Chairperson Esposito called the special meeting to order at 6:05 p.m. and announced that
the Commission was meeting remotely via Zoom under the Governor's Order and detailed
the process of public participation.
Interim City Clerk McPhillips reported that the agenda was posted on July 2, 2021 at 1:37
p.m.

Bybee provided a verbal update to the pending public records requests and stated
only two are pending as of the meeting.
Chairperson Esposito requested that the Commission receive an update on the two
pending PRA's at the August meeting.

VI. INTERIM CITY CLERK'S REPORT
Interim City Clerk McPhillips updated the Commission on the City Clerk vacancy and
reported that Council is expected to discuss and provide direction on the recruitment at
the August 2nd Council Meeting.
VII. CITY ATTORNEY'S REPORT
Assistant City Attorney Jolie updated the Commission on SB 473 which is likely to pass.
Ms. Jolie reported that SB 473 is a reorganization of the existing Public Records Act and
does not include substantive changes. However, it will take some time to adjust to the
revised format and numbering.
Assistant City Attorney Jolie announced the League of California Cities Attorney Division
has appointed a Succession Committee to create on-line training modules on topics such
as the Brown Act and Public Records.

Subject: Open Government Commission Training Budget FY 2021-22
SUMMARY:
The FY 2021-22 budget approved by the City Council on June 7th includes $2,000 for training
expenditures. The funds could be used for training opportunities that would be beneficial and
valuable to the Open Government Commission and related to subject matters such as public
records and government transparency. Funds are available through the fiscal year ending June
30, 2022.
At its meeting of July 8, 2021, the Commission discussed possible training opportunities through
either the annual League of Cities Conference or the 1st Amendment Coalition organization.
Because the final program for the League's annual conference was not finalized, the
Commission requested this item be continued for further discussion. Since that time, the League
of California Cities published their conference agenda. Unfortunately, there are no sessions
scheduled on the topics of public records and government transparency.
Additionally, staff has looked for other training opportunities and identified two online webinars
that might be of interest. The First Amendment Coalition offers free webinars on topics of free
speech, free press and government transparency. A copy of their recent events with topics that
are on point is attached. The second webinar is a 2021 Public Records Legislative Update
sponsored by the firm of Best Best & Krieger. Information on this webinar is also attached.
RECOMMENDED ACTION:
Staff and Commission will continue to look for training opportunities that become available
during Fiscal Year 2021-22.

17A.35 (c) (Second Quarter, 2021)
SUMMARY:
Included with this staff report are the following logs of Public Records Requests for the second
quarter of calendar year 2021:
• Fire Department Public Records Requests
• General City Public Records Requests
• Police Department Public Records Requests and Denial Log
As the Commission is aware, there was a complete staffing turnover in the City Clerk's Office in
April 2021 and the general log of public records requests through March 31, 2021 was not
complete at the time of the employee departures. As discussed at the July 8th Commission
meeting, staff helping to cover the City Clerk's Office on a temporary basis have worked to
reconcile the log and identified two records requests that had not been completed at the time of
the July meeting. The Commission requested that the two items be carried forward and an
update be provided at the August meeting.
The two carryover items are highlighted on the first page of the attached log. Staff has confirmed
the completion of one request received on 3/2/2021. The second request received on
12/30/2020 was not completed. Given the lack of information and discussion that occurred
between the former Clerk's staff and the requestor, staff is in communication with the requestor.
The request is quite broad, and we are working with the requestor to determine what, if any,
records the City maintains in response to the clarified request. Staff will continue to work on this
until completed and will provide a final report on the next log.
Since the team of temporary interim support has taken over the function, every records request
has been logged and tracked for timely response as reflected in the second quarter report.
RECOMMENDED ACTION:
