(Roll Call Vote) PROJECT DESCRIPTION: Due to ongoing concerns about theft and van dalism from the applicant’s clients, the applicant is requesting an amendment to the City Code’s Fence Ordinance to allow monitored perimeter security fence systems (“electrified fences”) on commercial and industrial zoned properties. BACKGROUND: Pursuant to Article XXXIV, Section 30.34.040, electrified fences of any kind are currently prohibited in the City. Pursuant to Article LII (Amendment to the Zoning Ordinance), Sections 30.52.30, 30.52.40, 30.52.55, and 30.52.60, the Planning Commission shall hold a public hearing to consider ordinance amendments and may either deny the request or recommend City Council the approval of the request. In the case of a recommendation of approval, the planning commission shall make findings demonstrating that the amendment is necessary to carry out the general purpose of the applicable City Code and applicable general plan goals and policies. The recommended ordinance will then be scheduled for a city council hearing. In the case of a denial, the planning commission shall adopt a resolution with specific findings for the denial. If denied, the applicant may appeal to the City Council. The city council may approve, modify, or disapprove a proposed ordinance amendment. 5.A Packet Pg. 8 2 ENVIRONMENTAL REVIEW: Review and approval of Z 21-02 qualifies for an exemption from environmental review under California Environmental Quality Act (“CEQA”) Section 15311 (Class 11) of the CEQA guidelines, which provides that CEQA does not apply to the construction of minor structures accessory to (appurtenant to) existing commercial, industrial, or institutional facilities, including but not limited to fences. The action also would not constitute a “project” within the meaning of CEQA under Section 15061(b) (3) of the CEQA Guidelines, which states a project is exempt from CEQA when “[t]he activity is covered by the common sense exemption that CEQA applies only to projects which have the potential for causing a significant impact to the environment. Where it can be seen with certainty that there is no possibility that the activity in question may have a significant effect on the environment, the activity is not subject to CEQA”. DISCUSSION AND ANALYSIS The electrified security fence system (“electrified fence”) would be located behind a separate non-electrified perimeter fence (“perimeter fence”) in order to prevent inadvertent access to the electrified security system. The design standards required under the Ordinance will also help ensure that the electrified fence will be visually transparent, as seen from the public right-of-way and adjacent properties. The permitted perimeter security system would be a short -pulsed, monitored, burglar alarm system which meets international installation standards, and has been safety tested and certified by a Nationally Recognized Testing Laboratory (NRTL). The alarmed, battery-charged electrified fence would be located 6 -to-12-inches behind the perimeter fence and would be comprised of twenty (20) 12.5 gauge, galvanized steel wires which run horizontally to a height of 10-feet. The power source for the security system is low voltage, solely powered by a 12V/DC battery. No part of the system connects to the electrical grid and it does not carry continuous current. The system includes an audible alarm which sounds when the fen ce line is breached by a trespasser. This type of system does not directly connect to or call law enforcement, thereby minimizing unnecessary calls for service. In the event of an alarm, a signal will be sent to the security provider’s monitoring station, who in turn contacts the business to let them know they had an alarm event. The alarm can be silenced by the business after verification or set to automatically shut off after a determined amount of time. The business must first verify the alarm event, and only then will deployment of law enforcement be requested. The proposed amendment and required findings for approval are provided in the attached draft Ordinance (Attachment 1). As provided therein, monitored perimeter security fence systems would be permitted in commercial and industrial zoned properties, subject to certain design, construction, and operating requirements. Prior to installation, the property owner shall receive an approved permit from the Police Department in accordance with GCC Chapter 3B (Alarm Systems). Findings for Approval: If recommending approval, the Planning Commission shall 5.A Packet Pg. 9 3 announce its decision making the findings for approval. The recommended Ord inance will then be scheduled for consideration by the City Council. The tentative City Council public hearing for this proposed amendment has been scheduled for June 21, 2021. Based on staff’s analysis, the required findings for approval have been met as follows: 1. That the amendment is necessary to carry out the general purpose of this chapter: The intent of Article XXXIV (Fences and Obstructions) is to control the location, height and materials of fences and other visual or physical obstructions so that t hey do not adversely affect adjacent properties or obstruct vision along public streets. Staff Analysis: The proposed amendment is consistent with the intent of the fence ordinance, because the criteria for approval of a monitored perimeter security fence system requires the electrified fence to be visually transparent, since it would be located 6-to-12-inches behind a perimeter fence and would be comprised of twenty (20) 12.5 gauge, galvanized steel wires which run horizontally to a height of 10-feet. 2. That the amendment is necessary to carry out the applicable general plan goals and policies. Staff Analysis: The proposed amendment will carry out the following Gilroy 2040 General Plan goals and policies: 2040 General Plan Goals and Policies Staff Analysis Land Use Goal LU 5. Encourage, facilitate, and support the development of new employment and industrial uses and retention of existing industry to ensure compatibility with existing surrounding uses and planned uses. Approval of the code amendment will help retain existing businesses in the City by minimizing theft and the associated loss of revenue. The proposed design standards will help ensure that the fence is visually transparent as seen from the right-of-way and adjacent properties. Economic Prosperity Goal EP 3. Maintain a supportive business climate that increases the City’s ability to support expansion of existing businesses and attraction of new businesses. The requested code amendment was in response to vandalism, trespassing, and theft of a local business in Gilroy. Approval of the code amendment will help minimize crime against businesses throughout the commercial and industrial zones of the city. Economic Prosperity Policy EP 3.3 Regulation Updates. Update policies, procedures, and regulations to promote a business-friendly atmosphere and a high-quality environment that is attractive to residents and businesses. Approval of the code amendment will permit installation of a security system that is designed to secure businesses’ property and assets in industrial and commercial zones by providing monitored intrusion protection around the perimeter of a property. Economic Prosperity Policy EP 8.1 Industrial Approval of the code amendment will 5.A Packet Pg. 10 4 and Commercial Lands. Protect and improve the quantity and quality of lands designated for industrial and commercial uses. protect commercial and industrial businesses by deterring theft and vandalism, alerting the business owner when the alarm is activated, and requesting the deployment of law enforcement in case of a security breach. Public Facilities and Services Goal PFS 9 Provide excellent public safety services in partnership with the community. The monitored perimeter security fence system requires the business to verify the alarm event, prior to requesting deployment of law enforcement; thereby minimizing unnecessary calls for service. Public Facilities and Services Policy PFS 9.3 Development Review. Include the Police Department in the review of development proposals to ensure that crime and safety issues are consistently addressed in the review of new development. Such review shall promote the implementation of Crime Prevention through Environmental Design principles. Applicants will be required to obtain a permit from the Police Department. The required multi-lingual "Warning-Electric Fence" signage will act as a deterrent to theft and vandalism. Public Outreach and Noticing: As required by law, a notice of the Planning Commission meeting was advertised in The Gilroy Dispatch on Friday, April 30, 2020 (no less than 10 days prior to the meeting). Individual property owner notification is not required since the proposed amendments affect large areas of the City. The Planning Commission public hearing packets are available through the City’s web page. Appeal Procedure: In accordance with Section 30.51.50 of the Gilroy City Code, the Planning Commission's decision may be appealed, in writing, to the City Council within 20 days of adoption of the resolution. Applicant letter 5.A Packet Pg. 11 ORDINANCE NO. 2021-XX AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF GILROY AMENDING THE GILROY CITY CODE, CHAPTER 30 (ZONING), ARTICLE XXXIV (FENCES AND OBSTRUCTIONS) WHEREAS, the Gilroy City Code Chapter 30 (Zoning), Article XXXIV (Fences and Obstructions), Section 30.34.040, currently prohibits electrified fences of any kind within the city; and WHEREAS, the City of Gilroy has received an application to amend the Gilroy City Code, Chapter 30 (Zoning), Article XXXIV (Fences and Obstructions) to allow electrified security fences, subject to certain criteria, on commercial and industrial zoned properties; and WHEREAS, the Planning Commission has received and considered the Zoning Code amendment, in accordance with the Gilroy City Code Chapter 30, Article LII (Amendment to the Zoning Ordinance), and the staff report pertaining to the proposed Zoning Text Amendment file number Z 21-02; and WHEREAS, the Planning Commission held a duly noticed public hearing on May 17, 2021, at which time the Planning Commission took and considered the written and oral public testimony related to Zoning Text Amendment file number Z 21-02 and thereafter recommended that the City Council approve said amendment; and WHEREAS, the City Council held a duly noticed public hearing on June 21, 2021, at which time the City Council received and considered Zoning Amendment file number Z 21-02, took and considered written and oral public testimony, the staff report, and all other documentation related to application Z 21-02; and WHEREAS, the City has determined that review and approval of the provisions contained in the Zoning Amendment file number Z 21-02 is exempt from environmental review under the California Environmental Quality Act (“CEQA”) pursuant to Section 15311 (Class 11) of the CEQA guidelines, which provides that CEQA does not apply to the construction of minor structures accessory to (appurtenant to) existing commercial, industrial, or institutional facilities, including but not limited to fences. WHEREAS, in accordance with City of Gilroy Zoning Code Section’s 30.52.40 and 30.52.60, the Planning Commission finds that the proposed Zoning Ordinance Amendment implements the Gilroy 2040 General Plan and in particular: Land Use Goal 5; Economic Prosperity Goal 3 Economic Prosperity Policy EP 3.3 (Regulations Updates); Economic Prosperity Policy EP 8.1 (Industrial and Commercial Lands); Public Facilities and Services Goal 9; and Public Facilities and Services Policy PFS 9.3 (Development Review). In line with these goals, the zoning amendment will promote a business-friendly atmosphere, protect lands designated for industrial and commercial uses, and help ensure that crime and safety issues are addressed; and WHEREAS, the location and custodian of the documents or other materials that constitute the record of proceedings upon which Z 21-02 approval is based is the office of the City Clerk. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF GILROY DOES HEREBY ORDAIN AS FOLLOWS: SECTION I Gilroy City Code, Chapter 30, Zoning, XXXIV (Fences and Obstructions), Section 30.34.40 (Prohibited materials) is hereby amended as follows: 30.34.40 Prohibited materials. (a) Barbed Wire Fences. Barbed wire, razor wire or similar fences shall not be installed within the city, except for security fences in commercial and industrial zones. Barbed wire, razor wire or similar fences shall not be installed within the area encompassed by the downtown specific plan. (b) Electrified Fences. Electrified fences,of any kind other than those permitted by Section 30.34.35 of this Chapter, shall not be installed within the city. (c) Wire Mesh Fences. Wire mesh fences shall not be installed within any required front yard, side yard or rear yard setback area whenever this is adjacent to a street in any residential or commercial zone. In the downtown specific plan districts, no wire mesh fencing will be installed within the front thirty (30) feet or the side or rear twenty (20) feet whenever adjacent to a street or an alley. Wire mesh fences shall not be installed along any water district channel or railroad corridor, unless coated with a dark vinyl or similar material. The solar panel may be augmented by a commercial trickle charger. 3) Perimeter Barrier: Monitored perimeter security fence systems shall be installed behind a non-electrified fence or wall that complies with section 30.34.30(b) of this Chapter. 4) Emergency Gate Access: Before a Monitored Perimeter Security Fence System is activated, a Knox device shall be approved by the Fire Department. The applicant has provided a site plan (Attachment 3) and statement of operations (Attachment 4) further describing their request. BACKGROUND: The City’s commercial use table (Article XIX, Section 30.19.010[c][1]) does not include a provision for “farmer’s markets”, even though they are a prolific use throughout the state of California and the nation. The closest similar use would be “outdoor booths and sales”; however, these uses are considered “temporary”, and are therefore only permitted for thirty (30) days per calendar year, in compli ance with the city’s temporary use policy. When a use is not explicitly listed in the City’s commercial use table, the Planning Commission may apply the district regulations and conditions more broadly, 5.B Packet Pg. 18 2 upon written request. Given the more permanent nature of a weekly farmer’s market, the Community Development Director has recommended the application of a Conditional Use Permit, which allows the Planning Commission to place specified conditions on the proposed use, including, but not limited to, conformity to plans and drawings submitted with the application and limits on time of day for the conduct of specified activities. Pursuant to Article XXXIV, Section 30.50.040, the Planning Commission shall receive, investigate, hear and decide upon every application for a conditional use and, after the hearing, shall approve the issuance of a use permit only if the evidence presented at the hearing establishes: (1) that the proposed use is properly located in relation to the general plan and to the community as a whole and to other land uses and to transportation and service facilities in the vicinity; and (2) that the proposed use, if it complies with all conditions upon which approval is made contingent, will not adversely affect other property in the vicinity, or cause any damage, hazard, or nuisance to persons or property. ENVIRONMENTAL REVIEW: Review and approval of CUP 21-01 qualifies for an exemption from environmental review under California Environmental Quality Act (“CEQA”) Section 15304 (Class 4) of the CEQA guidelines, which provides that CEQA does not apply to Minor Alterations of Land, including but not limited to “m inor temporary use of land having negligible or no permanent effects on the environment, including carnivals, sales of Christmas trees, etc.” where any temporary effects of a nuisance nature can be controlled through the use of permits, such as this conditional use permit and the Department of Public Health permits. Furthermore, the action would not constitute a “project” within the meaning of CEQA under Section 15061(b)(3) of the CEQA Guidelines, which states a project is exempt from CEQA when “[t]he activity is covered by the common sense exemption that CEQA applies only to projects which have the potential for causing a significant impact to the environment. Where it can be seen with certainty that there is no possibility that the activity in question may have a significant effect on the environment, the activity is not subject to CEQA”. DISCUSSION AND ANALYSIS: On February 4, 2021, the City of Gilroy issued a temporary use permit (TUP) to allow T & C Farmer’s Market to begin operations in the Gilroy Premium Outlets parking lot. The TUP was intended as a temporary measure to allow operation of the farmers market until the CUP was presented to the Planning Commission for approval. As provided in the applicant’s statement of operations, the T & C Farmer’s Market sells produce, arts & crafts, and prepared foods including hot dogs, bakery items, hummus, etc. All produce vendors have producer certificates as required by Santa Clara County Department of Agriculture, while all prepared food vendors have permits, as required by Santa Clara County Health Department. T & C Farmer’s Market requires face masks, social distancing, and other COVID-19 preventive measures, as required by the County health department. 5.B Packet Pg. 19 3 T & C Farmer’s Market has a lease agreement with Gilroy Premium Outlets, LLC from February 6, 2021 through June 4, 2021 to operate within a 14,980 square foot portion of the Building C parking lot, on Saturdays from 8:30 AM to 8:30 PM, including time for set-up and tear-down. The 14,980 square foot area is highlighted in orange on the attached site plan. The resolution includes a condition of approval that the farmer’s market shall only operate in compliance with their lease agreement with the management company. Initially, the farmer’s market would likely be open during the morning only and expanding to the afternoon, as needed to meet demand during the busy months between April and September. If successful, T & C Farmer’s Market would also like to expand to additional days per week, including potentially Sundays and/or one Friday per month. However, any such expansion would be contingent upon a modification of their lease agreement. The conditions of approval would allow such expansion to be approved by the Community Development Director, or the Planning Commission at a future public meeting, if warranted. Findings for Approval: The planning commission shall approve the conditional use permit only if evidence presented at the hearing establishes the findings for approval. Based on staff’s analysis, the required findings for approval have been met as follows, and subject to conditions in the draft Resolution of Approval for CUP 21-01: 1. Tents with sides 400 square feet and larger or canopies (no sides) with 700 square feet of area may be required to acquire a tent permit from the Fire Marshal’s Office.
