AN ORDINANCE REGULATING THE DISTRIBUTION, DELIVERY AND
DEPOSIT OF VEGETABLES, MEATS, FRUITS, BREAD, BAKERY GOODS,
GROCERIES, MILK AND/OR OTHER MERCHANDISE AND EDIBLES OF A.
PERISHABLE NATURE TO MERCHANTS AND BUSINESS PLACES WITHIN
THE CITY OF GILROY, AND IMPOSING PENALTIES FOR THE VIOLATION
OF ANY OF THE PROVISIONS OF THIS ORDINANCE.

THE MAYOR AND COMMON COUNCIL OF THE CITY OF GILROY 00
ORDAIN AS FOLLOWS:
Section 1. It shall be unlawful for any person, in~
dividual, firm, copartnership, corporation, association or
any organization or combination thereof to deliver, deposit or
distribute vegetables, meats, fruits, bread, bakery goods,
groceries, milk and/or merchandise and/or edibles of a perish-
able nature to merchants and/or places of business within the
City of Gilroy unless the same shall be delivered, deposited
or distributed from the rear street or alley where such business
is carried on and/or conducted, providing such rear street or
alley is available for such purpose. And'where no rear street
or alley is available to a merchant or business, such gOOds, wares
and merchandise shall be immediately delivered to an enclosed
store room direct, and in no event shall the same be permitted
to be, or remain upon the sidewalk. The aforementioned goods,
wares or merchandise shall also, be only delivered, deposited
and/or distributed to an enclosed store room direct or to or
upon a platform at least three feet above the ground, sidewalk
or street level, and such platform shall be so oonstructed and
maintained that dogs, cats or other stray animals shall not have
access to said perishable goods,wares and merchandise.
Section 2. It shall be unlawful for any person, firm or
corporation to permit, suffer or allow any meats, vegetables,

fruits, bread, bakery goods, groceries, milk and/or other
edibles or merchandise of a perishable nature to be and/or
remain on any street, public place or open place within said
City where the same may in any way come in contact with or
be contaminated by any dogs, cats or other stray animals except
that said goods, wares and merchandise may be placed upon &
platform as herein above set forth. No such platform shall
be constructed and/or maintained on any side walk in said City.
Section 3. Any person, firm, association or corporation
violating any of the provisions of this ordinance shall be
deemed guilty of a misdemeanor and upon conviction thereof shall
be punished by a fine of not more than $100.00 or by imprison-
ment in the City or County jail for a period of not more than
thirty (30) days, or by both such fine and imprisonment. Each
day or fraction thereof any person, firm, association or cor-
poration shall violate any of the provisions hereof shall be
considered separate and distinct offenses.
Section 4. All ordinances or parts of ordinances, in so
far as they conflict with this ordinance are hereby repealed.
Section 5. This ordinance shall take effect and be in force
from and af'ter its passage and C!provale
