with the City’s
General Plan, Zoning and land use designations for the area. Staff does not
recommend this alternative as it will impose unnecessary delay for the development of
the site.
FISCAL IMPACT/FUNDING SOURCE
Plan check and inspection fees have been collected to cover the costs associated with
this action. The Developer has submitted bonding and insurance for the above -
referenced Property Improvement Agreement and Parcel Map. All the required
improvements are part of the Developer’s responsibility, and there are no
reimbursements required for this project.

It is staff’s recommendation the City Council:
1. Adopt the Resolution accepting the certification of the November 8, 2022 election
results;
2. Declare elected Dion Bracco, Tom Cline, and Carol Marques to the Gilroy City
Council for a full term of four (4) years each; and
3. Declare Measure D ratified and order the City Clerk to file the amendment and
cause it to be recorded pursuant to Govt. Section 34460 .

BACKGROUND
Pursuant to City Council Resolution No. 2022-25, a general municipal election was held
and conducted in the City of Gilroy on Tuesday, November 8, 2022, for the election of
three members to the City Council, all full four-year, as required by law and the Charter
of the City. The three City Council members whose terms were expiring, thereby making
their seats eligible for the election, were Dion Bracco, Carol Marques, and Peter Leroe-
Muñoz. Incumbents Dion Bracco and Carol Marques sought re -election. Peter Leroe-
Muñoz did not seek for re-election. Three additional candidates, Jan Bernstein Chargin,
Joseph Robinson, and Ronald Robinson Jr., filed nomination papers and qualified to run
in the election.
Pursuant to City Council Resolutions Nos. 2022-36 and 2022-42, a special municipal
election was held on the same day for the purpose of amending the City’s Charter
Section 1109 with regard to contracts for public projects. This measure became known
as Measure D. The percentage needed to pass was 50% +1.
Three seats on the City Council seat expire in December 2022. The City consolidated
election services with the Santa Clara County Registrar of Voters in accordance with
City Charter Sections 1400 and 1402 and following all provisions of the California
Elections Code with regard to the election of candidates and Measure D. The Registrar
established four voting locations on November 8, 2022, for the purpose of holding the
municipal election and provided all election services.
The Registrar of Voters has canvassed the returns of the election and has submitted
them to the City Clerk. As elections official the City Clerk has certified the canvass of
the results of the November 8, 2022 election. The City Council is now required to adopt
a resolution reciting the fact of the election , declaring elected the persons for whom the
highest number of votes was cast for each office and the results of Measure D.
The following three (3) candidates had the highest number of votes cast in the canvass
of returns for the office of City Council for full four-year terms:

TOM CLINE
CAROL MARQUES
Elections Code Section 10263(b) requires the governing body to meet at its usual place
of meeting no later than the next regularly scheduled meeting following the presentation
of the 30-day canvass of the returns, or at a special meeting called for this purpose, to
declare the results and to install the newly elected officers.
With regards to Measure D, the ROV’s Certificate of Results and Official Canvass,
attached to the accompanying resolution, shows that the measure has passed, and it
shall be deemed ratified, but shall not take effect until it is accepted and filed by the
Secretary of State pursuant to Section 34460.

CERTIFICATION OF THE CANVASS OF THE GENERAL
MUNICIPAL ELECTION AND THE ELECTION OF THREE
COUNCIL MEMBERS AND THE ELECTION FOR AND
AGAINST MEASURE D AND DECLARING RESULTS OF
SAID ELECTION HELD IN THE CITY OF GILROY ON
NOVEMBER 8, 2022
WHEREAS, a consolidated General Municipal Election was held and conducted in the
City of Gilroy on Tuesday, November 8, 2022, as required by law and the Charter of said City, for
the purpose of electing to office three City Council Members for full four-year terms; and
WHEREAS, a consolidated Special Municipal Election was held and conducted in the
City of Gilroy on Tuesday, November 8, 2022, for the purpose of electing for and against Measure
D; and
WHEREAS, notice of said election was duly and legally given, voting precincts were
properly established, election officers were appointed and election supplies furnished and in all
respects said election was held and conducted by the County of Santa Clara, and the votes cast
were received and canvassed and the returns thereof made and declared in the time, form and
manner as required by the provisions of the Elections Code of the State of California governing
Municipal Elections; and
WHEREAS, the Registrar of Voters of Santa Clara County, having canvassed the returns
of said election, certified on December 8, 2022, a full, true, and correct Statement of the Results
of all votes cast at the said election for each candidate, and for the outcome of the election on
Measure D, the result of which the Gilroy City Council accepts, and finds that the number of votes
cast, the names of the persons voted for and other matters required to be as hereinafter stated; and
WHEREAS, said canvass was duly completed and the results thereof were certified by the
City Clerk and submitted to this Council.
NOW, THEREFORE, BE IT HEREBY RESOLVED, DECLARED, DETERMINED,
AND ORDERED BY THE CITY COUNCIL OF THE CITY OF GILROY AS FOLLOWS:
SECTION 1. That said consolidated General Municipal Election was held and conducted
in the City of Gilroy, County of Santa Clara, State of California, in the form, time, and manner as
required by law; that the number of votes given in each precinct either for or against the measure,
together with the whole number of votes which were received in the entire City are contained in
the Santa Clara County Registrar of Voters’ Certificate of Election Results and Official Canvass,
attached hereto as Exhibit “A”.
SECTION 2. That the names of persons voted for at the general municipal election for
Member of the City Council are as follows: Jan Bernstein Chargin, Dion Bracco, Tom Cline, Carol

SECTION 3. That the Charter Amendment Measure voted upon at the special municipal
election is as follows:
Measure D - Construction Contract Procurement and Public Noticing Modernization
Shall the City of Gilroy Charter be amended to:
• Modify the bidding threshold from $35,000 to the amount authorized by
California Public Contract Code Section 22032;
• Establish authority to procure for Design-Build and Best Value
contracts;
• Allow modernization of public noticing?

SECTION 4. The canvass of the returns of the votes cast and the counting of vote-by-mail
ballots cast in said City for the Office of City Council Member was duly held by the Registrar of
Voters in accordance with the order of the Council and in accordance with law, and the Registrar
of Voters has executed a certificate of the results of such canvass, which certificate is hereto
attached, as Exhibit "A" and by this reference is made a part hereof.
SECTION 5. Per Elections Code Section 10262(b), said certificate of results has been
examined by the City Clerk and has been certified by him to be complete.
SECTION 6. Said certificate has been examined and is hereby approved and adopted by
this City Council as the official canvass of said municipal election as required by Elections Code
Section 10263.
SECTION 7. The whole number of votes cast in the City of Gilroy at said municipal
election, including vote-by-mail votes, was 15,505 for City Council Member and 15,521 for
Measure D.
SECTION 8. The names of the persons voted for, the offices for which they were voted,
the number of votes received by each of said persons in each of said precincts and by vote by mail
votes are shown on said Exhibit "A", attached hereto.
SECTION 9. That the number of votes given at each precinct and the number of votes
given in the City to each of the persons above named for the respective offices for which the
persons were candidates and for and against the measure were as listed in Exhibit "A" attached.
SECTION 10. The City Council does declare and determine:
That as a result of the consolidated General Municipal Election, Dion Bracco was
elected to the office of City Council Member of the City of Gilroy for a full four-
year term, from and after Monday, December 12, 2022, and continuing until his
respective successor shall qualify;
That as a result of the consolidated General Municipal Election, Tom Cline was
elected to the office of City Council Member of the City of Gilroy for a full four-

year term, from and after Monday, December 12, 2022, and continuing until his
respective successor shall qualify;
That as a result of the consolidated General Municipal Election, Carol Marques was
elected to the office of City Council Member of the City of Gilroy for a full four-
year term, from and after Monday, December 12, 2022, and continuing until her
respective successor shall qualify;
That as a result of the consolidated Special Municipal Election, a majority of the
voters voting on Measure D, relating to “Construction Contract Procurement and
Public Noticing Modernization”, voted in favor of the Measure with the required
50% +1 vote, and it shall be deemed adopted and ratified upon the date that the vote
is declared by the City Council but shall not take effect until accepted and filed by
the Secretary of State, pursuant to Section 34460.
SECTION 11. The City Clerk shall make out and deliver to each of the persons elected a
certificate of election, witnessed by his hand, and duly authenticated. He shall also administer the
constitutional Oath of Office prescribed in the Constitution of the State of California to each
elected official and ask them to subscribe thereto. Each and all of the persons so elected shall then
be inducted into the respective office to which they have been elected.
SECTION 12. The City Clerk shall enter this resolution in full in the minutes of this City
Council as a statement of the result of said general municipal election and enter it into the book of
original resolutions.
PASSED AND ADOPTED by the City Council of the City of Gilroy at a special meeting
duly held on the 12th day of December 2022 by the following roll call vote:

RECOMMENDATION
The City Charter contains the requirement to elect a Mayor Pro Tempore following the
“election or appointment of a member to the Council.”
Following the election of November 8, 2022, it is appropriate that the Council elect a
new Mayor Pro Tempore for the calendar year 2023.

BACKGROUND AND ANALYSIS
Section 502 of the Charter is entitled “Mayor Pro Tempore” and describes the following:
“At the first meeting of the Council following the election or appointment of
a member to the Council, the Council shall elect one of its members as
Mayor Pro Tempore who shall act as Mayor during the absence or inability
of the Mayor to act. In the case of the temporary absence or disability of
both the Mayor and the Mayor Pro Tempore, the Council shall elect one of
its members to act as Mayor Pro Tempore.”
As new Council Members have started their terms on December 12, 2022, and with the
departure of former Mayor Pro Tempore Leroe-Muñoz, it is now appropriate that the
Council elect a new Mayor Pro Tempore to serve during the calendar year 2023.
At this time, Mayor Blankley recommends that Council Member Dion Bracco be
selected to serve as the Mayor Pro Tempore for the calendar year 2023.

Adopt a resolution of the City Council of the City of Gilroy approving a budget
amendment in Fiscal Year 2022-23 adding $265,801 from the Office of the District
Attorney to the Police Grants Fund for the South County Youth Task Force (SCYTF).
EXECUTIVE SUMMARY
Since Fiscal Year 2012-13, the South County Youth Task Force (SCYTF) has initiated
strategies, programs, and services focused on reducing violence by, and against, youth
and their families in South Santa Clara County (South County). Utilizing a multi-year

strategic plan, the SCYTF has traditionally secured funds from State and local sources
to support the Task Force program and services. In Fiscal Year 2018 -19 the SCYTF
Policy Team engaged in discussions to secure future funding at the local level to
support the ongoing efforts of the SCYTF.
From those discussions, the County of Santa Clara has allocated multiple years of
funding to support SCYTF strategies, programs, and services. The ongoing coordination
of the SCYTF is provided through a partnership between the City of Gilroy and the
County of Santa Clara. The City serves as the fiscal agent for the SCYTF and the
County of Santa Clara serves in a leadership capacity to help set policy direction and
seek funding for the SCYTF.
The City Council is asked to approve an amendment to the Fiscal Year 2022-23 budget
to appropriate the funds.
BACKGROUND
Consisting of over 30 participating agencies, the SCYTF has utilized a multi-year
strategic plan as a guiding document to unite the collective visions of the membership
and to target priorities for deployment of services and funding.
Funding and resources to support the SCYTF efforts have been secured from State and
local grant funds and individual cash contributions from key SCYTF agencies and/or in -
kind services and contributions from the SCYTF membership. Since 2012, the City of
Gilroy has served as the lead coordinating agency for the SCYTF collaborative and
serves as both administrative and fiscal agent for the SCYTF. In 2019 to help carry the
load, the County of Santa Clara assumed shared coordination and leadership of the
SCYTF with the City remaining as the fiscal agent. As a result, all cash funding awards
and contributions continue to be accepted and administered by the City of Gilroy on
behalf of the SCYTF.
ANALYSIS
In Spring 2022 community engagement efforts were held in Gilroy, San Martin and
Morgan Hill with stakeholders, policy makers, and community members. The outcome
of those efforts led to the 2023-2025 SCYTF Project II THRIVE Strategic Plan. As a
result, in its FY23 adopted operating budget, the County of Santa Clara District
Attorney’s Office (DAO) allocated an additional $265,801 to support the continuing
efforts of the SCYTF Project II THRIVE Strategic Plan. The DAO and City have entered
into an amendment to the current service agreement with the City of Gilroy as co-
coordinator and fiscal administrator of the SCYTF funds. The term of the amend ed
agreement will end October 31, 2023. With approval of the proposed budget
amendment, funding will be appropriated to the Police Grants Fund. Any unexpended
funds at the end of the fiscal year may be carried over to the following fiscal year
through a written request by the City and approval by the DAO.

ALTERNATIVES
Council may reject the budget amendment. This will prevent the City from utilizing the
additional $265,801 from the County in its function as the fiscal agent for the SCYTF.
Ultimately, services to the residents of the City of Gilroy and greater South County
region would be reduced. Staff does not recommend this alternative.
FISCAL IMPACT/FUNDING SOURCE
If approved, funds from the County of Santa Clara will increase funding sources and
appropriations in the FY23 operating budgets by $265,801 .
The City of Gilroy’s contribution to the SCYTF is the full-time SCYTF Coordinator
position currently funded through the existing budget.

WHEREAS, the City Administrator prepared and submitted to the City Council a budget

examined, considered and adopted the same on June 7, 2021; and
WHEREAS, City Staff has prepared and submitted to the City Council a proposed
amendment to said budget for Fiscal Year 2022-2023 for the City of Gilroy in the staff report dated
December 12, 2022 for the Police Grants Fund; and
WHEREAS, the City Council has carefully examined and considered the same and is
satisfied with said budget amendments.

EXECUTIVE SUMMARY
The City of Gilroy (City) has been awarded a Title II Grant from the California Board of
State and Community Corrections (BSCC) for $1,049,952 over a period of three
calendar years. The Title II grant was submitted to the BSCC as a collaborative
application along with entities of the South County Youth Task Force (SCYTF) and
designated the City as the lead and fiscal agent in August 2022.
The grant will provide funding for services in the cities of Gilroy and Morgan Hill and
unincorporated San Martin. The term of the grant is for three years from Janu ary 1,
2023 through December 31, 2025 at an allocation of $349,984 per year.
The recommended action is to: 1) authorize the City Administrator to accept the grant
award, execute an agreement with the BSCC, implement and administer all
requirements of the grant, and 2) amend the Fiscal Year 2023 (FY23) budget to
appropriate the first year of funding, with the Fiscal Year 2024 (FY24) and 2025 (FY25)
grant award portions to be included in the proposed budget appropriations during the
next Council biennial budget process.
BACKGROUND
In 2012 and 2013, the City of Gilroy led a collaborative effort that included the City of
Morgan Hill, the County of Santa Clara, the Gilroy and Morgan Hill School Districts, and
community-based organizations and community members to establish the South County
Youth Task Force (SCYTF). The focus of the SCYTF at its inception was to intervene in
the lives of youth to provide positive socialization opportunities as alternatives to
criminal involvement and to deter them from at-risk behaviors and gang influences.
At the onset of the SCYTF’s formation the City also received a California Gang
Reduction, Intervention, and Prevention Grant (CalGRIP) award from the BSCC that
enabled the City to solidify the SCYTF membership and structu re. SCYTF created its
first strategic plan that helped unite the collective missions of the task force’s
membership around a single vision. From this unified effort, the City on behalf of the
SCYTF applied for and received two additional CalGRIP grant awards from the BSCC
between 2014 and 2017 for “Project REACH and Project One Neighborhood
Empowered (ONE)”.
In 2017 the SCYTF approved a new strategic plan, titled “THRIVE: Transformation and
Hope, Resiliency, Integrity, Voice, & Engagement – 2017-2020”. The new strategic plan
was built on the foundation established from the inaugural SCYTF Strategic Plan –
2013-2017 and places an emphasis on sustainability beyond CalGRIP funding,

strengthening existing capabilities, and filling in identified service gaps in prevention and
violence de-escalation. THRIVE encompasses five violence prevention strategies meant
to address the underlying causes of violence in targeted communities within the south
county area. It is a guiding document for collaboration and for seek ing future funding
opportunities. The five THRIVE strategies are:
1. Improve and expand community building and violence prevention efforts,
2. Increase accessible safe places and after-school programs for children, youth
and families,
3. Move community and police relations towards a restorative justice model,
4. Increase street outreach and intervention, and
5. Continue to build capacity to improve effectiveness and collaboration of multi -
agency partnerships.
In 2017, a new BSCC grant program was approved by the State to replace the former
CalGRIP program. The new program, California Violence Intervention and Prevention
(CalVIP), focused on community violence with an emphasis on prevention and
intervention strategies that address community needs and effect positive chan ge to the
community. Accordingly, the City (on behalf of the SCYTF) submitted a grant application
titled “Project THRIVE: Transformation, Hope, Resiliency, Integrity Voice and
Empowerment” and utilized the THRIVE strategies as its model.
The City received the CalVIP award of $500,000 over two years to carry out the five
THRIVE strategies from 2018-2020. The City of Gilroy was no longer eligible for the
CalVIP Grant funds in FY 21-22 due to not meeting the criteria of being a city that is
“disproportionately impacted by violence” based on homicide rates per calendar year.
In early 2021, through a collective process, the SCYTF collected input, ideas, and data
from different community stakeholders to shape what is now considered the only
restorative justice-based diversion program in Santa Clara County. The vision is to not
only increase our capacity to deliver an improved and enhanced diversion program, but
to continuously improve the capacity and reach of our local behavioral health, law
enforcement, school administrators and educators to embrace and actively engage in
the South County Restorative Justice Youth Diversion Program pilot. As the only South
County, regional multi-agency collaboration of local governments, school districts,
community and faith-based organizations, and law enforcement agencies ; operating
with a focus on youth, the SCYTF team consists of individuals who are committed to
serving, supporting, and uplifting our youth so they can thrive. The South County
Restorative Justice Diversion Program is a key component of the new SCYTF Strategic
Plan Project II THRIVE (2023-2026) and therefore this grant program is a top priority for
both SCYTF’s Policy and Technical Team members.
During the development of the 2017 and 2023 SCYTF Strategic Plans, various cross-
sector partners, including community-based organizations (CBOs), school district
personnel, law enforcement agencies (LEAs), parents and youth, participated in
listening circles. In these listening circles, a broad range of needs were expressed,

including increasing pro-social activities that positively affect youth, accessibility to more
local community-based services for youth and parents, and concerns over crime rates,
among others. A diversion program that serves youth cited and/or a rrested in South
County was overwhelmingly well-received by community and system partners, in
addition to having these programs accessible to youth prior to receiving citations. As a
result, the Diversion Program emerged, carefully designed with input from youth,
parents, CBOs, law enforcement, and other system partners. Development of the
program occurred throughout 2021 with community information nights and community
presentations held throughout Gilroy and Morgan Hill.
On August 12, 2022, the Title II grant was submitted for a total of $1,049,952 as a
collaborative application among the entities of the South County Youth Task Force
(SCYTF) to fund the South County Restorative Justice Youth Diversion Program
(RJYDP). The RJYDP provides an opportunity for south Santa Clara County youth who
engage in alleged citable or harmful conduct to come together with impacted community
members and collectively address the incident as a circle, while supporting and
respecting youth as valuable community members. Compl etion of the voluntary
program diverts youth away from the Juvenile Justice System by striving to decrease
historical and systematic inequities and barriers and provides local supports to youth
and families to heal and thrive.
Based on Restorative Justice framework, RJYDP operates through a trauma-informed
lens and seeks to address root causes of harmful behaviors through program
milestones. Youth voice alongside the locally impacted community will create solutions
needed to cultivate positive opportunities and pathways. A small pilot of the RJYDP is in
place. This grant will greatly expand the number of youth/families served, expand
referring agency capacity and offer necessary trainings. The majority of program funds
go directly to local community-based organization partners to provide essential services.
On November 17, 2022, the City was notified the BSCC Board approved the funding
recommendations of the Title II Program Executive Steering Committee (ESC) and
awarded the City of Gilroy a grant in the amount of $1,049,952. As the grant applicant,
the City assumes responsibility as the lead agency with fiscal and administrative
responsibilities for the grant.
ANALYSIS
The term of the grant is for three years, with services commencing on January 1, 2023
and ending December 31, 2025 and a final evaluation period commencing on January
1, 2026 ending March 31, 2026 with an allocation of $349,984 per year.
Proposed FY23, FY24 and FY25 budget appropriations are included in the table below.
The Council is only asked to amend the FY23 adopted operating budget. Appropriations
for FY24 and FY25 will be included in the proposed budgets presented to Council in the
next two-year budget planning process.

The Title II Grant will provide services to three cities/ local jurisdictions: Gilroy, San
Martin and Morgan Hill. The South County Restorative Justice Youth Diversion Program
(RJYDP) pursues three goals.
Program Purpose Area: South County Restorative Justice Youth Diversion Program
Goal One is for youth who commit lower-level offense(s), that there will be an increase
in participation in the diversion program, thereby diverting these youth away from the
juvenile justice system and into a restorative justice-based diversion program.
Goal Two is to increase local support for youth, families, and victims that have been
impacted by the alleged harm that led to the citation.
Goal Three is to enhance and increase the understanding and use of the restorative
justice model, use of restorative practices, and trauma-informed care throughout South
County community, schools, all South County Youth Task Force CBOs, and public
safety agencies.
ALTERNATIVES
If the Title II Grant is not accepted, the City will not receive the $1,049,952 grant award
from the BSCC and services proposed for the three cities/ local jurisdictions will not be
provided. Staff would need to seek alternative funding options and continuation of the
program will be impacted. This is not recommended.
FISCAL IMPACT/FUNDING SOURCE
Acceptance of the $1,049,952 Title II Grant award will increase FY23, FY24 and FY25
Operating Budget revenues and appropriations by $349,984 per year. Any unexpended
funds at the end of the fiscal year may be carried over to the following fiscal year
through a written request by the City and approval from BSCC.
PUBLIC OUTREACH
During the Project II THRIVE strategic plan development a community engagement and
outreach process was conducted in the Spring of 2022 and focused on engaging
current participants in areas that had been targeted in the inaugural 2013 plan. Multiple

community listening circles were held in Gilroy, San Martin and Morgan Hill along with
strategic stakeholder group sessions for both the Policy and Technical Teams of the
SCYTF.
The entire process included participation of approximately 367 members of the
community, policy makers, and stakeholders from the cities. Special focus groups for
youth were also held to ensure their voices were heard and included in the strategic
plan recommendations. The SCYTF Policy Team approved the 2023-2026 Project II
THRIVE SCYTF Strategic Plan on November 16, 2022. The City Council will receive a
presentation on the newly-adopted THRIVE SCYTF Strategic Plan during a January
2023 Council meeting.

DESIGNATING CERTAIN POSITIONS AS AGENTS FOR
THE CITY OF GILROY’S APPLICATIONS FOR, AND
ADMINISTRATION OF, FUNDING FROM THE BOARD OF
STATE AND COMMUNITY CORRECTIONS
WHEREAS, the City of Gilroy (“City”), is a municipal corporation duly organized and
existing under and pursuant to the Constitution and laws of the State of California (“City”); and
WHEREAS, the Board of State and Community Corrections requires for accepting and
administering grants under their funding programs to have designated agents authorized by their
respective legislative bodies to execute such documents for and on behalf of the Board of State
and Community Corrections; and
WHEREAS, the authorization may be applied universally for three-year terms for all
funding opportunities from the Board of State and Community Corrections for any existing or
future grant programs; and
WHEREAS, the City applied for and has been awarded the 2022 Title II Grant Program
from Board of State and Community Corrections to support delinquency prevention and juvenile
justice system improvement; and
NOW, THEREFORE, BE IT RESOLVED THAT the City Council of the City of Gilroy
does hereby find, determine, resolve and order as follows:
Section 1. Recitals. The City Council does hereby find, determine, and resolve that all of
the foregoing recitals are true and correct.
Section 2. Designation. The City Council does further resolve that the City Administrator
is hereby authorized and designated as agent for the City of Gilroy to execute for and on
behalf of the City of Gilroy any and all required documents to apply for, accept, and
administer any and all funding sources provided through the Board of State and
Community Corrections for four (4) years from the date of adoption provided below.
Section 3. Acceptance. The City Council hereby accepts the three-year 2022 Title II Grant
with service period commencing on January 1, 2023, and ending on December 31, 2025,
and a final evaluation period commencing on January 1, 2026, ending March 31, 2026.
Total grant award is $ 1,049,952.

WHEREAS, the City Administrator prepared and submitted to the City Council a budget

WHEREAS, City Staff has prepared and submitted to the City Council a proposed
amendment to said budget for Fiscal Year 2023 for the City of Gilroy in the staff report dated
December 12, 2022 for the Board of State and Community Corrections Fund; and
WHEREAS, the City Council has carefully examined and considered the same and is
satisfied with said budget amendment.
NOW, THEREFORE, BE IT RESOLVED THAT appropriations in the Board of State
and Community Corrections Fund, Fund 228, is hereby increased by and additional $349,984 for

The City Council opened the annual recruitment period ending November 30, 2022, to
fill seats on six Boards, Commissions, and Committees with member terms vacant or

received after the November 30th deadline, however staff recommends that Council
accept those applications due to the several Boards, Commissions, and Committees not
receiving an adequate number of applications to fill all vacant seats.

There are two qualifications that I believe allow me to meet the standards of this appointment. One would be
my certificate of completion from the state of California in partnership with the Department of Industrial
Relations as well as the Division of Apprenticeship Standards, another would be my certificate of achievement
with Foothill College In partnership with the Santa Clara County Electrical JATC which has given me all of my
training to be up to date with building codes throughout the county and state.

First, I do not have any prior appointments. A lot of the service work I do in the community is really myself
reaching out to local organizations and non profits. I donate, contribute, lend a helping hand and advocate for
them any chance possible. I take pride in that work and do it when I can because I feel it’s important to be
apart of the community in any way you can.
What are your goals while serving on this Board/Commission/Committee?
My goal if granted the opportunity to serve on this board would be to make sure I can be of service to the
community and do the necessary work after being provided information that the infrastructure in Gilroy is
built correctly. My goal would be to be as useful as possible and contribute to the future of Gilroy as a pertains
to the community we are trying to shape. Given that this is a volunteer position my goal is to give back to the
city they gave so much to my family.
Why are you the most qualified to serve on this Board/Commission/Committee?
I believe I’m the most qualified to serve on this board because this is what I do for a living. I work daily with
multiple trades throughout the city and county on various projects such as commercial buildings, fire houses,
libraries, schools, public infrastructure and even homes. I work daily with project managers, designers,
engineers, management and city inspectors as well as inspectors of the county. I believe this is a great

opportunity for me to use my every day craft to give back to the city of Gilroy and that’s why I feel I’m

I have applied to be re-appointed to the Open Government Commission but unfortunately, I will not be
able to be in attendance for the interview with the council on 12 December. My husband and I have a
planned vacation to southern California beginning Saturday, 10 December and ending 23 December. We
have prepaid for our trip, and it cannot be postponed without incurring additional costs.
Please know I am committed to the goals and priorities of the Commission. I am the current chair of the
Commission and past vice-chair; I feel very strongly that with the knowledge and education I have gained
in the past four years, I can continue to contribute in a meaningful way to the Commission and the City. I
look forward to continuing the furtherance of the Commission’s goals and I believe there is a lot more we

gained experience in how to start and run a club/organization effectively as well as utilize leadership qualities.
I am also an ongoing member of another leadership commission, the YMCA Student Leadership Council, that
focuses on improving the lives and conditions surrounding the youth through advocacy and initiatives. In this
organization, I frequently provide my own input on topics that need focus, such as making parks and schools
safer for children. Also, I often am involved in leadership building activities with others on the council. I
believe that I can take the leadership skills that I picked up from prior opportunities and utilize them here on
the Gilroy Youth Commission.
List any service to the community including any prior appointments:
I have volunteered extensively (100+ hours) at local organizations or events around my area, such as through
the Santa Clara County Parks Organization, or at nearby animal shelters In these opportunities, I am often
working with others in maintaining local parks or taking care of animals in need. Frequently, these acts of
customer service require me to engage with citizens/bystanders coming through such organizations,
ultimately allowing me to build a sense of community with those around me. I aim to volunteer around 3-5
hours per week as I feel that it is a good opportunity to give back to my community and help those around me.
I have also volunteered around 20+ hours with the City of Gilroy at events such as the Gilroy Garlic Festival and
I aim to be able to do more in the future.
What are your goals while serving on this Board/Commission/Committee?
While serving on the Gilroy Youth Commission, I hope to be able to act as a voice for my peers in creating
change within my community. Specifically, I hope to be able to advocate for the reduction of vape or smoking
products like e-cigarettes that are circulating among the youth. In schools especially, I feel that this problem is

beginning to grow dramatically as many teens carry around products such as these. These products find
themselves in the hands of youth due to factors such as peer pressure or from a lack of information about the
harms that it can cause. In order to address this problem, I hope to advocate for the dangers of e-cigarettes
and products alike that can cause harm to youth going into the future. I also hope to be able to build strong
relationships with others on the commission so that we can all collectively make change.
Why are you the most qualified to serve on this Board/Commission/Committee?
I believe that I am most qualified to serve on the commission as I have prior leadership experience that can
transfer to my position on the commission. I also believe that I have worthwhile opinions on creating change
within my community and those around me. I feel that I have the ability to be able to effectively converse and
engage with others on the council in order to meet a common goal through discussion.
