This portion of the meeting is reserved for persons desiring to address the Commission on
matters within the Commission’s jurisdiction but not on the agenda. Persons wishing to address
the commission are requested to complete a Speaker’s Card located at th e entrances and
handed to the City Clerk. Speakers are limited to three (3) minutes each. The amount of time
allowed per speaker may vary at the Chair’s discretion depending on the number of speakers
and length of the agenda. The law does not permit Commis sion action or extended discussion
of any item not on the agenda except under special circumstances. If Commission action is
requested, the commission may place the matter on a future agenda.

1. CALL TO ORDER
The meeting was called to order at 7:01 PM by Chair Bentz. The Chair read aloud a
statement announcing that the meeting was being conducted by teleconference
pursuant to the extension of the Brown Act waivers provided for under Assembly Bill
361, as would subsequent meetings so long as the City Council could make findings
that it was necessary in order to protect public safety and the Governor’s declared
emergency in effect.

City Clerk Pham provided the staff report. City Clerk Pham and Assistant City
Attorney Jolie Houston responded to the commissioner’s questions.
Chair Bentz requested staff to investigate the cost of doing training with Best Best
& Krieger. Assistant City Attorney Houston suggested to the commission that she
and the City Clerk could provide training to the commission as well in tandem with
the newly appointed board members and commissioners.

An update was provided to the Commission by City Clerk Pham.
City Clerk Pham notified that there is one open vacancy for the Open Government
Commission with term ending on December 31, 2025. Recruitment period is open until
the seat is filled by City Council.
Commissioner Scheel inquired about her previous request for an update from the
January 20, 2022 Special Meeting requesting updates on hybrid meetings and
Spanish translations and accessibility to Spanish speakers to those meetings. City
Clerk Pham responded that there was no update at this time. Assistant City Attorney
Houston notified that she and City Clerk Pham will provide an oral report to the
commission regarding the status of the two in the next regular meeting.

STAFF REPORT
Agenda Item Title: Open Government Commission Training Budget FY 2021-22
Meeting Date: May 12, 2022

SUMMARY
The FY 2021-22 budget approved by the City Council on June 7, 2021 includes $2,000
for training expenditures. The funds could be used for training opportunities that would
be beneficial and valuable to the Open Government Commission and related to subject
matters such as public records and government transparency. Funds are available
through the fiscal year ending June 30, 2022.
At its meetings of July 8 and August 12, 2021, the Commission discussed possible
training opportunities through either the annual League of Cities Conference or the 1 st
Amendment Coalition organization. Staff also provided information on two online
webinars that might be of interest.
Since then, Staff has notified the Commission about one (1) free webinar from Institute
of Local Government (ILG) on the topic of “Navigating Publi c Meetings” held on January
24, 2022. In addition, staff has looked at Best Best & Kreiger (BB&K)’s as the firm
provides a variety of training to public agencies. Their relevant training t o the
Commission includes:
• Public Records Act Changes to Law Enforcement and Personnel Records (Free
Webinar)
• Comments, Likes and Emojis, Oh My! An Update on Evolving Social Media Law
for Public Officials and Agencies (Free Webinar)

• Ethics Training for Public Agencies

This is the first Public Records Act (PRA) Log provided by this City Clerk. The PRA log
was overhauled to ensure ease of use by the Clerk’s Office staff and provide adequate

for timely response as reflected in the first quarter report. Please note the format of the
log will eventually change once the new PRA management system is active.

Local 104, Sprinkler Fitters Local 483, the District Council of Ironworkers and their members and their families; and
other individuals that live and/or work in the City of Gilroy and Santa Clara County.
Silicon Valley Residents have a strong interest in enforcing the State’s environmental laws that encourage sustainable
development and ensure a safe working environment for its members.
We are making this request pursuant to the California Public Records Act (“Act”),1 and request the above documents

Under the California Public Records Act § 6250 et seq., I am requesting an opportunity to inspect or obtain copies of
public records that show for both the 2019‐2020 and the 2020‐2021 Fiscal Years: 1) Revenues received by the City of
Gilroy as a result of towing vehicles at the city’s request; and 2) Costs incurred by the City of Gilroy as a result of towing
vehicles at the city’s request. Further, I am requesting an opportunity to inspect or obtain copies of records for the two
above‐mentioned Fiscal Years that describes the reason for the city initiation these tows, including, but not limited to
tows for: 5 or more unpaid parking tickets, a vehicle parked in one spot in excess of 72 hours, and unpaid vehicle
registration (i.e., the number of tows for each of these—and any other documented reasons).
I would also like to request a waiver of all fees on the basis that I am a law student seeking this data for research, and
the disclosure of the requested information is in the public interest and will contribute significantly to the public’s
understanding of the costs and benefits to municipal towing practices. This information is not being sought for
commercial purposes.
The California Public Records Act requires a response within ten business days. If access to the records I am requesting
will take longer, please contact me with information about when I might expect copies or the ability to inspect the
requested records.
If you deny any or all of this request, please cite each specific exemption you feel justifies the refusal to release the
information and notify me of the appeal procedures available to me under the law.
Finally, my preference for method of receiving documents responsive to my request is via email. However, if that is not
feasible, USPS mail will work.
