Ordinance 249i r k O R D I N A N C E N 0, AN ORDINANCE AMENDING ARTICLE III OF CHAPTER II OF PART III OF THE MUNICIPAL CODE OF THE CITY OF GILROY BY REPEALING SECTION 343 THEREOF AND BY AMENDING SECTION 3469 BOTH OF SAID SECTIONS RELATING TO PROVISIONS FOR REGULATING THE BUS114ESS OF SELLING INTOXICATING LIQUORS IN THE CITY OF GILROY, AND PROVIDINO FOlt THE REVOCATION OF LICENSES IN CERTAIN CASES, AND PROVIDING PEN+ ALTIES FOR THE VIOLATION OF THE PROVISIONS OF SAID ARTICLE III. The Mayor and Common Council of the City of Gilroy do ordain as follows: -- Section 1 Section 343 of the Municipal Code of the City of Gilroy is hereby re?0ealed. Section 2. Section 346 of the Municipal Code of the City of Gilroy is hereby amended to read as follows: -- Section 346. When it appears to the satisfaction of the Common Council, upon the complaint of the City Marshal, or any citizen of the City of Gilroy, that there is probable cause to believe that any person holding a license under this Article has violated any provision thereof, the Council shall fix a time for the investigation and hearing of said complaint, and at least ten days before the day fixed for the hearing of said complaint, cause a notice of the time set for said hearing together with a cony of the complaint to be served by the City Marshal upon the person holding such license oommanding such Person to appear before the Council at the time Qd place there- in specified, to show cause why the permission and license granted t `� should not be revoked, and the bond given declared forfeited, and on the day set for the hearing the Common Council shall pro- ceed to hear the proofs adduced in support thereof, counter there- to, and if, from such investigation it appears to the satisfao- ti on of the Council that any provision of this Article, or of the bond given, has been vidlated, then by an order entered on their minutes, the Council may revoke the permission and license given, cancel the license issued, and declare the bond given for- feited, or the Council may, in its discretion inVose a fine of not less than Fifty Dollars to be immediately paid into the City Treasury by the person found guilty of violating the provisions Of this Article. If any fine imposed by the Council be not immediately paid into the City Treasury by the person found guilty of violating the provisions of this Article, the Council shall revoke and cancel the license given, and declare the bond forfeited. The decision of the Council relative to the revocation of a license, or the imposition of a fine, or of the revocation of a license after failure to pay a fine as hereinl3efore provided, shall be final. The Common Council may cause subpoenas to be served on any and all persons having knowledge of any violation of this Artiolet requiring them to be present and testify at naid hearing. It shall be unlawful for any person to refuse or neglect to obey such subpoena. Section 3. All ordinances or parts of ordinances in conflict with any of the provisions of this ordibacoe are hereby repealed. section 4.
