GILROY OPEN GOVERNMENT COMMISSION
Meeting Minutes
February 25, 2021
I. OPENING
A. Call to Order and Roll Call
Chairperson Esposito called the meeting to order at 7:01 p.m. and announced that the
Commission was meeting remotely via Zoom under the Governor’s Order; he then
detailed the process of public participation.
ROLL CALL:
Present: Commissioner Diana Bentz, Commissioner Karen Enzensperger,
Chairperson Robert Esposito, Commissioner Rebecca Scheel.
Abs ent: Commissioner Matthew Carvalho
B. Welcome Newly Appointed Commissioners Matthew Carvalho and Karen
Enzensperger
Commissioner Enzensperger introduced herself.
II. PRESENTATIONS TO THE OPEN GOVERNMENT COMMISSION
A. PUBLIC COMMENT BY MEMBERS OF THE PUBLIC ON ITEMS NOT ON THE
AGENDA BUT WITHIN THE COMMISSION’s SUBJECT MATTER JURISDICTION
There were none.
III. CONSENT CALENDAR
A. Approval of the Minutes of the November 12, 2020 Special Meeting
There were no public comments.
Motion on Item III. A.
Motion was made by Chairperson Esposito, seconded by Commissioner Scheel
and carried 4-0-1 (Absent: Carvalho) to approve the November 12, 2020 minutes.

IV. UNFINISHED BUSINESS – NONE.
V. NEW BUSINESS
A. Annual Appointment of Chairperson and Vice Chairperson
The staff report was presented by Deputy City Clerk Guzzetta.
There were no public comments.
Motion on Item V. A.
Motion was made by Commissioner Scheel, seconded by Commissioner
Enzensperger and carried 4-0-1 (Absent: Carvalho) to reappoint Robert Esposito as
Chairperson.
Motion was made by Commissioner Scheel, seconded by Chairperson Esposito
and carried 4-0-1 (Absent: Carvalho) to reappoint Diana Bentz as Vice Chairperson.
B. Quarterly Review of Public Records Requests Per Gilroy Code Section 17A.35 (c)
(Fourth Quarter, 2020)
The staff report was presented by Deputy City Clerk Guzzetta.
There were no public comments.
Motion on Item V. B.
Motion was made by Commissioner Bentz, seconded by Chairperson Esposito and
carried 4-0-1 (Absent: Carvalho) to receive the report.
C. Commission Input on City Budget for Fiscal Year’s 2021-22 and 2022-23
The staff report was presented by Deputy City Clerk Guzzetta.
The Commission discussed the City Budget and requested the item return on the May 13,
2021 Commission meeting.
There were no public comments.
VII. CITY CLERK’S REPORT – NONE.
VIII. CITY ATTORNEY'S REPORT
Assistant City Attorney Houston spoke on Public Records Act responses during COVID,
and reported that Berliner Cohen would be an Amicus Brief writer for a Public Records Act
case pending appeal in the Los Angeles area regarding a serial Public Records Act

requester and advised he has started making requests in Northern California.
IX. REPORTS OF COMMISSION MEMBERS
Chairperson Esposito reported on an article he read regarding possible Brown Act
violations in Chico, California.
Commissioner Bentz expressed appreciation for the sessions on Implicit Bias and the
Diverse and Inclusive City at the League of California Cities New Law & Elections
Seminar Training.
X. FUTURE COMMISSION INITIATED AGENDA ITEMS
The Commission requested a discussion on the remaining training budget for the Open
Government Commission.
XI. ADJOURNMENT
The meeting adjourned at 7:41 p.m.
