J ,Ou :~ I ~.-.:"!~ . +- ~ ..5 ORDINANCE 1'10.418 AN ORDINANCE REGULATING THE HOURS OF' BUSINESS WHEN AND THE PLACE OF BUSI1TESS WHERE, UNCURED AND UnCOOKED MEATS ARE SOLD, OFFERED FOR SALE, RECEIVED OR DELIVERED, REPEALING ORDINANCE NO. 388 OF THE CITY OF GILROY, RELATING TO THE SALE OF UN- . CURED AND UNCOOKED MEATS, AND PRESCRIBING A PENALTY FOR THE VIOLATION OF THE PROVISIONS HEREOF. BE IT ORDAINED BY THE MAYOR AND COMMON COU1WIL OF THE CITY OF GILROY AS FOLLOWS: SECTION 1: It shall be unlawful for any person, firm, partner- ship or corporation, to sell or offer for sale any uncured or un- cooked meats (express orders excepted), from any established place of business in the City of Gilroy on the following days, to wit: Sunday, New Y~ars Day, Washington's Birthday, Decoration Day, Fourth of July, Labor Day, Armistice Day, Thanksgiving Day, and Christmas Day; provided, however, that in case of a holiday falling on Saturday, Sunday, or Monday, said established places of business may be kept open between the hours of seven o'clock A.M. and twelve o'clock noon. SECTION 2: It shall be unlawful for any person, firm, partner- ship or corporation, to sell or offer for sale any uncured or un- cooked meats except from an estab~ished place of business within the City of Gilroy, and at which place said meats are regularly inspected by State and Municipal Inspectors. SECTION 3: It shall be unlawful for any person, firm, partner- 1 \~ .._~. Uc :-.J 0.. ~ I .. tf ship or corporation, to sell or offer for sale any uncured or uncooked meats except between the hours of seven o'clock A.M. and six o'clock P.M. on days other than those herein enumerated and set forth in Section 1 hereof. SECTION 4: Be it further provided that in case of emergency the Health Officer of the City of Gilroy may, in his discretion, permit the sale and delivery of uncured and uncooked meats at any time. SECTION 5: Any person, firm, partnership, or corporation violat- ing any of the provisions of this ordinance shall be deemed guilty of a misdemeanor and upon conviction thereof shall be punished by a fine of not more than $100.00 or by imprisonment in the City or County Jail for a period of not more than thirty (30) days, or by both such fine and imprisonment. Each day or fraction thereof any person, firm, partnership or corporation shall violate any of the provisions hereof shall be considered separate and distinct offenses. SECTION 6: Ordinance No. 388, relating to the sale of uncured and uncooked meats, and all ordinances or parts of~dinances, in so far as they conflict with this ordinance are hereby repealed. SECTION 7: This ordinance shall take effect and be in force from and after its passage and approval.
