Resolution 229 L ., RESOLUTION NO.229 I I I ACCEPTING DEDICATION OF STREETS Al\J1) ALLEYS SHOWN ON MAP OF TRACT NO. 506,CASTLEWOOD PARK UNIT NO.1, A SUBDIVISION mB LAS ANIMAS RANCHO LOT 16, AND ORDERING TH~ OPENING OF SAID ALLEYS. WF~REAS, San Martin Sales Company, a partnership,consisting of Michael J.Filice ,Frank L.Filice,John M.Filice,Peter C.Filice,James H.Filice and Pasquale Lico have established a subdivision knownas Castlewood Park,Unit NO.l,Tract 506, and the map thereof is recorded in the office of the County Recorder,in Book 180 of maps,page 40, on the 15th day of June ,1948; and VmEREAS, at the time of the recordation of said map the said sub- division was not a part of the incorporated area of the City of Gilroy, r 1133 County of Santa Clara,State of California; and rlHEREAS, since recordation of said map that portion of said sub- di vis ion extend ing North 0 f the center line of 'I'hird Avenue and West of the center line of Miller Avenue, the sane cdluprising Blocks 3 and 4 as shwon on said map ,have been annexed to and b econe a part of the incorporated area of the::::ity of Gilroy; and ~,'.h"'EREAS, there is ::,hown on said map an alley along the entire West- erly boundary ;ine of said Block 3 and 4 and constituting that part of the subdivision now included 'within the City Linits of the City of Gilroy, lying West of a line designated on said map as "Public U~ili- ties Easement and Future Alley Line"; and TIBEREAS, in the owners certificate of dedication on said map there is the following: "We also thereby dedicate for public use those certain strips of land lying between the lines 0 f streets and the lines each designated as rtfuture alley line", as s hovm on said IJap within said subdivision, reserving to ourselves for the use of succ- essive owners of the respective lots certain rights of use of such portions of said strips of land as lie within the bound- aries of said respective lots, said rights of use being such as are incidental to the care,planting and cultivation of such portions of said strips of land, but not including the construction of buildings or structures of any kind ,excepting irrigat ion and sprikkling systems and appurtenances thereto; said reservation 0 f such rights to terminate and to be of no further effect at such tine as the governing body having juris- diction shall order the strips of land opened as public alleys~ ''iHEREAS , it now appears desirable and necessary that the said alley way hereinbefore and in the owners certificates mentioned be now opened to public uses as a public alley and throughfare in the City o f Gilroy; Nor: , THJ~REFGRE, BE IT RESOLVBD AiID IT IS HI~H}~BY ORDERED that all of said portion of the said Subdivision of said Blocks 3 and 4 of said Subdivision lying ""lest of the said line designated "Public Utilities Easement and Future Alley Line" be accepted as a public alley and be opened and is hereby declared open as a public alley and throughfare of' theJi ty of Gilroy and the sane shall henceforth be subject to the rigllts of the public to use the same as an alley 1'laY.
