Chair Rodriguez called the meeting to order at 6:30 p.m. and led the pledge of
allegiance.
II. REPORT ON POSTING THE AGENDA AND ROLL CALL

IV. PRESENTATION BY MEMBERS OF THE PUBLIC (Three-minute time limit).
V. PUBLIC HEARINGS
A. V 16-02 (variance) requests exceptions to Gilroy City Code section 30.19.20 (c)
(2) to permit a setback exceeding 10 feet at the side yard property line (not
adjacent to a street) and a front building height less than 25 feet, and from Gilroy
City Code section 30.34.30 (a) (1) to permit a six-foot high fence to be located less
than 26 feet from the face of curb. The project is located at 111 Lewis Street, APN
841-04-029, and is commonly known as The Cannery at Lewis Street. The City
Council adopted a negative declaration and mitigation monitoring program for
this project with the approval of tentative map application TM 05-03. These
mitigation measures will be applied to the apartment development. The current
variance request is exempt under Section 15305, Minor Alterations in Land Use

Limitations. Application filed by Meta Housing Corporation c/o Chris Maffris.
Both Commissioner Ashford, and Commissioner Lai had to recluse themselves from
hearing Public Hearing V.A. (V 16-02) as they own/share an interest in property within
500 feet of the said project.
Planner II Durkin provided a presentation on the variance request for project known as
The Cannery located at 111 Lewis Street.
Commissioner Gullen asked for clarification on the Art Panels and fence.
Planner II Durkin stated the recreational and landscaping area will have three pieces of
art with a focal point within the open-view fence making it visible to the public
Commissioner Tom Fischer asked if the height variance occurs on Lewis Street or on
both streets; he also asked if there will be articulation on Genaro
Planner II Durkin stated it occurs on Lewis Street. The 25 height variance stated it’s
only required on the front property line.
Chair Rodriguez opened the public hearing for public comments.
Chris Maffris, thanked the commissioners for their consideration on the variances and
staff members for all of their work.

XI. ORAL REPORTS BY COMMISSION MEMBERS:
A. City Council Meetings of August 15, September 12, and October 3, 2016:
Commissioner Ashford stated they will be a pancake breakfast on Saturday, October
15, 2016 from 8 a.m. to 10 a.m. in front of 7500 Monterey Street (Ashford’s Heirlooms)
with the mayor candidates.
Commissioner Ashford provided a brief summary on the August 15, 2016 meeting, he
attended. A fundraiser was held for the Red Barn raising $22,000.00, matched by a
$20,000.00 grant. The roof is ready to be installed.
Commissioner Armendariz was absent therefore, no discussion was made on the
September 12, 2016, meeting.
Commissioner Lai provided a brief summary on the October 3, 2016 meeting, he
attended.
B. Housing Advisory Committee: Commissioner Gullen
Commissioner Gullen stated there was no meeting.
C. Historic Heritage Committee: Commissioner Ashford
Commissioner Ashford stated there was no meeting
D. Arts & Culture Commission: Vice Chair Kloecker
Vice Chair Kloecker provided a brief summary on the Arts & Culture Commission
meeting, he attended.

XII. PLANNING DIVISION MANAGER REPORT:
Interim Planning Manager Tolentino shared with the commissioners that City Council
recognized the month of October as Planning month through a presentation of a
resolution and acknowledging the City Planners and Planning Commission for their hard
work.
Interim Planning Manager Tolentino asked commissioners to provide a one week notice
via email to both she and Office Assistant, Zinnia Navarro on future agenda items that
provide a conflict for the Commissioners or if they are unable to attend the Planning
Commission meetings.
XIII. ASSISTANT CITY ATTORNEY REPORT:
No Report.
However, Assistant City Attorney Houston reiterated to the Commissioners if they
believe an item on future agendas provide a conflict or have questions, to contact
Interim Planning Manager Tolentino or herself for clarification.
