Ordinance 376 3!1(] ORDINANCE NO. 376 AN ORDINANCE CALLING AND PROVIDING FOR AND GIVING NOTICE OF A SPECIAL ELECTION TO BE HELD IN THE CITY OF GILROY, STATE OF CAL IFORN IA, ON I'HtJR6DAY, THE J.sJk DAY OF OCTOBER, A. D. 1931, THE OBJECT BEING TO SUBMIT TO THE QUALIFIEP ELEC.TORS OF SAID CITY A PROPOSITION TO INCUR A BONDED DEB'f BY SAID CITY OF GILROY FOR THE PURPOSE OF THE ACQUISITION, CONSTRUCTION AND COMPLETION OF A MUNICIPAL IMPROVEMENT, TO-WIT: THE BORING AND CONSTRUCTION OF A WELL TO FURNISH WATER FOR THE INHABITANTS OF THE CITY OF GILROY AND THE INSTALLATION OF A PUMP THEREON, AND SUCH BUILDINGS AND EQUIPMENT AS MAY BE NECESSARY IN CONNECTION THEREWITH. ! i I WHEREAS, the Mayor and Common Couneil of the City of Gilroy I did, on the 21st day of September, A. D. 1931, duly approved by the Mayor of the City of Gilroy, who is the executive of said City; NOW, THEREFORE, the Mayor and Common Council of the City of Gilroy do ordain as follows: Seot~()J:l 1. City I I I I I Ii II II I I, 'I - I of Gilroy, in Gilroy, California, as follows: Bonds Numbered 1 and 2 on the first day of January, 1934; Bonds Numbered 3 and 4 on the first day of January, 1935; Bonds Numbered 5 and 6 on the first day of January, 1936; Bonds Numbered 7 and 8 on the first day o.f January, 193'; Bonds Numbered 9 and 10 on the first day of January, 193e; Bonds Numbered 11 and 12 on the first day of January, 1939; Bonds Numbered 13 and 14 on the first day of January, 1940; Bonds Numbered 15 and 16 on the first day of January, 1941. 2 D!! .' The special election hereby called and ordered to be held shall be held and conducted, and the vote thereat received and canvaBsed and the returns thereot made, and the result there- of ascertained and determined and declared as herein provided, and acoording to the laws of the State of California providing and governing elections in the Ci~y of Gilroy. The polls tor such election shall be opened at six o'clock A. M. on the J,5th day ot October, 1931; and shall remain open until the hour of seven o'clook P. M. of said day, at which time said polls shall be closed. The ballots to be used at said election shall be such as may be required by law to be used thereat, and in addition to any other matter required by law to be printed thereon, there shall be printed the following: "MUN' Ie I PAL TICKET" To vote tor a proposition and thereby authorize the incurring right of the word "yes". e bonded indebtedness to the amount of, and for the purpose stat I in such proposition, stamp a eross (x) in the blank space to the I I I authorize I I I To ~ote against a proposition and thereby refuse to the incurring of a beDded indebtedness for the amount of and tor the purpose stated in said proposition, stamp a cross (x) in the blank space to the right of the word "no". Also said ballot shall have printed thereon the following: Shall the Oity of Gilroy inour a bonded debt to the amount of tsoOO.OO tor the pur- pose ot the acquisition, construotion and complet~on of a municipal improvement, viz: the boring and construotion of a well to fur- nish water to the inhabitants of the Oit7 of Gilroy, and the installation of a pump thereon, and such buildings as may be neces- sary in connection tberewith, ~uch debt to bear interest at the rate of'~ peroentum per annum, payable semi-annually. - Yes No :s Sample ballots containing the above matter required to be printed thereon shall be supplied to the electors of said City ot Gilroy by the City Clerk, but failure on the part of any elector to receive such sample ballot shall not be held to in- validate the election or effeot in any ~anner the legality ot any bdnds that may be authorized thereat. Section 3. Any qualified elector of the Oity ot Gilroy who has complied with the law governing the registration ot voters may vote at said special eleotion tor or against the proposition therein submitted. To vote in tavor ot and thereby authorize the incurring of a bonded debt tor the purpose set forth in suoh proposition, he shall stamp a cross (x) in the square to the right ot the word "yes", printed opposite the proposition. To vote against and refuse to authorize the incurring of a bonded debt for the purpose set forth in such proposition, he shall stamp a cross (x) in the square to the right of the word "no" printed opposite the proposition. Each cross (x) stamped in the square to the right ot the word "yes" shall be counted as a vote in tavor of and to author- ize the incurring of the bonded indebtedness for the purpose set forth in the proposition opposite to which the cross (x) is " stamped, and each cross (x) stamped in the square to the right of the word "no" shall be counted as a vote not in favor of and a refusal to authorize the incurring of a bonded indebtedness for the purpose set forth in the proposition opposite to which such cross (x) is stamped. Section 4. The City Clerk is hereby direoted to provide all supplies that may be necessary to properly and lawfully conduct said Sp6C-1 ial election. I When the polls are closed the officers of the election shall count the ballots cast at suoh special eleotion and canvas the votes oast respectively for and against the proposition herein stated, and make return thereot to the Mayor and Common Counoil ot the City of Gilroy, in the time, torm and manner required tor the counting, canvassing and returning ot votes cast at other municipal elections in the City ot Gilroy.
