Chair Gullen called the meeting to order at 6:30 p.m. and let the pledge of allegiance.
II. REPORT ON POSTING THE AGENDA AND ROLL CALL
Christina Villarreal reported the agenda was posted on Monday, September 28, 2015 at
10:00 a.m.

IV. PRESENTATION BY MEMBERS OF THE PUBLIC
No comments or presentations were made.
V. PUBLIC HEARINGS
CUP 14-06 (Conditional Use Permit) submitted by New Hope Community Church
requests approval to continue their operations at 8886, 8872 and 8862 Muraoka Drive,
re-locate their administrative operations to 8861 Muraoka Drive, and utilize 8851
Muraoka Drive for overflow parking on Sundays. A previous CUP allowed a 10,491
square foot church use at 8886 Muraoka Drive until October 3, 2007. Since then, the
church expanded its operation without requisite permits to include a connected nursery
(2,430 square feet), pre-kinder activity room (2,430 square feet at 8862 Muraoka Dr)
and children’s activity area (2,430 square feet at 8872 Muraoka Drive). In addition, a
new office (4,940 square feet) is proposed directly across the street at 8861 Muraoka
Drive. At peak use on Sunday mornings, the church use will need 132 spaces to
accommodate their Sunday services and activities. Shared parking arrangements on
the subject properties are in-place for this request. The proposed project is exempt from
environmental review under Section 15301 of the State CEQA Guidelines. Application
filed by Tom Cline and Lon Davis of New Hope Community Church
Planner I Negrete presented the staff report for New Hope Community Church.
Tom Cline, Applicant and Malcome MacPhail, Pastor thanked the city staff for their
services and their assistance with the New Hope Community Church, Conditional Use
Permit process.
Commissioner Sanford asked if they wanted to expand or change their hours, can they?
Planner Negrete stated the permit is specific to the scope we have and they would not
be able to expand.
Commissioner Lai asked if the permit was good for 5 years? Planner Negrete stated the
permit is good for 8 years with a one 1 year extension. Commissioner Lai then asked,
what happens after 8 years? Planner Negrete states they could apply for an extension
but that is the time limit.
Chair Gullen opened the public comments, hearing no comments, he closed the public
hearing.
Disclosure of Ex-Parte Communications:
Commissioner Tom Fischer and Elizabeth Sanford met with the New Hope Community
Church Applicant.

B. RDO-HE 14-02 (Residential Development Housing Exemption) request to allot 75
affordable senior apartment homes in the downtown district pursuant to Gilroy city code
section 30.50.60.2.j. The applicant proposes 60 one-bedroom units and 15 two-
bedroom units. Eighty nine percent of the units constructed in this project will be low
income and eleven percent for very low income. The architectural and site design is not
part of this RDO request and is expected to be considered by the Planning Commission.
RDO allocations are not a project subject to CEQA. The project site is located on the
east side of Monterey Road across from Erwin Court. Application was filed by AMG &
Associates c/o Gene Boussard
Planner I Negrete presented the oral report for the affordable senior apartment homes
stating applicant failed to post appropriate signs at the project location.
Chair Gullen opened the public comments, hearing no comments, he closed the public
hearing.
Chair Gullen stated the item was continued for noticing and then made a motion to
continue.

Motion: to continue RDO HE 14-02 to next Planning Commission on November 5, 2015.

VII. NEW BUSINESS:
A. Envision Silicon Valley Regional and Local Gilroy Transportation measure.
Sue Martin, Planning Manager states, Henry Servin, City Transportation Engineer will
be presenting; however, is doubled booked for the evening and is currently on his way.
Ms. Martin request to move forward with the meeting until Mr. Servin arrives, Chair
Richard Gullen agrees.

A. Current Planning Projects
Sue Martin, Planning Manager gives an update on Harvest Park stating it is in the
Architectural & Site process and waiting for the consultants to complete a noise
analysis.
Commissioner Kai Lai asked if the school district is aware of new projects. Ms. Martin
stated when the City receives an application the school is included in the routing
process.

Commissioner Fischer states there was a subcommittee meeting but no Development
Standards Task Force meeting.
H. General Plan Advisory Committee:
Commissioner Sanford gave a brief summary of the meeting

Commissioner Fischer stated that there was no meeting.
XII. PLANNING DIVISION MANAGER REPORT:
Planning Manager Sue Martin, gave a brief summary of the 3 Planning Commission
meetings coming for November 5th, 12th, and 19th.
City Transportation Engineer, Henry Servin arrives. Chair Gullen continues Item VII.A.
New Business.
A. Envision Silicon Valley Regional and Local Gilroy Transportation measure.
City Transportation Engineer, Henry Servin, gives a presentation for preparation of a
possible new sales tax measure for November 2016 to bring a long term transportation
investments proposed for the next 30 to 35 years.
