Heck Resolution no. 57 was passed and ~dopted as follows:

A Resolution adopting a certain agreeement made and entered
into as of April 11th, 1935, betwe';n the City of Gilroy, a munic ipal
corporntion, party of the first part, Charles B. Sloan of San Fran-
cisco, California, and Donald C . Brooks of San I~teo, California,
parties of the cecond part, and Charles H. Kirkbride, Ernest A. ':1il-
son and donald:::. Brooks, of i3an Mateo, California, copartners prac;..;
ticing l:;,w under the firm name of Kirkbride, ':Tilson & Brooks, par-
ties of t~e third part.
1'i}lci1~C:;AS, t',e said Donald C. Brooks as plaintiff' recovered a judg-
ment against the said City of Gilroy, as of December 4th,1931, in the sum
of.r 11,772.67, which judgment vms final and no part thereof has been
psid, and,
',EZREAS, an action is now pending wherein Charles E. Sloan is
plaintiff and the scid City of Gilroy is defendant, in the Superior
Court of the State of California, in and for the County of Santa
Clara, and

aforementioned indebtedness, if any, and the said judgment in the man-
ner and form set forth in the agreememt herein referred to, and,
