THE,, 1 ayor and Coromon Council of the City of Gilroy do ordain as follows:- SECTION I. The Coast Cou'ities Gas and Electric Company, successor to the Coast Counties Light and Power Company, its successors and assigns, is hereby authorized to change part of its general route, all poles from which are suspended wires and other appliances for transmitting electric current, which route is maintained under permission granted by Ordinance No. 243, from that part of the general route which is described as follows " Lewis Street from Railroad Alley to I >onterey Street; thence along East line of IVIonterey Street to Martin Lane" To and along the following route, to -wit: " From the termination of Railroad Alley at Lewis Street along a right of way through Blocks 3 and 4 North Range 1 East of the City of Gilroy, the center line of said right of way being parallel to the Westerly line of land of Southern Pacific Company, and 42 feet West thereof, to Martin Lane (sometimes called I.O.O.P. Avenue) thence Westerly on Partin Lane to I.anterey Street." SECTION II. The City of Gilroy shall have the right to suspend and maintain such wires as it may see fit to carry electric light and power on i 3 the poles of the Coast Counties Gas and Electric Company, its successors and assigns, on the right of way through said Blocks 3 and 4 North Range 1 East above described at all times during the franchise granted to Coast Counties Gas and Electric Company under Ordinance No. 243, of the City of Gilroy. SECTIOU_'rII. The right of way for a pole line through said Blocks 3 and 4 North Range 1 East of the City of Gilroy, hereinbefore fully described, was secured by the City of Gilroy through various grants made to the City of Gilroy by the owners of the property subject to the right of way,which said grants contain the terms under which the City of Gilroy may maintain a pole line on said right of way. By the acceptance of this franchise the Coast Counties Gas and Electric Company agrees at all times to observe and abide by the terms and conditions mentioned and fully set forth in the respective grants secured by the City of Gilroy to construct and maintain a pole line over the right of way hereinbefore described, and during the term of its franchise, the Coast Counties Gas and Electric Company, and its successors and assigns, will be liable for all injury that may happen or accrue to any person or property in said Block 3 and 4 North Range 1 East of the City of Gilroy by reason of its wires, and the Coast Counties Gas and Electric Company, and its successors and assigns, agrees to protect the City of Gilroy from all liability for which the City of Gilroy may become liable under the terms of the grants hereinbefore mentioned, and should the City of Gilroy be compelled to pay any damage for injury to any person or property by reason of said wires on said rights of way, the Coast Counties Gas and Electric Company, its successors and assigns, agrees to repay to the City of Gilroy the amount of said damage, provided however, that in case any claim or action at law is brought against the City of Gilroy for injury mentioned in Id this paragraph the City of Gilroy shall notify the Coast Counties Gas and Electric Company, and its successors or assigns, of such suit or action, and said Coast Counties Gas and Electric Clompany, its successors or assigns, if it so desires shall be permitted to assist the City of Gilroy by Counsel or otherwise in the settlemett or defense of any such action or claim. SECTION IV. Except as in this Ordinance provided none of the rights and privileges granted to or assumed by said Coast Counties Gas and Electric Company as successor of the Coast Counties Light and Power Company under Ordinance No. 243 are altered, changed, abolished or added to. SECTION V. Said Coast Countied Gaa and Electric Company shall apply to the Railroad Commission of the State of California for its approval of the above change, and this Ordinance shall take effect on the day of the filing with the Clerk of the City of Gilroy of a certified copy of an order granting such Approval and of an abandonment in writing, signed by the duly authorized office&or officers of said Corporation, of that part of the route first described in Section I hereof. `� hL Adopted and passed the / day of A�� 1917,p by the following vote: Ayes, Councilmen �.
