Agenda item 9.1 (Weed Abatement)
Personal Statement – subject property report line item 148 [APN: 841-73-005]
To whom it may concern,
The subject property of 505 E Luchessa Ave, Gilroy, CA 95020 with APN: 84173-005 was
purchased in May 2023 by Berry Jamieson, LLC. [Recorded Grant Deed Attached] The previous
property owner did not disclose the weed abatement on the property.
When I discovered the tax late in 2023, I reached out to the county to understand the tax and
circumstances. I spoke with Moe Kumre, Santa Clara County Weed Abatement Manager, he
informed me that the county was delayed in reporting in 2023 and the previous owner should
have informed us. Moe suggested reaching back out to the seller and title company for the
financial obligation of the previous owner. I let Moe know that we took ownership at the end of
May 2023 and the site was cleared in June 2023.

Agenda Item No. 9.1
August 5, 2024
Gilroy City Council
I was confused about the process of being removed from the Weed Abatement Program as I
thought having the site cleared and the county inspection would occur and show the site
acceptable, and it would automatically be removed. I later found out that was not the case.
I continued to communicate with the Santa Clara County Weed Abatement department between
May 2024 – June 2024 inquiring about the county inspection and being removed from the Weed
Abatement Program. At that time, I communicated with Jonathan Crick, Gilroy Deputy Fire
Marshal, regarding the removal of our site from the Weed Abatement Program and inspection of
our site. Jonathan provided further instruction on being removed from the Weed Abatement
Program.
Jonathan Crick also let me know he had driven by the site, and it appeared acceptable.

There was a fire on Sunday, June 16, 2024, along the curb of 505 E Luchessa Ave property. The
fire was started by an RV occupant, and I provided video footage of the incident to Greg Lopez,
Fire Division Chief of the Chestnut Street Station. Greg informed me that because of the efforts
we had made in keeping the site cleared the fire was handled quickly.
I am requesting the removal of 505 E Luchessa Ave, APN: 841-73-005 from the Weed
Abatement Program.
