CITY ATTORNEY'S REPORT Assistant City Attorney Houston spoke on Public Records Act responses during COVID, and reported that Berliner Cohen would be an Amicus Brief writer for a Public Records Act case pending appeal in the Los Angeles area regarding a serial Public Records Act Open Government Commission Meeting Minutes 02/25/2021 requester and advised he has started making requests in Northern California. IX. REPORTS OF COMMISSION MEMBERS Chairperson Esposito reported on an article he read regarding possible Brown Act violations in Chico, California. Commissioner Bentz expressed appreciation for the sessions on Implicit Bias and the Diverse and Inclusive City at the League of California Cities New Law & Elections Seminar Training. X. ADJOURNMENT The meeting adjourned at 7:41 p.m. /s/ Suzanne Guzzetta, CMC Deputy City Clerk Open Government Commission Meeting Minutes 02/25/2021 CITY OF GILROY OPEN GOVERNMENT COMMISSION STAFF REPORT Date: July 8, 2021 To: Open Government Commission Staff: LeeAnn McPhillips, Interim City Clerk Subject: Quarterly Review of Public Records Requests Per Gilroy Code Section 17A.35 (c) (First Quarter, 2021) SUMMARY: Included with this staff report are the following Togs of Public Records Requests for the first quarter of calendar year 2021: • Fire Department Public Records Requests • General City Public Records Requests • Police Department Public Records Requests and Denial Log As the Commission is aware, there was a complete staffing turnover in the City Clerk's Office in April 2021. The full-time City Clerk retired, and the part-time Deputy City Clerk resigned. Unfortunately, the general log of public records requests through March 31, 2021 was not complete at the time of the employee departures. Therefore, over the last couple of months, staff helping to cover the City Clerk's Office on a temporary basis have worked to reconcile the log with the information available. Staff has identified some gaps that have not been able to be reconciled. The office has not received any inquiries or complaints about unfulfilled requests which leads staff to believe the requests were fulfilled, but not logged. To be sure, staff has recently gotten access to data stored within the website as well as former employee email records in an effort to determine when the request may have been fulfilled. If staff is still not able to confirm completion, the next step will be reaching out to the requestor to confirm receipt of information and any request that has not been fulfilled will be given a high priority response. Since the team of temporary interim support has taken over the function, every records request has been logged and tracked for response. The second quarter report for the period April 1 — June 30, 2021 will be provided to the Commission at the regular August meeting. In addition, a further update of the first quarter report will also be provided to the Commission at the August meeting. RECOMMENDED ACTION: Receive report. As new staff providing temporary support to the Open Government Commission reviewed the schedule, it was identified that the meeting scheduled for November 11, 2021 was scheduled on an observed City Holiday (Veteran's Day). Typically, when a regular meeting date falls on a holiday, the regular meeting is rescheduled to the following week. Therefore, it is recommended that the November 2021 Open Government Commission meeting be adjusted to Thursday, November 18, 2021. A draft revised schedule is attached for the Open Government Commission's reference.
