RESOLUTION No. ~
RESOLUTION OF THE COlv'IMON COUNCIL OP THE Crrry OF GIIROY PROVIDING
FOR NOTICE OF THE PROPOSED ANNEXATION OF UNIl{HABITED TERRITORY
TO THE CITY OF GILROY UNDER THE "ANNEXATION OF UNINHABITED
TERRITORY ACT OF 1939".
VffiEREAS a written petition has heretofore been filed
in the office ~f the Clerk of the C~ty of Gilroy,~nder the
provisions of the "Annexation of Un~nhabited Terr~tory Act
of 1939" (Statutes of 1939 Chapter 297), asking that there
be annexed to the City of ~ilroy as uninhabited territory the
following described tract of land contiguous to the city
limits of the city of Gilroy, situated in the County of Santa
Clara, State of California, to-wit:
"Beginning at a point in the Easterly
line of Miller Avenue and the Westerly
line of the City of Gilroy from which
the Northeasterly corner of 'Tract No.
506, Castlewood Park, Unit No.1', as
shown on the Map recorded in Book 18
at page 40 of maps, Official Records
of Santa Clara County, bears N. 89008'
30" W. 80.00 feet and running thenoe
N. 89008'30" W. 230 feet to the North-
west corner of Castlewood Park; thenoe
Southerly along the Westerly l:tne of
Castlewood Park to the southerly line
of Third Street; thence Easterly along
the Southerly line of Third Street to
the Westerly line of Miller Avenue;
thenoe Easter1v across Miller Avenue
to the interse~tion of the Southerly
line of Third Street with the Easterly
line of Miller Avenue; thence Northerly
along the Easterly line of Miller Avenue
to the point of beginning."
AND VflIEREAS, it appears that said petition has been signed
by the owners of not less than one-fourth of the area of the
land in such territory, and represents not less than one-
fourth of the assessed value of such territory according to
the last preoeding equalized assessment roll of the County
of Santa Clara in which such territory is situated, and that
the tract therein described is contiguous with the corporate
limits of the said city of Gilroy, and
v1.HEREAS the said petition has heretofore been referred by the
Common Council of the City of Gilroy to the City Planning
Commission of the said City of Gilroy for its investigation
and recommendation, and that said Planning Commission has made
its report and recommendation to the said Common Council in
favor of the annexation of said territory under certain condi-
tions in the said report set forth, and
WHEREAS the "Annexation of Uninhabited Territory Act of 1939"
requires that upon the filing of such a petition a resolution
be adopted by the Common Council giving notice of such proposed
annexation and fixing the time and place of hearing, when and
where any person .owning real property within the territory
proposed to be annexed, may appear and object thereto.
NOW, THEREFORE, BE IT RESOLVED, that the Common Council of the
City of Gilroy hereby designate the said territory as "Castle-

1948, at the hour of 8:00 o'c~ock p.m. 01" sa ay, in the '
Council Chambers of the' City Hall Gilroy, California, has
been and is hereby fixed as the time and plaoe when and where
any person owning real property within such tract so proposed
to be annexed, and having any objeotions to the proposed
annexation, may appear before the said Common Council and
show oause in writing, if any he has, why such territory
should not be so annexed.
