Ordinance 383 3~-, ORDINANCE No. 383 AN ORDINANCE RELATING TO THE DISTRIBUTION IN THE CITY OF GILROY OF ADVER. TISING SAM P L E S, HAND- BILLS, DODGERS, CIRCULARS, BOOKLETS AND 0 THE R NOTICES OF COMMERCIAL ADVERTISING. The Mayor and Common Coun- cil of the City of G,lroy do or- dain as follows: Section 1. It shall be unla wiul for any person, firm or corpora- tion to distribute or throw, or procure anyone ,to distribute or throw, upon any ,private yard, lawn, driveway, sidewalk, porch or steps of any residence or pub- lic place, or upon or in any part of any structure, .r up&n any vacant property, or in or upon any motor vehicle or other vehicle parked or standing Upon the streets or in a public place in the' City of Gilroy; any advertising sample, handbill, dodger, circular, booklet,' or other notice of com- mercial advertising prov:ded that nothing in this section shall pro- hibit ,the distribution and delivery of any newspaper which is capable of be.ng or is entered as second class matter under the provisions of the United States Post Office regulations of March 3, 1879, and other United States Statutes, and acts amendatory thereof. Section 2. Any person, firm or corporation violating any of the provisions of this ordinance shall be guilty of a misdemeanor and upon convictiOn thereof shall be punishable by a fine not ex- ceed.ng One Hundred ($100.00) Dollars, or by imprisonment not exceeding twenty (20) days, or by both such fine and imprison- ment. Section 3. If any section, seD- tence, clause, phrase or portion of this Jrdinance is or be for any reason held to be or is or be un- constitutional or void, such inval- idity shall not affect the validity of the remaining portions of this ordinance. The Mayor and Com- mon Council hereby declares that it would have passed such or- diance and each section, sen- tence, clause, phrase, and each por- t:on thereof, irrespective of the fact that anyone or more other sections, sentences, clauses or phrases or portions thereof be de- clared unconstitutional or void. Section 4. This Ordinance shall take effect immediately. Adopted and passed this 5th day of JulY, 1932, by the following vote: AYES, Councilmen F. C. Boock, Geo. Milias, Jr., Geo. Wentz, S. D.
